07-05-1990 Regular Meeting• • • CODE ENFORCEMENT BOARD MEETING JULY 5, 1990 The Miami Shores Village Code Enforcement Board regular meet - Ing was held on July 5, 1990 at 7:35 P.M. at the Miami Shores Village Hall. The meeting was called to order by Vice Chair- man Richard Colangelo with the following In attendance: Royal D. LaBarre Owen Henderson III Arthur H. Taylor John L. Stokesberry Barry Asmus (arrived 7:40 p.m.) Absent: Charles Custin Also Present:Frank LuBlen, Director of Code Enforcement Jack Wilson, Code Enforcement Inspector Robert Rodriguez, Code Endorcement Inspector 1. Minutes - June 7, 1990 The minutes of the meeting of June 7, 1990 were approved as distributed by a motion made by Mr. Henderson,seconded by Mr. Stokesberry and carried by a unanimous vote. 2. HEARING CASE NO. 001288 Obstruction on R/W 9105 Bayshore Drive Miami Shores, FI 33138-3407 Mr. Rodriguez presented the case. With considerable dis- cussion as to who Is responsible for the tree in question because of it being on the parkway, Mr. LuBlen will go with Inspector Rodriguez on Thursday to make a deter- mination as to who is responsible for the trimming of the tree. Mr. LuBlen will report back to the Board with his findings. 3. HEARING CASE 001354 Hedge/Fence Beyond Height Limitations 1532 NE 104 Street Miami Shores, FI Mr. Rodriguez presented the case. It was Mr. Rodriguez's opinion that there was miscommunication with the gardener that maintains the property. The gardener was Instructed by both the resident Ms. Pearl and himself to cut the hedge to be In compliance with the code. The gardener did not follow the instructions. • • • Mr. Henderson moved for Finding of Fact that the hedge Is out of compliance and a Conclusion of Law 518 (A) and If the hedge Is not brought Into compliance within 30 days a $25 a day fine will be applied. Mr. Stokesberry second- ed the motion which passed by the following vote: Mr. Taylor, Mr. Henderson, Mr. Colangelo, Mr. Stokesberry and Mr. Asmus YES 4. HEARING CASE 001362 COMMERCIAL VEHICLE IN RESIDENTIAL ZONE 160 NW 95 STREET MIAMI SHORES, FL Mr. Wilson presented the case. The Board explained to the resident that the taxi that Is parked on the premises must be enclosed In the garage and not visable from the street or the vehicle must be totally removed from the Miami Shores area. Mr. Taylor moved for Finding of Fact that a that a com- mercial vehicle (TAXI) Is parked at the residents ad- dress and that the resident has 30 days to comply or a fine of $25 per day will be levied and ordered an Administrative fee of $110 be assessed. The motion was seconded by Mr. Colangelo and passed by unanimous roll call vote. 5. HEARING CASE 001363 COMMERCIAL VEHICLE IN RESIDENTIAL ZONE 162 NW 108 STREET MIAMI SHORES, FL Mr. Wilson presented the case. Mr. Wilson explained to the Board that the Van that Is parked at the residents address is used for the residents employment. Mr. Ausburn explained to the Board that the van Is used for his Job only and that he will discuss with his employer the possibility of getting magnetic signs to replace the lettering on the van now. Mr. Colangelo moved for Finding of Fact of a violation of a commercial vehicle and that he was In compliance, Mr. Henderson seconded the motion and the motion passed unanimously. 6. HEARING CASE 001306 GENERAL UNSIGHTLINESS 9826 NW 1 AVENUE Mr. Rodriguez presented the case. Mr. Rodriguez Informed the Board that the case was turned over to Public Works to bring the property Into compliance. No action was taken by the Board • • • 7. HEARING CASE 001307 MAINTAINING A NUISANCE 1284 NE 92 STREET MIAMI SHORES, FL Mr. Rodriguez presented the case. Mr. Rodriguez Informed the Board that the dirty pool water condition as of July 5, 1990 was still not complied with. Mr. LaBarre moved for Finding of Fact that a violation of Code 10-9 does exist and an Administration fee of $110 be assessed and $50 a day fine levied If the violation Is not complied with within 30 days. The motion was seconded by Mr. Taylor and the motion passed unanimously. 8. HEARING CASE 001338 UNLAWFUL SIGN ON PREMISES 1245 NE 93 STREET MIAMI SHORES, FL Mr. Rodriguez presented the case. Mr. Colangelo moved for Finding of Fact of violation of Code 504 (b) (2) there Is a and the sign must be removed within 30 days or a $50 a day fine will be levied. The motion was seconded by Mr. LaBarre and the motion passed unanimously. 9. HEARING CASE 001360 GENERAL UNSIGHTLINESS 9826 NW 1 AVENUE MIAMI SHORES, FL Mr. Wilson presented the case. Mr. Wilson explained to the Board that the resident Is a new owner and that she has cleaned up the property and has come In com- pliance with the Code. Mr. Henderson made a motion to dismiss the case. The motion was seconded by Mr. Colangelo and the motion pass- ed unanimously. Mr. Stokesberry made a motion to adjourn the meeting at 8:17 p.m. the motion was seconded by Mr. Henderson and passed unanimously. (2 (Aik (Acting Secretary) Approved:
