CODE ENFORCEMENT BOARD MEETING
June 5, 1986
A regular meeting of the Miami Shores Village Code Enforcement
Board was held on June 5, 1986. The meeting was called to order at 7:30 P.M,
at the Miami Shores Village Hall, by Chairman Barry Asmus, with the following
members present:

1. MINUTES - May 1, 1986
A motion was made by Mr. Taylor to approve, as written, the minutes
of the meeting of May 1, 1986, seconded by Mr. Rivero, and passed
unanimously.

EISENSTEIN, ABE, 29 N. W. 99th ST.
OVERFLOWING SEPTIC TANK
Mr. LuBien reported that this property .is no longer owned by Abe
Eisenstein, but rather is now owned by Centrust. Upon being made
aware of the situation, a person at Centrust advised him that the
occupants have moved out,and Miami Pioneer Septic Tank has been
engaged to install a new drainfield, for which a permit has been
obtained, and work will begin on Monday.
Mr. Taylor moved .that Form 4A be executed, seconded by Mr. Rivero,
and carried by the following roll call vote:

CARTAGENA, NORBERTO, JR., 285 N. E. 103rd ST.
UNFINISHED ROOF REPAIRS
Mr. LuBien, Mr. Wilson, and Mr. Cartagena were all three sworn in.

• Mr. LuBien outlined the facts behind the violation as incomplete
roof repairs, a violation to Sec. 12-36 of the Village Code. •

Mr. Cartagena testified that, he had contracted a roofing company
to do the repairs, but they never returned to complete the work
after receiving an initial payment of $200. Further that he has
been working on the roof intermittently, himself, while obtaining
estimates. to re -roof the entire house. The bids he has received
are much more than he can afford, at this time, and he hopes to
get started as soon as he receives his anticipated income tax
refund. The house is for sale, and Mr. Cartagena said, he is
aware that the roof must be replaced if he is to get his price.
Mr. LuBien stated that upon receiving no receipt or mail return on
the final notice, and having notice of this hearing returned un-
claimed, hand delivery was finally successful. Today's inspection
revealed the roof repairs remain unfinished.
Mr. Rivero moved for Finding of Fact, and Conclusion of Law, that
the incomplete roof repairs are a violation of Sec. 12-36 of the
Miami Shores Village Code of Ordinances, that an Administrative
fee of $110. be assessed, and if the violation is not corrected
in 30 days, a fine of $15.00 per day will be levied. Motion was
seconded by Mr. Taylor, and passed by the following roll call vote:

4. FALSE ALARM APPEAL
W. ROBERT ABRAMITIS, 1026 N. E. 97th ST.
Mr. Abramitis was sworn in. He testified, he is appealing release
from at least two of the four false alarm charges, noting that
these were due to installer error, and he feels the intent of the
Ordinance and fines is to have residents use the systems responsibly,
which he is now more sure of it's operation.
Mr. Asmus advised Mr. Abramitis that according to the Ordinance he is
not charged for the first five false alarms, further that, he should
notify the installer in writing of faulty equipment or installation,
and that they should be responsible.
Mr. LuBien advised Members that, in this case the Board does not have
latitude to make a final decision. The proper action for the Board
is that, they either find reason for the Village Manager to give
consideration or find reason not to uphold.
Mr. Schroeder moved to deny the appeal and refer it to the Village
Manager for his consideration, seconded by Mr. Rivero, and carried by
the following roll call vote:

Mr. Grau arrived during the discussion, therefore did not vote.

5. ADDENDUM:
411, AFFIDAVIT OF VIOLATION, CASE NO. 86-3759-166
RONDON, CARLOS & LEONOR M., 67 N. W. 109th ST.
COMMERCIAL & PRIVATE VEHICLES PARKED ILLEGALLY IN RES. ZONE.
Members reviewed photographs as Mr. LuBien recited the facts behind
the violations to the Schedule of Regulations & Sec 10-1 of the
Code of Ordinances.
Mr. Rivero moved to proceed to the next step, seconded by
Mr. Schroeder, and passed unanimously.

VARIOUS VIOLATIONS
Violations have been corrected. Mr. Granda is in compliance.
B. CASE NO. 86-3374-161

INOPERABLE VEHICLES - UNSIGHTLY YARD.
The inoperable vehicle, is now operable. The yard is cleaned up.
• Mr. LuBien reported there is no longer a violation.
C. CASE NO. 86-3646-163
Fathington Corp., N.V., 9275 N. BAYSHORE DR.
PEELING PAINT
Mr. LuBien reported, the house has been painted, violation no
longer exists.
7. MEETING FOR JULY
Mr. LuBien reported that since the July meeting falls on the 3rd.,
Members of the Board were polled as to their presence. Three Members
will be unable to attend, one was unsure. It is, therefore doubtful
if the July 3rd meeting would have a quorum.
Mr. Taylor moved to cancel the July meeting and the next meeting to be
held on August 7th, seconded by Mr. Grau, and passed by a unanimous vote.
The meeting adjourned at 8:00 P.M..
