CODE ENFORCEMENT BOARD MEETING
December 1, 1983
A meeting of the Miami Shores Village Code Enforcement Board
was held on December 1, 1983, 7:30 p.m., at the Village Hall, with the
following Board members present:
Julie A. S. Williamson, Chairman
Donald L. Bednar
Kenneth Cutchens
Franklin E. Grau
Santos F. Rivero
Barry K. Asmus (arrived late)
Absent: Arthur H. Taylor (Due to court appearance)
Also present: Frank LuBien, Code Enforcement Director
As retiring Chairman Mr. Bednar thanked the Board and the public
for the support and assistance they had given them, then turned the gavel
over to Mrs. Williamson, the new Chairman.
(1) MINUTES:
Mrs. Williamson called attention to the fact that the person
seconding the motion on Item 6, of the minutes of 11/3/83 was
not reported. It was ascertained that Mr. Asmus had seconded
this motion. The minutes were then approved as amended by
motion made by Mr. Bednar, seconded by Mr. Rivero and passed
unanimously.
(2) HEARING, CASE NO. 83-1748-067
MERNA MATHEWS, 150 N. W. 109th Street
VARIOUS VIOLATIONS (Schedule of Regulations, 216, 518, 11-1,
12-48 & 14-43.
Mr. LuBien reported that he had made an inspection that day and
found the yard had been cleaned, the hedges trimmed, the
garage unoccupied, that the only violation remaining was the
roof. Further, that the owner is out of town but expects to be
back on Dec. 10th to complete the job.
After some discussion Mr. Bednar moved that the Board finds
Ms. Mathews in violation of the ordinance and that a fine of
$10.00 a day be imposed if the violation is not corrected within
30 days. The motion was seconded by Mr. Cutchens and an
amendment offered that the time for correction be extended to

January 4, 1984. The was accepted and the amended motion
was passed with the following vote:

(3) AFFIDAVIT OF VIOLATION, CASE NO. 83-1775-068'
NELSON B. ALDERMAN HUNT, 1032 N. E. 98th Street
VARIOUS VIOLATIONS (junk boar and car, overgrown unsightly yard)
Mr. LuBien reported the condition has not changed.
Mr. Rivero moved that we proceed to the next step. The motion
was seconded by Mr. Grau and passed unanimously.
(4) REPORTS FROM PREVIOUS MEETINGS:
A. CASE NO. 83-410-064
EDWARD A. SWING, 1323 N. E. 104th St.
Various Violations
Mr. LuBien reported that Mr. Swing did not understand the
order of the Board with regard to boats on his property,
in the yard or within the garage and what he is permitted to
keep within his garage.
Oen examination Mr. Swing admitted he had two boats in the
garage but only one in the yard. The Board held to the
determination that only one was permitted on the property.
Mr. Swing further admitted to keeping or storing about 15
boat engines in his garage. In this discussion Mr. Bednar
stated that a garage is designed to house vehicles and
equipment, that the housing of boats and running the motors
violate uses permitted in a single family zone.
(Mr. Asmus arrived at this point.)
It was the consensus of the Board that he is not in compliance
with 15 motors and 3 or 4 boats on the property. The
compliance date was December 3, 1983. Mr. LuBien recommended
an extension but Mr. Cutchen's motion to this effect failed
for lack of a second. The Chairman announced that the order
will stand as given with a report to be made at the next meeting.

Overgrown Hedge
Mr. LuBien reported that the hedge has been cut and the
property is now in compliance. Mr. LuBien will file an
Affidavit of Compliance.
C. CASE NO. 83-1709-066
JUNE BECKLEY, 1331 N. E. 103th Street
Overgrown Hedge
Mr. LuBien reported that the hedge in question is not
in compliance. The Order will stand.
The meeting adjourned at 8:40 p.m.
