Code Enforcement Board was held on Maxcfl.. 7, 1991 at. 7.1.35 P.21. at. the N.L.amiShores Village Hall. The meet- ing was. called. to. oder by vice. Chairman, Mr, Art. Taylor, with. ,the following members present: Arthur H. Taylor, Vice Chairman Thomas j, Caldwell Owen Henderson III Royal D. LaBarre Daniel B. Owens Absent: Barry K. Asmus, & John -L. Stokesberry Also present; Frank-LuBien, Director of Code Enforcement Robert Rodriguez., Code. Enforcement Inspector 1. MINUTES - 'FEBRUARY 7, 1991 The minutes of the meeting of February 7,.'199:1 -were. approved as mailed, by a motion made by Mr. LaBarre, seconded:by.Mr, Caldwell, and carried unanimously, 2. REQUEST FOR RELIEF, CASE NO, 001348 EXCESSIVE MILDEW & PEELING PAINT ON CONCRETE WALL 61 N. E. 93rd ST, OWNER: MRS. JTJNON SALOMON Mr. LuBien,.Mr. Rodriguez. and Mrs. Salomon and Mr. Andre:Beauvais (who represented Mrs. Salomon).we.re sworn in,: It appears that there was some misunderstanding, because lir. Wilson did not fully explain the violation to Mrs. Salomon. Mr. Beauvais noted the wall was painted by the due date, but the house was not. Mrs. Salomon did not attend the ,first Code Enforcement Board meeting because she thought she was in compliance. Mrs. Salomon stated she is divorced and doesntt work. It was noted the total fine which, .includes the Administrative fee of $110.00. is $1,560.00, to date. Mr. Henderson made a motion to waive the fine and to keep the $110.00 Administrative fee, since Mrs. Salomon did make an effort to comply. The motion was seconded'by Mr..Caldwell, and passed .by unanimous roll call vote. 3. HEARING,'CASE NO. 001835 FAILURE TO OBTAIN AN OCCUPATIONAL LICENSE 1080.::N, E. 104th ST OWNER: JAMY DE FEX The.. violation correction. date. for this, case was February 4, 1991, Mr, LuBien introduced: the case stating•he was• called.at;home on a Sunday to observe a truck. moving .furniture.:into the:house..Mr, LuBien stated the property is. rented. without an occupational: license, Mrs. Jamy De Fex was sworn, in, She stated she doesnt..know what anyone is talking about. She lives. alone., and rents no part of .the. house, In response to query she stated she -has. lived. there about eleven years.. She had some furniture delivered from:relatives some time. ago, but doesn't remember ex— actly when, CODE ENFORCEMENT BOARD -2- 3/7/9.1 Mr. LuBien advised the. INOPERABLE VEHICLE ON PREMISES 10001 No, Miami.Ave, OWNER: Joyce Lally Held Mr. Rodriguez noted the inoperable vehicle correction date was 2/8/91. Mrs. Joyce Held was sworn in. She stated the vehicle belonged to her son. She further stated, the vehicle was moved the next day to the service station, to'be put in running condition. Current tags were put on the car, and it was sold on February 20, 1991, Mr. LaBarre moved for Finding of Fact and Conclusion of Law°a violation exists to Sec 13-1, and that an Administrative fee of $110.00 be assessed. The motion was seconded by Mr..Caldwell, and passed unanumously by roll call vote. 5. HEARING, CASE. NO. 001862 UNLAWFUL 'SIGN ON VEHICLE 860 N. E. 91st TERR. OWNER: ROGER ALAN, TENANT TENANT: HURLEY. RIDGEWAY, OWNER Mr. Alan and.his fiancee Lee Wells were sworn.in.. It was noted that upon inspection on February -7, 1991 two of the !far sale signs were removed from the vehicle, l remained-. Iie.was out of town and Ms, Wells could not pick,up,his certified mail. Mr. Alan was in communication with' the Building & Zoning' Department when he arrived back in town, and re- moved the other smaller sign, left in the car inadvertently, Mr. Caldwell moved. to, dismiss the case, seconded by Mr, Henderson, and carried by unanimous:roll..call vote. 6. HEARING, CASE N0. 00.1818 UNSIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR 129 N. W. 98th ST. OWNER:JON E. MC LEOD TENANT: JON E. MC LEOD Scott McLeod was at the meeting for his father, Jon McLeod. He was sworn inland advised the Board that he is responsible for the repairs. He also stated, since he is working..on the house he.thought he is in compliance. The house is pressure cleaned and. ready to'paint.in about a.week or as soon as he can get to it.. Members reviewed photographs taken_by Mr, Rodriguez. He stated the compliance date was February 10, 1991, and compliance is still not met, Mr, Henderson Atoved for. Finding.. of` Fact. and Conclusion of Law violation does Pxist to Sec.12133, ordered that $110,00. Administrative fee -be. assessed, and if the violation is not corrected.in.30 days there will be a fine of $25.00. per' day, the motion was seconded, by Mr. LaBarre,and passed by a unanimous roll call vote, • CODE ENFORCEMENT BOARD 3- 3/7/91 7. HEARING, CASE NO. 1834 FAILURE TO OBTAIN OCCUPATIONAL .LICENSE 147 N. W, 109th. STREET OWNER; GEORGE E. OBENOUR II TENANT, TENANT Mr. LuBien stated. this case should not be. on the agenda, since it was canceled and another case number given. Mr. LaBarre.moved.to dismiss the case, seconded by.1Kr.. Caldwell, and passed unanimously, 8. HEARING, CASE NO. 001864 FAILURE TO OBTAIN AN OCCUPATIONAL LICENSE 165 N. E. 109th.' ST OWNER; ZOILA SANCHEZ VICHOT TENANT: RAMON VI C11OT Mr. LuBien stated that. notice was sent on February 1, 1991 for a compliance date of February 15, 1991. Also he noted the violation for failure to obtain an occupational license was sent on the basis of the computer print- out, there has been no response. Mr. Henderson noted. since the owner and the tenant have the same last name, it may not be a rental situation. Mr. LaBarre moved for Finding of Fact and Conclusion of Law a violation does exist to Sec 1.4:-17, ordered that an Administrative fee of $11.0.00 be assessed, and if '..license is not obtained in .30 days.a fine of $25.00 per day will become effective, The motion died for lack of a second. Mr, Henderson moved to table the case to the next -.:regular meeting, and more information is obtained by Mr. LuBien. or Mr. Rodriguez. The motion was seconded'by.Mr. Caldwell,.and.carried unanimously. 9. HEARING, CASE NO. 001863 FAILURE TO OBTAIN AN ` OCCIJPAT,IONAL LICENSE 198 N. E. 110th ST OWNER; COSTEN T, DOWNS Mr..
