CODE ENFORCEMENT BOARD REGULAR MEETING
SEPTEMBER.61 1991
The regular meeting of the Miami Shores Village Code Enforcement Board
was held on September 6, 1991. at 7:30 P.M. at the Miami Shores Village Hall.
The meeting was called to order by the Chairman, Barry K. Asmus, with the

1. MINUTES -- August 1, 1991
The minutes of the meeting of August 1, 1991 were approved by a motion
made by Mr. LaBarre, seconded by Mr. Caldwell, and passed unanimously.
Cases were taken in order as per agenda. and those people who were present.
2. HEARING, CASE N0 002183
FAILURE TO MAINTAIN PARKWAY

TENANT; SUNNY SUNDAR
Mr. Sundax was- sworn in. LuBien, Mr, Rodriguez,. and Mr, Trumble,
also were sworn in for their testimony of the evening.
Mr, Trumble testified that Mr. Sundar had obtained.a permit and work to
pave is in progress. The violation is corrected. Mr, Sundar noted that he
has been out of the country, therefore the delay.
Mr. Caldwell moved to dismiss the case, seconded by Mr. Henderson, and
carried unanimously,

UNAUTHORIZED CONSTRUCTION/ALTERATIONS

OWNER: MICHAEL SALZVERG
Mr. Salzverg was sworn in.
Mr. Rodriguez reported a permit has been obtained, the violation is now
corrected,
Mr. Caldwell moved to dismiss the case, seconded by Mr. Henderson, and
carried unanimously.

Na, Mildred Drown was sworn in to speak -for her mother,. Anne Smith. Members
reviewed photographs. of the violation.

Mr. Rodriguez outlined someof the problems at the residence. He stated
the case is a repeat violation, and showed addiitional material to bear•this out.
Ms. Brown noted that her mother, Anne Smith has not lived.in the house since
1982, she is deceased and the house which was rented is: vacant at this time. The
tenants moved.. out leaving the house in,a state of general diarepair. Ms. Brown
further stated, she is in the process of finalizing the estate.
Nr. Asmus suggestes:, Brown work with Mr. Rodriguez. and Mr. LuBien to
obtain a permit and bring the house into code compliance.
Mr. LaBarre moved to table the Hearing to the next meeting, seconded by
Mr. Henderson, and passed unanimously.
Mr. Asmus also instructed Ms. Brown that an Occupational License must be
obtained for rental property. Mr. Caldwell suggested also.that since the
general unsightliness of the yard causes her so much problem, she might think
about having a yard service to do the lawn on a regular basis,

Mr. Campbell was sworn in,
Mr. Trumble stated he had.given Mr. Campbell an extension and that
Mr. Campbell had attended the last meeting, the case was postponed to this meeting.
He refreshed Member's memory about the case., Mr, Campbell.stated.he was out of
town a week and had already been taken for $5,200,00 to do.the. job. Mr. Caldwell
suggested he report this to the police, Mr. Campbell stated, he does now have
a person from Ft. Lauderdale. who will lay the tiles, and he showed Members a
statement to proceed.
Mr. LaBarre made a motion to table the Hearing to the next meeting. The
motion was seconded by Mr, Stokesberry, and carried unanimously.
6. HEARING, CASE NO. 001955

OWNER: ROBERT C. HANNA
Mr. Rodriguez explained that. Mr. Hannah was a candidate for work on his
house by the_4ayor's Task Force, but they are unable to help until they are
reactivated. Mr. Hanna in the meantime obtained a loan from a relative to do
the necessary work which is now in progress.
Mr. Stokesberry moved to table the hearing to the next meeting, seconded
by Mr. LaBarre and carried unanimously.
7. HEARING, CASE NO. 2202
UNAUTHORIZED.CONSTRUCTION/ALTERATIONS

OWNER: MICHAEL ZOROVICH
Mr. LuBien reported that blueprints have been submitted., a permit was
obtained, and the violation now corrected.
Mr. LaBarre moved to dismiss the case, seconded by Mr. Owens, and passed
unanimously.

Mr. Rodriguez reported his last inspection revealed the. violation still
has not been corrected. The owner of the property is now. HUD. This property
also is a repeat offender.
Mr. LaBarre moved for:Finding of Fact and Conclusion of Law a violation
exists to Sec 12-133 of Miami Shores Village Code of Ordinances, ordered that
a $110.00 Administrative fee be assessed, and if not corrected in 30 days, a
fine of $25.00 per day becomes effective. The motion was seconded by
Mr. Henderson, and carried unanimously.
9. HEARING, CASE NO. 002283
HEDGE/FENCE BEYOND HEIGHT LIMITATIONS
326 N. E. 92nd ST.
OWNER: BERNARDITA R. BRYANT
Mr, Rodriguez reported, this violation should have been corrected by
Augus:t:.15, 1991. His inspection on August 19, 1991 showed compliance still
has not been met. This is a repeat violation of different codes,
Mr. Henderson made a motion for Finding of Fact, a violation does exist,
Conclusion of Law this violates 518(A), ordered that an Administrative fee of
$110.00 be assessed and if the violation is not corrected in 30 days a fine
of $25.0Q per day becomes effective.
10. HEARING, CASE NO. 2301
INOPERABLE VEHICLE ON PREMISES
46 N. W. 95th STREET
OWNER: ANDRE HILAIRE
Mr. Rodriguez reported the violation of .Sec 13-3 should have been
corrected August 21, 1991, his inspection on August 22, 1991 revealed the
violation was still not corrected.
Mr. LaBarre made a motion for Finding of .Fact and Conclusion of Law a
violation to Sec. 13-3 does exist, ordered that $110.00 Administrative fee
is assessed, and if not corrected in 30 days, a fine of $25,00 per day becomes
effective.

Mr. Rodriguez reported this violation should have been corrected by
August 21, 1991, his inspection on. August 22, 199.1 revealed the violation still
not corrected.
Mr. Stokesberry moved.for Finding of Fact and'Conciusion of Law, a
violation exists to 518 (A), ordered that an Administrative fee of $110.00 be.
assessed and if the violation is not corrected in 30 days,a fine of $25,00 per
day becomes effective. The motion,was.seconded by Mr, LaBarre, and passed
unanimously,

Mr. Rodriguez reported this violation was to be corrected by 8/21/91,
He inspected on August 22, 1991 andthe violation still had not been corrected.
Mr. LaBarre made a motion for Finding of Fact and Conclusion of Law that
a violation exists to Sec 12 104, ordered that an Administrative fee of $110.00
be assessed and if the violation is not corrected in 30 days, a fine of. $25.00
per day will become effective, Mr, Qwerisseconded the motion which passed by
unanimous vote.
13, HEARING, CASE NO. 002309
INOPERABLE VEHICLE ON PREMISES

OWNER: JOSEPH MONDY
This was Mr. Rodriguez case, and he reported that the owner had 'til 8/22/91
to correct the violation.: As of August 23, 1991 they werestill not in compliance.
This is a repeat violator, and $110.00 is outstanding on each of two cases,
Mr, LaBarre moved for a Finding of Fact and Conclusion of Law that a viola-
tion exists to Sec 13-1 of the Miami Shores Village Code of Ordinances, ordered
that an Administrative fee of $110.00 be assessed, and if the violation is not
corrected in 30 days, a fine of $25.00 per day goes into effect, The motion was
seconded by Mr. Stokesberry, and carried unanimously.
Mr. Asmus read the Memo from Village. Manager, Gail Macdonald concerning
a Basics Workshop being offered to Members by. Florida International University
Institute of Government. Mr. Henderson.and Mr. Stokesberry advised they are
interested and had already responded to Sandy Moredock, Mr. LaBarre and
Mr. Owens also indicated an interest, and they will contact -Sandy Moredock
tomorrow.
Mr. Asmus announced that Mayor Johnson made a request that two people
from the Code Enforcement Board be appointed to the Mayor's Task Force.
Mr. Owen Henderson volunteered as the representative and Mr. Stokesberry
will be the alternate.
