CODE ENFORCEMENT BOARD MEETING
MARCH 3, 1983
meeting of the Miami Shores Village Code Enforcement Board
was held on March 3, 1983, 7:30 p,m,, at the Village Hall, with the
following Board members present:
Donald L, Bednar, Chairman

Also Present: Leslie R, Forney, Village Manager
Frank LuBien, Code Enforcement Director
1) MINUTES:
Minutes of the meeting of January 6, 1983 were approved
as written by motion made by Mr, Grau, seconded by Mrs.
Williamson and passed unanimously,
2) APPEAL OF FALSE BURGLAR. ALARM
ALAN M. MEDOF
1230 N.E. 91 TERRACE
This alarm was activated on January 12, 1983 at 3:21 p,m,
Mrs, Susan Medof advised the Board she called the Central
Station after deactivating the system; went to her next
door neighbor, a Metro policeman, who checked her home
and assured her it was safe to enter. Mrs, Medof requested
Central not to dispatch the police.
Examination of the premises revealed the alarm was activated
by a loose wire on the screen in the bathroom on the west side
of the house, and Mrs, Medof felt someone could have touched
this screen and set off the system.

Sgt. Asker, representing the Miami Shores Police Department,
stated, if an officer is dispatched to the scene, and there
is no evidence of an attempted breakin, it is considered a
false alarm. Of,Cosner was dispatched to the scene
following a call from a neighbor, The Village Police did
not enter the home since the premises were already checked
by Metro and Mrs.. Medof advised everything was all right.
Following discussion, Mr, Grau moved we dismiss the case,
as based on the facts revealed, it is reasonable to believe
there might have been an attempt to enter the house, Motion
was seconded by Mrs. Williamson and carried unani'miously,
3) APPEAL OF FALSE BURGLAR ALARM
JOSEPH LODGE
390 N.E. 102 STREET
At 4:04 a,m. on February 5, 1983 Officer Taylor, Dt. Harrison
and Sgt. Dearden responded to an alarm reported by Crime Control.
The Police took appropriate .action and checked the premises
thoroughly and discovered an unlocked sliding door.
Mr. Joseph Lodge went over the details of the evening of
February 5th and advised the Board of the following facts:
a) this was not a malfunction of the system as it operated
perfectly when reactivated; b) a jarring sound can set
the alarm off - however, there were no unusual sounds that
night, confirmed by Mrs, Lodge, who was up late in the evening;
c) strong winds can affect the system - hurricane center advised
the velocity was 5 miles per hour that evening - not sufficient
to set off the alarm; d) someone attempting to enter the premises
can set, off the system; Mr, Lodge believes this was so as his dog
reacted in an unusual manner and on the following morning, February
6th, it was discovered that the glove compartment of an unlocked
vehicle was opened,
The Chairman, from personal experience, sympathized with Mr. Lodge
and was in complete accord with the reasons recited by Mr, Lodge
for activation of alarm system. The Chairman relinquished the
Chair to Mrs, Williamson and left as he felt his opinion would.
be biased.

Following discussion, Mrs. Fox moved to dismiss this
case due to extenuating circumstances that there might
have been an attempted entry. Motion was seconded by
Mr. Grau and passed with the following vote:

Mrs, Fox - Yes
Mr, Cutchens Yes
Mr. Rivero - No
Mr. Bednar returned to the chair,
Mr. Fabian arrived at 8:10 p,m.
4) AFFIDAVIT OF VIOLATION - CASE NO, 83-1253--039
MARILYN T. WALKER, 255 N,W. 111 STREET
ROOF & HOUSE MILDEWED, PEELING PAINT'ON HOUSE
Early January, 1983 the poor condition of the'exterior
of this residence was observed, Notices were sent with
no results. Registered mail was returned unclaimed.
Nr. Rivero moved that we proceed with the next step,
seconded. by Mrs, Williamsona• and passed unanimously.
5) AFFIDAVIT OF VIOLATION CASE NO. 83-1164-040
KATHLEEN M. HAGERTY, 551 N,E, 105 STREET
FAILURE TO MAINTAIN POOL, HOUSE, ROOF & YARD
KEEPING CATS IN A MANNER TO CAUSE NUISANCE
Poor conditions were observed in May of 1979. Notices were
sent, violations have been corrected, only to recur at a •
later date,. Further notices were sent, extension requested
and granted,but the problems still exist,
Following examination of photographs, Mrs. Williamson made
a motion we proceed with the next step, seconded by Mr, Grau
and passed unanimously,

6) AFFIDAVIT OF VIOLATION - CASE NO. 83-1236-041
-W.F. ANDES, 1080 N,E. 96'STREET
FAILURE TO CONTAINERIZE TRASH
The Building Department was advised by the waste supervisor
that loose trash was regularly placed in alley without
proper containers. Notices were sent, with no results.
Registered notice was returned unclaimed,
Photos of the existing condition were submitted by Mr.
LuBien,
Mr. Grau moved that we proceed with the next step, seconded
by Mrs. Williamson and passed unanimously,
7) REPORTS FROM PREVIOUS MEETING:
A. CASE NO. 82-993-036
PETER J. HYDE, 1236 N,E. 93 STREET
HEDGES IN EXCESS OF HEIGHT LIMITATION
Mr. LuBien reported that no effort has been made by
Mr, Hyde to cut the hedge or to seek administrative
relief. An Affidavit of NonCompliance, Notification
of Lien and Supplementary Notification of Lien were
sent. The fine is $500.00 and continuing,
B. CASE NO. 82-1019-037
EMETERIO ZORRILLA, 916 N,E, 96 STREET
CONSTRUCTION OF UNLAWFUL FENCE WITHOUT PERMIT
Nr. LuBien advised he is satisfied that the fence is
now reasonably -safe. The fence. has a-2" t 6" variance
as the lot is.sway-back, and all of the interim posts
are not encased in concrete,
Following discussion, Mr. Grau moved that we issue an
Affidavit of Compliance, seconded by Mrs, Williamson
and carried unanimously,

H. FRANK RUBIO, 1107 N.E. 104 STREET
UNLAWFUL STRUCTURE IN REAR SETBACK
Mr. Rubio has until April 6, 1983 for compliance.
On February 11, at the request of Mr. Rubio's
attorney, Mr. Forney and Mr. LuBien were requested
to give a deposition,

AIDAN M. MCNALLY, 800 N,E, 96 STREET
UNPAID LIEN
On February 7th we sent Mr. McNally a reminder of
outstanding lien in the amount of $170.00. He has
complied with the notice and removed the inoperative
vehicle but has not paid the lien. Mr. LuBien noted
that this house is up for sale and Mr. McNally now
resides in New York.
The meeting adjourned at 9:00 p.m.
