09-01-1988 Regular Meeting• • Miami Jhoresllage F L OR ID A CODE ENFORCEMENT BOARD MEETING September 1, 1988 The Miami Shores Village Code Enforcement Board regular meeting was called to order by Mr. Grau, Chairman, on September 1, 1988 at 7:30 P.M., at the Miami Shores Village Hall. The following members were present: Franklin E. Grau, Chairman Barry. K. Asmus Richard A. Colangelo Owen Henderson III John L. Stokesberry Absent:Charles M. Custin William Schroeder Frank LuBien, Director of Code Enforcement Also present: Jack Wilson, Code Enforcement Inspector 1. MINUTES - August 4, 1988 The minutes of the meeting of August 4, 1988 were approved, as written, by a motion made by Mr. Stokesberry, seconded by Mr. Henderson, acid passed unanimously. 2. HEARING, CASE NO. 88-4778-224 JUDITH WILLIAMS, 86 N. E. 95th ST. MILDEW & STAINS ON HOUSE & AWNINGS Members reviewed photographs of the violation., as Mr..Wilson.read the facts. A complaint was received and confirmed that there:was excessive mildew and stains on house and awnings.. There had been correspondence and some work done however, the job was incomplete. Mr. Wilson further stated, today inspection revealed compliance. Wilson Mr. JackA& Ms. Judith Williams were sworn in. Ms. Williams stated, work was delayed -first because of difficulty in engag- ing a painter and then, the weather being so rainy. It is still not finished, at least, to her satisfaction. Brief discussion followed. It was clarified the detail work is incomplete, and Ms. Williams was advised, the house stains are caused by sprinkler system, and once the house is painted this problem should be corrected. Mr. Stokesberry moved for Finding of Fact, the violationdid exist. Conclu- sion of Law this was a violation of Sec 12-133 of the Miami Shores Village Code of Ordinances. The violation is now corrected, and an Administrative fee of $110.00 be assessed, seconded by Mr. Henderson)and passed by a unanimous roll call vote. Mr. Grau, in reply to Ms, Williams. query, clarified the Administrative fee and explained that the complaint was anonymous. CODE ENFORCEMENT BOARD -2- 9/1/88 Mr. Asmus arrived at this point. 111/ 3. HRARTNG, CASE NO. 88-5035-225 • NOEL URVA LE EBANKS, 262 N. W. lllth..TERR. UNLAWFUL PARKING Mr. Wilson. noted the parking of cars on the front lawn have..been a recurring violation. since July 1984. At the present time there are still no proper parking spaces., and cars ate parked on the lawn illegally. Members reviewed photographs of the cars parked on the lawn. Mr. Raymond A. Ebanks was sworn in. He advised. Members that his father is deceased and he moved into the house. with his widowed mother -in Aug, 1987. Mr. Ebanks stated he owns an auto rental company., and.he leaves. one car at the house available in case his mother has an - emergency;` since she is in poor health. Further, Mt. Ebanks advised the Board,the,h-ome is for sale, and he has not considered creating a parking area. He fully understands the violation. Mr. Wilson stated the car was parked.on the lawn yesterday morning, and .1:: Mr. Gram explained to:Mr. Ebanks., this is illegal. Mr.. Henderson moved. for Finding of Fact and Conclusion of:,Law,.the violation does exist, to Sec 501(a) Schedule of Regulations`. of the Miami. Shores Village Code of. Ordinances, an .Administrative fee of $110.00 be .assessed, and if • the violation re-oceurres a fine of $25.00 per day -will go into effect. Motion was seconded by. Mr. Stokesberry, and passed by unanimous roll call • vote. • Mr. Ebanks declared he does understand the motion. 4. HEARING, CASE.NO. 88-5106-226 JEAN & JENNER.PHILIZAIRE, 10904 N. W. 2nd AVE. UNLAWFUL PARKING, UNSIGHTLY• YARD, INOPERABLE VEHICLE Members _ reviewed photographs as Mr. Wilson read- the facts behind; the viola- tion. An overgrown and unsightly yard,. inoperable vehicle, and vehicle on the lawn. Notices were'sent and some work was done, but the violations re- main. Mr..Wilson further stated, the yard is in pretty good shape, the parking situation is partially corrected. Neither Jean nor Jenner Philizaire were.present at the meeting. Mr..Asmus.moved for Finding of Fact and Conclusion of Law the.violation to Sec Schedule of Regulations, 10-1 & 13-1 did exist, also: that an Administra==. tive fee of $110.00 be assessed, and if all violations are not corrected in thirty (30) days a fine of $30.00 per day will. be imposed. This motion was seconded by Mr. Stokesberry, and passed unanimously. 5. AFFIDAVIT OF OF VIOLATION, CASE NO. 88-5068-227 WW;.DAVID CRAVEN, 934 N. E. 98th ST. UNFINISHED NEW RESIDENCE Members reviewed photographs .of. the violations.. Mr, ,Wilsonread the -facts behind. the violation. Work suspended on.a new house. under construction. Owner promised to obtain a new permit, and finish the job, but nothing has been done. • • • • CODE ENFORCEMENT BOARD. -3- 9/1/88 Following.further brief discussion, Mr. Asmus moved:to proceed to the next step, seconded by Mr. Henderson, and passed unanimously. 6. REPORTS FROM PREVIOUS MEETING A. CASE NO. 88-4902-219 PATRICK DENTICO, 10055 BISCAYNE BLVD. INSUFFICIENT PARKING SPACES - OVERSIZED BOAT Mr. Wilson.,reported the boat had been.removed. The latest on the insufficient parking is not completelyresolved. Mht & Mte..1James Dentico appeared:at the Planning & Zoning Board meeting with their attorney, -Mr. -.Frank Woland.and requested a parking area variance. There has been no Change. B. CASE NO. 88-4952-220 KATHLEEN MC KLLVY, 444 N. E. 93rd ST. PAINTING VIOLATION Mrs. McKelvy was given 45 days to correct the violation, there has been no change. C. CASE NO. 88-5013-223 F & J TRADING CO., INC. 969 N. E. 92nd ST. PEELING PAINT - OVERGROWN & UNSIGHTLY The front of this house has been painted, but nothing has been done in the rear. There is no change_ in the overgrown and unsightly lawn. Mr. Asmus expressed pleasure in working with Mr. Grau, whose term on the Board expires this month. Mr. Grau noted that he has enjoyed his work on the. Board. He indicated there havebeen many Changes in the.time he has served. The Administrative fee was begun, and new systems are being .developed. Also there have been many personnel changes on the Board. There being no further business, the meeting adjourned at 8:00 P.M.
