05-01-1986 Regular Meeting• • aiami chores9illage FL. o R 1 O A CODS; ENFORCEMENT BOARD MEETING May 1, 1986 A regular meeting of the Miami Shores Village Code Enforcement Board was held on May 1, 1986. The meeting was called to order at 7:30 P.M., at the Miami Shores Village Hall, by Chairman Barry Asmus, with the follow- ing members present: Barry K. Asmus, Chairman Franklin E. Grau Angela Daley Arthur H. Taylor Santos Rivero Absent: William Schroeder Julie A. S. Williamson Also present: Frank LuBien, Code Enforcement Director Jack Wilson, Code Enforcement Inspector 1. MINUTES - April 3, 1986 Mr. Taylor moved that the minutes of the meeting of April 3, 1986 be approved, as written, seconded by Mr. Rivero and passed unanimously. 2. HEARING, CASE NO. 86-3498-160 LEON CIO GRANDA, 9326 N. W. 2nd CT. VARIOUS VIOLATIONS Facts behind the violation were outlined by Mr. LuBien as an unlawful porch enclosure. Owners subsequent application for variance was de- nied. The. porch has been restored to a screened porch, and the only violation which continues is the incomplete roof repairs. Mr. Granda, the owner was present with his tenant, Carlos Bones. They were sworn in along with Mr. Jack Wilson and Mr. Frank LuBien. Mr. Granda noted that the repairs were not undertaken immediately because Mr. Bones is doing the work, he became ill and underwent surgery. The enclosed porch has since been restored to a screened porch, the roof repairs are complete except for laying of the tiles, which can be done in the next few days. Discussion followed concerning the lack of a permit, lack of response to earlier notices, and delay in laying the tiles on the roof. Ms. Daley moved for Finding of Fact & Conclusion of Law that violation to Sec 11-1 & 5-3, unsightly, unfinished roof repairs exists, and that Mr. Granda be assessed an Administrative fee of $110., and if the violation continues beyond thirty days, ,a fine of $10. per day be levied. HEARING, CASE NO. 86-3374-161 PAULE BAZILE, 9337 N. W. 2nd PL. INOPERABLE VEHICLES - UNSIGHTLY YARD Mr. LuBien read the facts behind the violat on to. Sec. 14-43 & 11-1, ad. Members reviewed photographs. He noted that as of inspection today the yard is cleaned up, the cadillac was gone, and the volkswagon now in operable condition. There is no longer a violation on the premises. Paule Bazile was present and stated, thereas nothing mechanically wrong with the volkswagon, and she explained the difficulty in obtaining a Florida license for the car. Mr. Rivero moved to issue form 4-A for compliance, and that the Administra tive fee be waived, seconded by Mr. Taylor, and carried by a unanimous roll call vote. Mr. LuBien explained that the violation has continued for some time, the owner, Mr. Eisenstein is adamant as to not spending another dime to correct the situation, and if the Health Department orders, he will put the tenants out and close the place down. Following further discussion, Mr. Grau moved to proceed to the next step, while at the same time Mr. Forney be notified to look into the matter and remedy the situationas soon as possible.
