06-04-1992 Regular Meeting• • • CODE ENFORCEMENT BOARD REGULAR MEETING JUNE 4, 1992 A regular meeting of the Miami Shores Village Code.Enforcement Board was held on June 4, 1992 at 7:30 P.M. at the Miami Shores Village Hall. The meeting was called to order by Mr, Barry Asmus, Chairman, with the following members present: Barry K. Asmus, Chairman Margaret Burch Thomas J, Caldwell Owen Henderson.111 Daniel B, Owens. John L. Patnik, Jr. Absent: John L, Stokesberry Also present: Frank LuBien, Director of Code Enforcement Pierre Roche, Code Enforcement Inspector Richard Trumble, Code Enforcement Inspector 1. MINUTES a MAY 7, 1992 The minutes of the meeting of May 7, 1992 were approved, as written, by a motion made by Nrs. Burch, seconded by Mr. Owens, and passed unanimously. 2. REQUEST FOR RELIEF CASE NO, 002510 WASHER & DRYER PLACED.OUTSIDE OF HOUSE JEAN M. ALPHONSE, 150 N. W. 99th ST Included in Members packet was a copy of the letter from Mr,. Jean Alphonse requesting relief of the fine, and Customer Inquiry of the violation. Mr. Alphonse was sworn in as was Mr, LuBien, Mr, Roche and Mr. Trumble for their testimony of the evening. Mr. Alsphd^'se testified that he was not aware of a violation until it was called to his attention by Mr, Roche, at which time itwas corrected immediately. He stated he lives in New York, his mother Who speaks no English lives in the house. Nike Alphonse responded to other...questions asked by Members of the Board, Amotion made by Mr, Caldwell that the Administrative fee of $110.00 remain and all but $50.00 of the fine be waived, seconded by Mr Henderson, failed by the following vote: Mrs, Burch No Mx. Caldwell Yes Mr. Henderson Yes Mr, Owens Yes Mr, Patnik No Mr, Asmus No. A motion was made by Mrs Burch that the $110,00 Administrative fee remain and $400.00 of the fine remain and that there is relief of $1,250, The motion was seconded by Mr. Patnik and passed 4/2. Mr. Caldwell & Mr. Owens voted No. 3. REQUEST FOR RELIEF CASE NO,. 002615 EXPIRED OCCUPATIONAL LICENSE (HOUSE RENTAL) CECELIA D. HUDSON, 6 NW 107th ST Mrs. Hudson was sworn in. She stated. she does not rent the house, JT r cousin, Pat Randolph lived in the house for awhile, but no rent was charged. HEARING, CASE NO, 00.2649 WEATHEBTIG 1T & WATERTIGHT STRUCTURES REBECCA GAIL HENRY, 109.9 N, E. 97th ST Trumble stated hewas' in touch..with.Mrs, Henry. by phone only, The violation remains, Mr. Owens Moved for. Finding of Fact and Conclusion of Law a violation does exist to Sec 12-128, ordered that an Administrative fee of $110,OQ be assessed, and $25,00 per day fine if the roof tiles are not in place in 3Q days, Mr. Caldwell seconded the motion and it passed unanimously, 6, HEARING, CASE NO. OQ2654 UNSIGuTLY FASCIA, SOFFIT, HOUSE EXTERIOR JAMES BENNES, 770 NE 97th ST Mr, Hennes was sworn in, The facts were presented by Mr, Trumble as Members reviewed pictures of the. violation, Mr. Mennes gave his explanation why the garage door was not repaired earlier, Because of the l4rge size of the door it had to Be specially ordered. A permit bas been obtained, Br. Henderson made a motion to .charge a fine of $25,00 per day if the violation i .not corrected in 30 days, The notion was seconded by Mrs. Burch, and carried unanimously, 7. HEARING CASE NO,002671. WEATHERTIGHT AND WATERTIGHT STRUCTURES ELIZABETH B, STONEHOUSE HOFFMAN, 1210 N, E. 97th ST Mr, Greg Hoffman of 9306 NE 9th Ave, and son of Mrs, E LI. Stonehouse Hoffman was sworn in, 'Members looked at pictures of the violation as Mr, Trumble stated facts of the violation and that he had no contact with the owner or the son, The house is in fine condition except for this leak, Mr. Hoffman stated that the house had a new pitched roof installed by Carruth Roofing about three years ago, The: roof has been patched but apparently it still leaks. The reason tiles are missing is because they are looking for a leak. Hismother is 75 and the house was vacant for a while, Mr, Caldwell moved that the violation:be corrected in 30. days or a fine of $25,00 per day will be levied, Mr, Henderson seconded the motion which passed unanimously, • • • CODE ENFORCEMENT BOARD REG MIG -3r 6/4/92 8. HEARING, CASE NO, 002679 PET LIMITATION AND CONTROL 10916 N. W, 2nd AVE OWNER: LOUIS V, BARTLETT Mr. Roche stated the facts df the case and noted it is still not in compliance, Mrs. Bartlett refuses to admit him for inspection. Members reviewed the police report fohthis situation, Mrs.. Bartlett was sworn in, She stated she has only 4 cats which have been declawed, nurtured and spayed. She Ades feed other stray cats in the neighborhood, Members ad— vised her this is the problem and the source of the fowl odor coming from the house, Mr. Henderson moved that.the'case be continued for thirty days to see if Mrs. Bartlett will let Mr, Roche examine the house for number of cats and hope she will be in compliance. The motion was seconded by Mr. Caldwell and passed unanimously, 9. HEARING, CASE NO 002685 INOPERABLE VEHICLE ON PREMISES 130 Nit 97th ST OWNER.; S & S INVESTMENT CORP, TENANT:.NANCY GONZALEZ Ili'. Roche explained' the` pease on. the.vehicle is expired and compliance has not been met, The house is in the process of changing hands and the vehicle belongs to the former owner, Members reviewed pictures of the vehicle and the license plates. Mrs, Burch moved for 'Finding of Fact and Conclusion of Law a.violation exists to Sec 13-1 of the Code, ordered that a $110,00 Administrative fee be assessed.and if the violation is not corrected in thirty days: a fine of $25.00 per day be levied,, The motion was seconded by -Mr. Caldwell and passed by a 5/1 vote, Mr. Henderson voted No. 10. HEARING, CASE NO 002704 UNLAWFUL OCCUPANCY GEORGE A. LINARES, 597 NE 93rd St, Mr. Trumble stated the facts of the case, Mr. Linares was sworn in. He stated his family lived. in N. Y,, He does rent the house, and was not aware that a. license is. needed. He did pay;ifor one this evening. He further stated. that he did have a room in the house until he rented an apartment in Miami Beach for the week end, when home from work. GEORGE A. LINA1ES, 597 N. E. 93rd ST Members looked at pictures as Mr. Trumble noted compliance has not been Mr, Lenares noted he will take a day off from work and clean up tomorrow, He was advised that it can be done while he is home over the weekend. Mrs, Burch made a motion that the violation be corrected in 30 days or a fine of.$25.00 per day will become effective, The motion was seconded by Mr. Patnik and failed by the following vote; T+s . Henderson moved for Finding of Fact, a violation exists, Conclusion of Law this is a violation of 12104 of Miami Shores Village Code ordered that an Administrative fee of $110,00 be assessed and a fine of $25.00 per day levied after 30 days.if the violation is not corrected, Mr. Owens seconed the motion which passed unanimously. met.
