08-02-1990 Regular Meeting• • • • CODE ENFORCEMENT BOARD MEETING AUGUST 2, 1990 The regular meeting of the Miami Shores Village Code Enforcement Board was held on August 2,, 1990 at 7;30. P.M. at the Miami Shores Pillage Hall. The meeting was called to order by Chairman,. Mr, Asmus, with the.following present: Barry R. Asmus, Chairman Charles M. Custin Royal D, LaBarre John L.:.Stokesberry Arthur H. Tayl;o± Absent: Owen Henderson III & Richard A. Colangelo Also present: Frank LuBien,,Director of Code Enforcement ,Tack.Wilson, Code Enforcement Inspector Robert Rodriguez, Code Enforcement Inspector 1, MINUTES — JULY 5, 1990 Mr. Taylor moved to approve, as distributed, the minutes of July 5, 1990, seconded by Mr. Stokesberry, and carried unanimously. 2. FALSE ALARM APPEAL AB'TAH CHURCH, 546 N. E. 97th. STREET After being sworn, Mr. Church noted his letter enclosed in Members packet is self explanatory. He has a top of the line security alarm system which he explained to Members. He has had numerous burglary attempts and several actual burglaries. The system was checked out throughly on May 12, and the false alarms are reported on May 28 & 29 when he and his wife were out of town, He feels he should not be denied police protection or fined. Members questioned Mr. Church concerning the false alarms. Mr. Stokesberry could sympathize with Mr. Church, having experienced an almost identical situation. Mr. Stokesberry moved that these were probably legitimate alarms and so notify the Village Manager of this finding. Mr. Taylor seconded the motion which passed by a unanimous roll call vote, 3. REQUEST FOR RELIEF, CASE NO 001118 DAMAGED FENCE 842 N, E. 96th STREET, OWNER: JOSE E. FERNANDEZ Mr. -Fernandez was sworn in. He noted he was very busy with many things happening, he was granted a continuance. Further, he noted the pool was repaired and cleaned up a month ago. The fence though damaged the end of December has been repaired. Mr. Rodriguez noted:inspection this morning indicated only partial repair, Mr. Custin questioned Case .##001117 being in compliance, and closed 6/1/90. Following further question and discussion, Mr, Custin moved the pool was in poor condition and the appeal for $110,00.Administrative fee be denied, the motion was seconded by Mr. Taylor.,and passed by unanimous roll call vote. MX. Taylor moved to deny the appeal for fence repair, seconded.by Mr. Stokesberry and carried 4/1 by a roll call vote. Mr. Custin voted no. Mr. Asmus explained the. Boards action. to Mr. Fernandez. • • • CODE ENFORCEMENT BOARD MTG -2- 8/2/90. 4. HEARING, CASE NO. 001371 INOPERABLE VEHICLE ON PREMISES 266 N. W. 92nd STREET,.OWNER: JEANETTE PAUL Mr. Wilson noted that the vehicle has been moved as of this morning, but not by the due date.. Members..reviewed photographs he took of the violation. Mrs. Paul explained she was in Haiti and her husband speaks no English, it was not until her return that she was aware of the violation. The violation has been corrected. Mr. Stokesberry moved for the Finding of Fact and Conclusion of. Law, a violation existed to Sec 13-1 of the Miami Shores Village Code, ;:and the violation has been corrected. Ordered that an Administrative fee of $110,00 be assessed. Motion seconded by. Mr. Custin and carried unanimously by roll call vote. Mr. Asiuus explained Members action to Mrs. Paul. 5. HEARING, CASE NO. 001379 UNSIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR 9760 NORTH MIAMI AVENUE, OWNER: RICHARD HENRY & ANNA SINGER Members reviewed photos taken by Mr. Wilson as he outlined the violation. He further stated, some. work has been done. Mr. Henry was sworn in. He agreed with Mr. Wilson, but indicated he was overwhelmed by painters bids, and has no money to pay them and limited time to do the work himself. If allowed another thirty days he can do the work himself. Mr. Stokesberry moved for Finding of Fact and Conclusion of Law the violation does exist to Sec 12-133 of Miami Shores Village Code of. Ordinance. Ordered that an Administrative fee of:$110..00 be assessed, and if not corrected in arty days a fine of $25.00 per day will become effective. The motion was seconded by Mr. Taylor:and passed by unanimous roll call vote. 6. HEARING, CASE NO, 001348 UNSIGHTLY 'FASCIA, SOFFIT, HOUSE EXTERIOR 61 N. E. 93rd STREET', OWNER: WILNER SALOMON Members reviewed photos taken by Mr. Wilson of the violation. Mr. Wilson stated the house had been painted, but nothing done to the wall which was the reason for the citation. He had.not spoken to anyone at the residence. Mr. Taylor moved for Finding of Fact and Conclusion of Law a violation exists, Ordered that $110.00 Administrative fee be assessed, and if the wall is not painted in 30 days a fine of $25.00 per day toil1 go into effect. E. 102nd STREET., OWNER : RITA. MC CARTHY Mr. LuBien reported this case should not have been on the agenda, The commercial vehicle has been moved, and the case closed, 8. HEARING, CASE NO. 001420 INOP LE VEHICLE ON PREMISES 10326 N. W. lst AVENUE OWNER; CAROLYN J. FERNANDEZ Mr. Wilson stated the violation is not corrected. Members looked at pictures he took today of the inoperable vehicle on the premises. LaBarre iuoved for. Finding of Fact and Conclusion, of Law a. violation exists to Sec 13:1 of Miami Shores Village Code, ordered an Administrative fee of $11.0.00.be assessed, and if not corrected. in thirty days a fine of $25.00 per day becomes effective. The motionwas seconded by Mr. Stokesberry, and passed unanimously, The meeting adjourned at 8:15 P.M.
