01-07-1988 Regular Meeting• • Jhores91.11age F L 0 R 1 D A CODE ENFORCEMENT BOARD MEETING January 7, 1988 The Miami Shores Village Code Enforcement Board regular meeting was held on January 7, 1988. The meeting was called to order at 7:30 P.M., at the Miami Shores Village Hall by Vice Chairman, Barry Asmus, with the following members present: Barry R. Asmus, Vice Chairman Franklin E. Grau, Chairman Charles M. Custin Owen Henderson III John L. Stokesberry Thomas L. James Absent: William Schroeder Also present: Frank LuBien, Director of Code Enforcement Jack Wilson, Code Enforcement Inspector 1. MINUTES - December 3, 1987 The minutes of the meeting of December 3, 1987 were approved, as written, by a motion made by Mr. Stokesberry, seconded by Dr. James, and passed unanimously. 2. HEARING, CASE NO. 87-4646 -203 CARMEN A. ALBALADEJO., 36 N. W. 101st ST. INOPERATIVE VEHICLE Mr. LuBien recited the facts behind the violation., as. a ear which appeared inoperable, and:with an expired tag, in front of the house, had not been moved in over six months. There had been.no response nor action=;to the notices sent. However, latest inspection revealed the auto now has a tag, and is in compliance. Mr. Miguel Albaladejo who stated he is Carmen's brother, and the owner of the car, was sworn in with Mr. LuBien and Mr. Wilson. - He stated he had. been working -in New York for about ten months, and had taken the car keys with. him.. The car now has:a-tag and is:operable. Following a few.questions from the Board, Mr., Asmus.explained:.the procedure of Administrative fee and execution of Form 4A,.which indicates compliance, for the benefit. of new members. Mr. Custin moved for Finding of Fact and- Conclusion of-Lawthat there was a violation of Sec 13-1 of the Code of Ordinances. Ordered that an Administra- tive fee of $110.00 be assessed, and since. the ear is now tagged and operable Form 4A be issued. Motion was. seconded -by Mr. Stokesberry.and passed by unanimous roll call vote. Mr. Grau., Chairman arrived at this point, and Mr. Asmus turned -.the meeting over to him. • • CODE ENFROCEMENT BOARD MEETING -2- 1/7/88 3. HEARING, CASE NO. 87-4654-204 WESLEY D. CARTER., 575 N. E. 95th ST. CONSTRUCTION WORK WITHOUT PERMIT The factsbehind the violation were read by. Mr. .LuBien. There was no response, to initial notices, but then.Mr... Carter wasAn the office and had conversation with Mr.:. Lu.Bien. On the permitapplication subsequently submitted•Mr. Carter noted the scope of construction work being done, he also sent. a letter which Mr. LuBien read, stating that drawing would be submitted by this meeting,. Apologies also were extended for working without apermit. Mr. Carter, after being sworn: in, notedthat he stopped all work mediately upon being cited for. violation. He has had conversation. with Mr. LuBien and learnedwwhat=.drawings must be provided. Work .is progressing slowly be- cause he is doing it himself.. Also since applying for the permit he has enlarged his plans to enclosing the garage, and understands this requires additional procedures. Additional, discussion followed. Mr..Asmus. moved for. Finding,- of Fact. that: violation' exists, Conclusion of Law -this is a violation. of Sec 6-4 of the Miami.. Shores: Village Code of Ordinances, that an. Administrative fee of'$110..00.:be assessed and if the permit is not obtained and drawings not submitted in thirty. days, a fine of $10.00 per day will,becomeeffective. Dr. James:secon.ded the motion, which passed with the following roll.call,vote: Mr. James No. Mr, Henderson. Yes Mr. ABMs Yes Mr. Stokesberry Yes Mr, Custin No Mr. Grau Yes Mr. Asmus explained the Board's action., and Mr. Carter agreed he could have the drawings in by thirty, days. 4. HEARING, CASE NO. 87-4661-205 ESTHER.NGERI,AJAO, 9818 N. W. 1st AVE. VARIOUS VIOLATIONS The facts behind the violation as cited by Mr. LuBien ;.:were .miscellaneous junk in the yard, broken windows,broken door, excessive mildew and peeling paint on the house. Some work was done in response to notices sent. Members reviewed photographs. Since the; Notice of Hearing all violations have been corredted. Mrs. Ajao was sworn in. She stated that upon receiving the first notice the work required forcompliance was done, and after a.phone call and inspection, she felt she was in compliance.. Upon receiving Notice of Hearing she made other phone calls and visited the office to verify com- pliance. She further stated, thatwhat was identified as junkare bicycles belong. to her. children. • • ODE ENFORCEMENT BOARD -3- 1/7/88 Much discussion continued. It was determined the:dates of photographs and dates of Hearing Notice preceed phone calls. Mr.. Asmus moved for Finding of Fact and. Conclusion of. law that_ a violation to 501(k) & 12-1.33 did exist, but is now. correeted. Order being $110.00 Administrative fee be assessed,..and Form 4A be executed, seconded by Dr. James and passed by un,4 fous roll call vote. 5. REPORTS.. FROM PREVIOUS MEETING A. CASE NO. 87-4571-201 ALAN P. FISKE, 1260 N.• E. 99th -ST. INCOMPLETE ROOF REPAIRS Mr. LuBien reported that therehas been no.change,,and an Affidavit of Non--Compliancewillbe issued. B. CASE NO. 87-4599-202 VIVIAN TOOKES, 137 N. W. 106th ST. HEDGES NOT IN COMPLIANCE The hedge has been removed and grass hasbeen planted. Compliance has been net. OTHER ITEMS DISCUSSED BY THE BOARD Mr. Grau made a request that the Notice of Hearing should be dated, and Mr. LuBien agreed this can be done. Mr. Asmus indicated, all phone messages should be dated and tinged. He was advised to contact the front office concerningthis problem. It was clarified, in response to query from.Mr. Stokesb.erry, that the Code Enforcement, Board. has the power to levy fines of up::to $250._00 not $500.00 Mr. LuBien explained that. a Code Enforcement: program.: is being written for. our computer system, and hoepfully will be operable in the near future. Mrs. Rose Stevens, 6:N. W. 106th St. Mrs. Stevens attended the meeting to express concernover the unsightly condition of the alley -way in the rear of 106th St., and the condition of the pool at 17 N. W. 105th St. She further stated she had attended the Council meeting in an effort to express these sane concerns. Much discussion followed. Mr. Wilson advised that,. Krome Realty` is in position of 17 N. W. 105th St. andthey have assured him that all violations will be corrected.
