CODE ENFORCEMENT BOARD MEETING
December 1, 1988
The Miami Shores Village Code Enforcement Board Meeting was called to
order by Owen Henderson III, Vice Chairman., on December_ 1, 19S8, at 7:30 1.M.,
at the Miami Shores Village Hall. The following members were present:

Also present: Frank LuBien, Director of code Enforcement
Herb Kay, Code Enforcement Inspector

1. MINUTES - November 3, 1988
The minutes of the meeting of November 3, 1988 were approved, as written,
by a motion made by Mr. Stokesberry, seconded by Mr. LaBarre, add passed
unanimous ly .
2. APPEAL OF FINE AND ADMINISTRATIVE FEE

Members: -received in their packet_a letter from Mr. Karr, owner of the.
property, requesting an appeal of the fine which had accumulated.
Mr. LuBien noted the property has been cleaned up and the house painted.
He stated he had discontinued the fine.as of October25, 1988, at which
time it had grown to -$1,385..00, this included. the $110,,00 Administrative
fee. The Hearing was held on August 5th and the sections of the Code
violated were 12-133 and 10-1.
Mr. Karr and Mr. Dickler owneraof the property were sworn in. Mr. Karr
stated. he lives. in South Miami, and rents the property out. The tenants
were supposed to be caring for the property and they assured him that
they were, and he believed..them without checking for himself. Further
he expressed regret it had gotten so bad, and said.he will take care of
-it himself from now on, he further stated, it will not happen again.
It was further noted in discussion that there are three (3) separate
living units here, which is a non -conforming use. Mr. Karr explained, he
bought the property from the owner, who advised him that the rental units
were grandfathered in. Also Mr. Karrstated he had made no payments to-
ward the fine.
Mr. Custin moved to.waive.the fine but Mr. Karr should pay the $110.00
Administrative fee. The motion died forlack of a second.

Mr. Stokesberry moved to waive $14000.00 of the fine. ;The Administrative
fee of $110.00 remain, and fine of $275.00 also remain. Mr. Karr will
have a penalty payment of $385.00 total.. The motion was seconded by
Mr. LaBarre, and passed by a unanimous roll call vote.
Mr. Karr was instructed to keep his property maintained, and to nail the
fine of $385.00 as soon as possible.
3. HEARING, CASE NO. 88-0036-231

There was a great deal of.diseussionn'coneerning this violation of awl
inoperable. vehicle. The notice sent was returned, unclaimed. It was
subsequently hand delivered by- Mr. Kay. He reported, the -erson who
accepted. the violation, stated`he is a cousin of the owner, he is from
Puerto Rico, -and knows..:nothing of the vehicle.
Mr.. Wilson state he wrote the violation becausethe property was in a
general deteriorated condition, and because. of the inoperable vehicle.
The correct mailing address for the owner was not kitlownuntil after the
notice was sent.
Much discussion continued, concerning.. hearing the case.., when the owner
was not properly. notified.
Mr. Stokesberry moved that the property owner be properly notified by
certified mail, the violation must be corrected by December 15, 1988,
and the Hearing date. set for January 5, 1989. Mr. Custin seconded the
motion, which passed by a.unanimous_roll call vote.

The violation is now corrected, and Mr. Miller has paid the $110.00
Administrative fee.
C. CASE. NO. 88-5198-230
JOSE LUIS SANTANA, 301 N. E. 96th ST.
MILDEW & PEELING PAINT
The violation has been corrected. The Administrative fee has not
been paid.
