CODE ENFORCEMENT BOARD MEETING
October 2, 1986
A regular meeting of the Miami Shores Village Code Enforcement Board
was held on October 2, 1986. The meeting was called to order at 7:30 P.M.
at the Miami Shores Village Hall, by Vice Chairman, Santos Rivero, with
the following members present:

William Schroeder
Sandy Sottilare
Julie A. S. Williamson
Absent: Franklin E. Grau
Arthur H. Taylor & Thomas L. James
Also present: Frank LuBien, Code Enforcement Director
Jack Wilson, Code Enforcement Inspector
The first order of business was to elect a Chairman and Vice Chairman.
Mrs. Williamson nominated Santos Rivero as Chairman, seconded. by Mr. Schroeder,
and passed unanimously. Arthur H. Taylor was nominated for Vice Chairman by
William Schroeder, seconded by Mrs. Williamson, and passed by unanimous vote.
1. MINUTES - September 3, 1986
Mrs. Williamson moved to approve, as written,. -the minutes of the meeting
of September 3, 1986, seconded by Mr. Schroeder, and carried unanimously.
2. HEARING, CASE NO. 86-3944-171
MICHAEL GALE, 165 N. E. 99th ST.
OVERGROWN & UNSIGHTLY YARD & HEDGES
Mr. LuBien read the facts behind the violation as unsightly and overgrown
yard with hedges in excess of height limitations. Further, Mr. LuBien
stated that the violations have been corrected about 2 or 3 weeks ago.
Mr. Michael Gale was sworn in. Mr. LuBien & Mr. Wilson, also were sworn in.
Mr. Gale testified, he does not live on the property and was out of town
when the notices came. He has been in touch with the. Village and gave a
current address where he might be reached. Mr. Gale apologized for the
condition of the property, he had had conversation with the tenant and
assured the Board the violation will not reoccur. He requested that the
Administrative fee of $110.00 be waived since the violations are corrected.
Mrs. Williamson moved to file Form 4-A, seconded by Mr. Schroeder, and
carried by a unanimous roll call vote.
Mr. Rivero explained to Mr. Gale that the fee is waived, and the hope that
this does not happen again.

3. HEARING, CASE NO. 86-3954-172
LEE BUCK & MARCUS EBERT, 9404 N. MIAMI AVE.
UNLAWFUL STRUCTURES
Facts behind the violations, as described by Mr. LuBien, a. trellis -like
structure (wooden posts with horizontal members and what appears to be a
pipe framed structure with screenings) and an orchid house, some being
unlawful, and all of which were installed without permits.
Mr. Tony Ramos was sworn in. He stated that he is the tenant who built
the structures as well as attorney for Mr. Buck. Growing plants & orchids
is his hobby, and after moving into the house he was in a rush to put up
the structures to save the plants. He noted he has received notices and
copies of the Ordinances, but fails to see what he is in violation of.
Mr-. Ramos was somewhat angry, stating he resented the notices and the treat-
ment he has been subject to. Further, that he has. not been precisely
instructed as to the violations or how to correct same. He confessed no
permits were taken out.
Mr. LuBien read a letter from Mr. Ramos addressed.to Mr.. Wilson, and our
reply, in which Mr. LuBien states "we will be happy to meet with you at the
site and point out the specific violations".
Much discussion.followed, concerning Sec 516 of the Zoning Ordinances, the
unlawful structures, and the procedure for obtaining approval for the orchid
house from the Planning & Zoning Board.
Mr. Sottilare apologized that things have gotten off to a poor start between
Mr. Ramos and Miami Shores Village Beautiful. He emphasized to Mr. Ramos
that he should contact Mr. LuBien and work directly with him in resolving
the problems and correcting the violations. He.would then see why it is
the Village Beautiful, and experience the sincere friendliness of all its
residents.
Mrs. Williamson, following assurance from Mr. Ramos that he, will comply
with the Ordinances, moved to find that the current structures are within
the set backs and do. not meet all of the structure requirements within
the code, and are therefore in violation of the code, further that
Mr. Ramos be given sixty days to comply after which a fine of $10.00 per
day will be assessed. Mr..Schroeder seconded the motion, and offered an
amendment that the Administrative fee of $110.00 be waived for the 60 day
period, but levied if the violation is not corrected. Mrs. Williamson
accepted the amendment, and the motion carried with the following vote:

Mr. Rivero requested that a progress report be made at the Board's next
meeting.

4. AFFIDAVIT OF VIOLATION, CASE NO. 86-4011-173
JOSEPH CARLO, 9136 N. MIAMI AVE.
NUMEROUS VIOLATIONS
Members reviewed photographs as Mr..LuBien.recited the facts behind the
violation. He noted that the. yard is overgrown and unsightly with loose
trash, a welding shop in the garage, storing junk vehicles and equipment
in the yard and insufficient parking spaces. Notices were sent, some
action was -taken, but the shop, one junk car and the boat remain.
Mr. LuBien stated that he has visited the property and had several conver-
sations with Mr. Carlo, but they have not produced positive results.
Mrs. Williamson moved to proceed to the next step, seconded by Mr. Schroeder.
Following brief discussion the motion carried by unanimous vote.
5. AFFIDAVIT OF VIOLATION, CASE NO. 864054-174
ROBERT BIRDWELL, 9333 N. MIAMI AVE.
OVERSIZE MOTOR HOME
Facts behind the violation as cited by Mr. LuBien, an oversize motor home
parked in front of the residence. The motor home has been moved to and
from the premises on numerous occasions, but left there about two weeks
this past time. Members reviewed photographs of the violation.
Mr. Schroeder moved to proceed to the next step, seconded by Mrs. Williamson,
and carried unanimously.
6. AFFIDAVIT OF VIOLATION, CASE NO. 86-4025-175
LAWRENCE LANCASTER (Tenant) - JEFFREY BRAUN (Owner)
600 N. E. 97th ST.
OPERATING A BUSINESS IN RESIDENTIAL ZONE
Mr. LuBien noted that inspection was made in response to complaints that
cars and trucks were observed coming and going and parked at the property.
Subsequent phone calls confirmed the operation of Lancaster Paving in a
residential zone. Notices were sent and acknowledged from Mr. Lancaster,
and Mr. Braun stated that the business would cease or the lease will be
broken. Further Mr. LuBien stated that Friday being payday is a busy
time traffic wise. Also he had conversation today. from someone at the
Church stating that the operations have moved to the Church parking lot
and couldn't something be done.
Mr. Sottilare made a motion to go to the next step, seconded by Mr. Schroeder
and passed unanimously.

UNLAWFUL CARPORT
The carport was removed within the 15 days allocated.
She has not paid the Administrative fee,

RAMON VICHOT, 165 N, E. 109th ST.
INCOMPLETE PAINTING, UNSIGHTLY YARD
The outside of the house has been painted, removing 95% of
the violation. Mr. LuBien had conversation with Mr. Vichot
and was assured the yard would be cleaned up.
C. CASE NO. 86,3823-168
TYRONE LIVINGSTON, 1275 N. E. 94th ST.
INCOMPLETE C.B.S. WALL
The wall has not been finished with stucco. It has been painted
a bright yellow which does not blend with the surrounding structures.
Further inspection will be made and if Mr. Livingstone is found to
be not in compliance an:. Affidavit of Non -Compliance will be issued
along with the order, and a cover letter certifying these as official
documents to be recorded with the Clerk of Circuit Court.

ANTHONY LACKNER, 290 N. E. 101st ST.
UNSIGHTLY YARD, OVERGROWN VEGETATION
The yard has been cleaned up somewhat. An overabundance of weeds
remain especially in parkway. Mr.. Lackner has another day to come
into compliance.
Thomas L. James sent regrets that he was unable to attend this, his first meeting,
because of his father's sudden.death. He looks forward to serving.
Mr. Rivero thanked Members for electing him as Chairman. He promised to do
always his best, a good job to keep the Village Beautiful. and on the go.
The meeting adjourned at 8:30 P.M.
