10-07-1982 Regular Meeting• • • iami Jhores9illage F L OR ID A CODE ENFORCEMENT BOARD MEETING OCTOBER 7, 1982 A meeting of the Miami Shores Village Code Enforcement Board was held on October 7, 1982 at 7:30 P.M., at the Village Hall, with the following members present: Absent : Julie A.S. Williamson Eugene F.Fabian Franklin E. Grau Kenneth Cutchens Santos F. Rivero Martha Sue Fox Donald L. Bednar - Chairman Also Present Frank LuBien, Code Enforcement Director Term of William A,Davis expired on October 1, 1982. Letter of resignation dated September 8, 1982 from W.Al Davis was received by Miami Shores Village. New Code Enforcement Board members were introduced by Mr. LuBien. Mr. Kenneth Cutchens, elected for 3 year term and Mr. Santos F. Rivero, elected for 2 years. First item to be considered was election of Chairman and Vice - Chairman. Mr. Grau observed that Mr. Donald Bednar had performed with excellence over the past year and all on the Board agreed. Mr. Grau moved for renomination of Mr. Donald L. Bednar as Chairman and Mrs. Julie A.S. Williamson as Vice Chairman. This was seconded by Mr, Fabian and carried unanimously, In the absence of the Chairman, Mrs. Williamson assumed the Chair. 2. MINUTES: Minutes of the meeting of September 8, 1982 were approved as written by motion made by Mrs. Fox, seconded by Mr. Grau, and carried unanimously. 3. RABIN, 9900-10-20 N.E. 2ND AVENUE UNSIGHTLY PARKING LOT AND FAILURE TO INSTALL REQUIRED PARKING LOT IMPROVEMENTS Mr. LuBien provided the Board with a photocopy of letter received from the attorney representing the new owner. Due to the rain there has been no activity, however, they reported they do plan to go ahead with the fence and landscaping. The Code Enforcement Director will keep in touch with the attorney and will report on progress. B. CASE NO. 81-183-003 ATTILA BESE, 440 N.E. 91 STREET UNLAWFUL ROOF Photocopies of letter of August 19, 1982, confirming the Code Enforcement Board's action at meeting of August 5, 1982 and our letter of September 28, 1982 relative to notification of Lien were presented to the Board. Mr. LuBien advised that he was instructed by the Village Manager that should the roof not be in place by the 19th of October, 1982, the Village Manager would instruct the Village Attorney to proceed with whatever remedial steps are necessary. C. CASE NO. 82-665-026 SIKANDAR KARIM, 9099 BISCAYNE BOULEVARD SIGN VIOLATION A lien was placed on this property and Mr. Karim has vacated same. Mr. LuBien advised he will check with the City Manager and the Village Attorney on this case. No further action is required by the Code Enforcement Board, 4. AFFIDAVIT OF VIOLATION, CASE NO, 82-937-033 AIDAN M. McNALLY, 800 N.E. 96 STREET STORING INOPERATIVE VEHICLES Inoperative vehicles were observed in June, 1981, They were removed, re -arranged and then re -appeared, At present, there is one vehicle in the rear yard and one in the parkway and neither vehicle has been moved in over three months. Notices were sent on 6/22/81, 1/28,82, 4/15/82 and 6/16/82. Photographs taken today (10/7/82) show the violation still exists. • Q 41iami Jhores19 lage F L 0 R 1 0 A - 3 October 7, 1983 Motion was made by Mr. Grau that we proceed with the next step, seconded by Mr. Fabian and carried unanimously. Mr. Rivero questioned why so many months were required to file the affidavit. Mr. LuBien explained that the vehicles were removed, rearranged and later replaced, so this is a continuing violation. 5, AFFIDAVIT OF VIOLATION, CASE NO. 82-917-034 DENISE TALISMAN, 1610 N,E, 105 STREET STORING INOPERATIVE VEHICLE In June, 1982, inoperative vehicle was observed at 1610 N.E. 105th St. Violation notices were sent on 6/9/82 and 7/30/82, Photos taken today (10/7/82) confirm vehicle has not been moved, This vehicle has one flat tire and front wheel tire is missing. Mrs. Talisman informed Mr. LuBien on his visit that she has personal problems, does not have a key to the vehicle - her son who is away at college has the car keys, she was mugged, etc, etc. Mrs. Fox made a motion that we proceed with the next step, seconded by Mr. Fabian and carried unanimously, 6. AFFIDAVIT OF VIOLATION, CASE NO. 82-1005-035 DENNIS PITTER, 117 N.W. 100 TERRACE STORING INOPERATIVE VEHICLE Inoperative vehicle was observed in parkway in August, Notices were sent on 8/11/82 and 8/30/82 but vehicle has not been removed, Photos of the vehicle were examined by the Board. Mr, Grau moved that we proceed with the next step, seconded by Mr. Rivero, and carried unanimously, 7. AFFIDAVIT OF VIOLATION, CASE NO, 82-993-036 PETER J. HYDE, 1236 N.E. 93 STREET HEDGES IN EXCESS OF HEIGHT LIMITATION Lack of yard maintenance was observed.in mid July, 1982, The yard was overgrown and the hedges were not trimmed, Notices were sent on 7/16/82 and 8/16/82; some work.was completed, but the hedges remain in excess of height limitations, Photos taken today (10/7/82) show hedges almost 8 ft, in height. Mr. Grau moved that we proceed.with the next step, seconded by Mrs. Fox,and carried unanimously. • • Miami cShores9ilIage F L OR ID A - 4 - October 7, 1982 A discussion was held relative to the Burglar Alarm cases. The Code Enforcement Director advised that he has heard nothing further on the referrals. Mr. Grau requested that the Director report to the Board at the next meeting the ultimate disposition of the Burglar Alarm cases heard last month. Mr. LuBien reported that the Village Manager requested him to make modifications to our Ordinance so that it complies with the State Statutes'. This has been done and when it is completed and returned by the Village Manager, the Rules and Regulations will be revised and the Code Enforcement Board will act to adopt same. It was requested at this point that Mr. LuBien advise the Code Enforcement Board, at the next meeting, of the status of the Elsie Baioff case. The meeting adjourned at 8;40 171,4 Secretary
