The regular meeting of the Miami Shores Village Code Enforcement Board
was held on January 2, 1992 at 7:30 PPM, at the Miami Shores Village Hall,
The -meeting was called to order by Vice Chairman, John $tokesberry, with the
following members present; John L. Stokesberry, Vice Chairman

Barry K. Asmus, Chairman
Also present; Frank LuBien, Director of Building & Zoning
Pierre Roche, Code Enforcement Inspector

CASE NO. 002377
UNSIGHTLY FASCIA SOFFIT HOUSE EXTERIOR
9600 N. MIAMI AVE. OWNER; CARLOS SANCHEZ
of December 5, 1991 were. approved by a motion
by Mrs, Burch, and carried unanimously.
Mr. LuBien introduced the case. He noted this item was tabled from the
November 1991 meeting and he read from the minutes of that meeting. Mr. Sanchez
was not present, but did call Mr, LuBien to explain his situation, Mr. Sanchez
told him that in the divorce settlement he was awarded the house,lbut the
financial settlement hurts, He does intend to fix up the house, but must obtain
the funds to do so.
Mr, Henderson moved to table the case to the March meeting, seconded by
Mr. Stokesberry. After -discussion, the motion passed by a 5/2 vote. Mrs. Burch
and Mr. Asmus voted No,

UNAUTHORIZED CONSTRUCTION/ALTERATIONS
9101 BISCAYNE BLVD, OWNER: THOMAS T. LIN
Mr. Lin was present and was sworn in,
Mr. LuBien, Mr, Trumble, and Mr, Roche were also sworn in for their testimony
of the evening,
Mr. LuBien noted this case also was tabled from the November meeting, Mr. Lin
did receive approval from the Planning & Zoning Board, but must go before Council.
Mr. Stokesberry moved to table the case another month, seconded by
Mr. Henderson, and passed by unanimous roll call vote.

PEELING EXTERIOR PAINT
9305 N. E. 9th AVE, OWNER: JACQT'JELING FROHBOSE
Mr. Frohbosewas sworn in,
Mr. LuBien introduced the case stating it too was continued from the meeting
of November 1991, Mr. Trumble stated inspection showed, all the work is complete
except for one wall,

Mr. Frolibose explained, he tried, but just couldn't complete the work, in
spite of working on it every weekend. He stated he can have it finished in
thirty days,
Mr, Stokesberry moved to continue this case for another 30 days, seconded
by Mrs, Burch and passed by unanimous roll call vote,

MAINTAINING A NUISANCE
1245 N, E. 93rd ST,® OWNER: GREAT WESTERN BANK LEGAL DEPT,
No one was present from the Bank Legal Dept,
Mrs, Burch moved for a Finding of Fact, a violation does exist, Conclusion
of Law this Is a violation -of Sec 10,9 of Miami Shores Village Code of Ordinances,
ordered that.$110,00 Administrative fee be imposed, and $25,.00 per day fine if
the violation isnot corrected in thirty days, The motion was seconded by
Mr, Stokesberry, and passed unanimously.
4, HEARING, CASE NO. 2458
COMMERCIAL VEHICLE IN RESIDENTIAL ZONE
113 N. E, 106th St, OWNER; KENNETH KRAFT
Mr, Kraft was sworn in, Mr, Kraft stated he does understand the ordinance,
but has a real problem with the vehicle. The lettering is permanent, and the
vehicle is used in his work, He explained he would like to put it in the garage,
but the garage is too full now and it would take time to clean it out. Mr. Kraft
further notedhe needs more time to find a solution,
Mr, Roche stated that in spite of the Notice of Violation and -neighbors
complaints, the vehicle remains parked at the residence.
In discussion several solutions were suggested, but these circumvent the
Ordinance. Discussion continued,
Mr, Stokesberry moved for.Finding of Fact & Conclusion of Law, a violation
does exist to the Sechedue of Regulations,ordered no.Administrative Fee be
assessed, but if not corrected in thirty days a fine of $25.00 per day will be-
come. effective. Mr. Caldwell seconded the motion which passed by unanimous roll
call vote,

Mr, LuBien introduced the case, Mr, Trumble stated the facts, and showed
pictures of the violation,
Mr. Daniel Owens moved for Finding of Fact a violation does exist,
Conclusion of Lawjhis is a violation of Sec 6-4 of Miami Shores Village Code of
Ordinance, ordered. an Administrative fee of $110.00 be paid, and;$25.00 per day
if the violation is not corrected in thirty days, Mr, Stokesberry seconded the
motion which:passed unanimously,

Members reviewed pictures of the violation,
Mrs. Burch made a motion for Finding of Fact and. Conclusion of Law a
violation does exist to Sec 12-133 of the.Code of Ordinance, ordered that $110,00
Administrative fee be assessed, and $25,00 per day if the violation is not
corrected in 30 days. The motion was seconded by Mr. Caldwell, and passed
unanimously.

The case was- introduced, and the facts presented by Pierre Roche, who also
showed Members pictures of.the violation,
Mr. Caldwell made a notion for Finding of Pact a violation does exist,
Conclusion of Law this is a -violation of Sec 12_,133, ordered thata $110,00
Administrative fee be assessed.and a fine of $25.00 per day if the violation is
not corrected in thirty -days, Mr; Henderson seconded the motion which passed
unanimously,

INOPERABLE VEHICLE ON PREMISES
428 N. E. 91st St, OWNER; LUIS CARAZO
Mr, Trumble presented the facts of the case. He stated there has been
no contact nor change in the situation.
Members looked at pictures of the violation,
Mr. Stokesberry moved for Finding of Fact a violation exists, Conclusion
of Law this is a violation of Sec 13-1, ordered that an Administrative fee of
$111,m be assessed, and $25,00 per day fine if the violation is not corrected
in thirty days, the motion was seconded by Mrs, Burch, and passed unanimously.

The case was introduced.and the facts presented by Mr, Roche, as Members
looked at pictures of the violation,
Mrs. Burch moved for Finding of Fact and Conclusion of Law -a violation
does exist to Sec 10,1 .of the Miami Shores Village Code of Ordinances, Ordered
that an Administrative fee of $110,00 be assessed, and if not corrected in
30 days, a fine of $25.00 per day will become effective, Mr. Caldwell seconded
the motion which passed unanimously,
