CODE ENFORCEMENT BOARD MEETING
January 5, 1984
A meeting of the Miami Shores Village Code Enforcement Board was
held on January 5, 1984, 7:30 p.m. at the Village Hall, with the following
Board members present:
Julie A. S. Williamson, Chairman
Donald L. Bednar
Kenneth Cutchens
Franklin E. Grau
Santos F. Rivero
Barry K. Asmus
Arthur H, Taylor
Also present: Frank LuBien, Code Enforcement Director
(1) MINUTES:
Mr. Taylor explained that the minutes should be duly noted that he
had notified Mr, Bednar, he would be absent from the Dec, 1, 1983
meeting because he had a court appearance on that date, The minutes
• were approved as amended by a motion by Mr. Bednar, seconded by
Mr. Asmus and passed unanimously.
(2) HEARING, CASE NO. 83-1709-066
JUNE BECKLEY, 1331 N. E. 103 STREET
OVERGROWN HEDGE
BY REQUEST OF JUNE BECKLEY
Mr. LuBien showed the Board pictures of the overgrown hedge taken
on December 6, 1983 and reported that even though some trimming had
been done the violation has not been complied with. Mrs. Beckley
requested this hearing so that her position could be discussed.
After some discussion, Mrs, Williamson, Chairman clarified the
position of the Board at these hearings; and the desire to work
with Mrs. Beckley to comply with the ordinance.
Mr. Bednar stated that the Board voted two months ago to find
Mrs, Beckley in violation and an Affidavit of Non -Compliance one
month ago remains on record.

Following much discussion Mr, Bednar moved that Finding -of -Fact
and Conclusion of Law stands and effective seven days from this
day the previous Finding -of -Fact applies and a fine of $10.00 a
day begin seven days from today, Mr. Asmus seconded the motion.
Mr Cutchens offered an amendment that the seven days be changed
to "grace period". This was accepted and the amended motion
passed with the following vote:

Mr. LuBien reported that he had made an inspection today and found
the yard has been cleaned up; however, junk boat and car remain in
yard. Mr. LuBien has not had conversation with Mr. Hunt since 1980.
Numerous attempts to contact him have proved fruitless. Notice of
this meeting was sent to Mr. Hunt by Certified Mail and Regular Mail
with no response.
Mr, Bednar moved, Finding -of -Fact and Conclusion of Law that Mr. Hunt
is in violation of Ordinance as cited by the Code Enforcement Officer
and that a fine of $10.00 per day beginning 10 days from today's date
be imposed. The motion was seconded by Mr, Cutchens, An amendment by
Mr, Asmus to change the fine to $20.00 per day was accepted and the
amended motion passed unanimously,
(4) REPORTS FROM PREVIOUS MEETINGS:

CASE NO. 83-410-064
EDWARD A, SWING, 1323 N. E. 104 STREET
VARIOUS VIOLATIONS
Mr, LuBien reported that as of 4:30 p.m. today (1/5/84) the boat has
been removed, the garage remains essentially full of boat motors and
various equipment and supplies,
Mr. Swing stated that the boat has been placed in the water. He is
trying to comply with the code by moving motors and parts from the
garage but needs time,
Mrs. Williamson, Chairman explained that once a fine has been imposed
it continues until compliance, the Board cannot promise to lift such
fine. The situation will continue to be monitored. Mr. LuBien will
file Affidavit of Compliance when in fact compliance is met,
Mr. Grau moved to continue action and receive a report on the situation
at the next meeting. Seconded by Mr. Asmus and passed.

CASE NO. 83-1748-067
MERNA PATHEWTS, 150 N, W, 109 STREET
VARIOUS VIOLATIONS
Me, LuBien reports that a section of roof still not in compliance
in the A., today but that a man was at work and the job was 90%
complete by the P,I, , Yard has been cleaned considerably, and
Mt, LuBien will verify tomorrow that work has been completed.
A motion was made by Mr, Cutchens to continue the case to the next
meeting and receive a report of compliance at that time, Mx. Asmus
seconded and the motion passed.
FELIX ATTT3 S-FIGUEROA CASE:
Mr. Rivero requested information on the progress of Felix Atiles-
Figueroa case, Mr, LuBien stated that he did not have all pertinent
information at hand, he will have it on the agenda for the next meet-
ing and be prepared to give a more concise report at that time,
Motion to adjourn was withheld by request from Mr. Bednar for a
procedure change.
A formal discussion was held with regard to recommendations,
standards, procedure and guidelines in assessing fines, It is the
consensus of the Board that uniform standards, guidelines be set up
for this purpose,
The meeting adjourned at 9:00 p.m. .
