CODE ENFORCEMENT BOARD MEETING
JULY 1, 1982
A meeting of the Miami Shores Village Code Enforcement Board
was held on July 1, 1982, at 7:30 P.M., at the Village Hall, with
the following members present:
Julie S. Williamson
Eugene F. Fabian
Franklin E. Grau
Martha Sue Fox
W. Al Davis
Absent : Donald L. Bednar, Chairman
Also in attendance: Frank LuBien, Code Enforcement Director
Wilbur W. Willaford, Code Enforcement Officer
In the absence of Mr. Donald L. Bednar, Julie S. Williamson was
requested to Chair.
1) MINUTES: Minutes of the meeting of June 3, 1982 were approved as
written by motion made by Mr. Grau, seconded by Mrs, Fox and carried.
Prior to proceeding with the meeting distribution was made by
the Code Enforcement Director of the following:

2) REPORTS FROM JUNE MEETING
A - CASE NO. 81-183-003

(ATTILA & NANCY BESE PRESENT OWNERS)
Copy of letter from Mr. Bese appealing decision of the Planning
and Zoning Board was submitted to the Code Enforcement Board by Mr. LuBien,
Mr. Bese reported the status of this situation together with his
projected views on resolving his problems,

Following discussion, Mr. Fabian moved that since Mr. Bese
is going before Council on the 6th of July, the Code Enforcement Board
will hold this case off until July 7, 1982, seconded by Mr. Davis.
Mr. Grau offered an amendment to the motion that in the event Council
rejects Mr. Bese's appeal, we then automatically proceed with the filing
of foreclosure. This was accepted and carried as follows:

B - CASE NO. 82-665-026
SIKANDAR KARIM - PIZZA KING,9099 BISCAYNE BLVD.
DISPLAYING UNLAWFUL SIGN
Mr. LuBien advised that the cloth signs displayed in violation
were not removed on the date stipulated on Order. A lien was filed and
the unlawful sign was removed on the 14th of June. The lien, totalling
$950.00 has been recorded and Mr. LuBien read the Code Enforcement
Board procedure of the right of appeal of the aggrieved party.
An Affidavit of Compliance will be filed in this case.
C CASE NO. 82-731-028
H. CLEMENT ALLEN, 1365 N.E. 105 ST,APT.3
STORING EXCESSIVE NUMBER OF BOATS
At the Board's request, Mr. LuBien investigated and determined
the boat is in fact stored on adjoining property and Mr. Allen received
permission from Mr. M. Celusnek, of 1355 N.E. 199th St, North Miami Beach,
FL 33170, to park the boat on his property.
A Notice of Compliance is being filed.
3) HEARING - CASE NO. 82-409-030
SAMUEL J. RABIN, 9900-10-20 N.E. 2ND AVENUE
UNSIGHTLY PARKING LOT & FAILURE TO INSTALL
REQUIRED PARKING LOT IMPROVEMENTS
Mr. LuBien reviewed the facts of this case and noted that at last
• meeting a site plan was submitted, which was approved by the Planning and

Zoning Board on January 22, 1981, depicting work required on the premises.
Inspections revealed that sprinklers were put in along sidewalk in back
area; the hedges existing, as interpreted by the Code Enforcement Director,
are not up to the quality of required landscaping; louvered fence in back
of lot has not been removed and is an advanced state of deterioration. It
was stipulated at our last meeting that this would be replaced by a 5'
CBS wall. The required improvements have not been completed.
Mr. LuBien advised that he was informed the property was purchased
by Provident Realty Co. and a letter was sent to their attorney, J.
Patrick Fitzgerald, McDermott, Wi11 & Emery on June 23, 1982 advising him
of the existing violations and our upcoming Hearing.
Mr. Ralph E. Bowen, real estate. broker, 685 Grand Concourse, presented
photographs to the Board taken on July 1, 1982 of the cited property. Following
discussion, Mr. Davis made a motion that owners have not complied with stipulations
in Affidavit of Violation, the premises are unsightly, owner is in violation
of Sec. 11-1, parking lot improvements have not been completed, it is ordered
that Sam Rabin shall comply with said section by July 31, 1982, and if Sam
Rabin does not comply within time specified, he shall pay a fine of $10.00
per day for each day violation continues. Mrs. Fox seconded the motion.
Mr. Fabian recommended that all parties be aware of the Code Enforcement
Board meeting and a copy of findings be sent to all concerned, including the
new owners.
Mr. Grau assumed chairmanship of the meeting at this point and Mrs.
Williamson amended the motion that a fine of $200.00 be levied on the property
at this point for existing violations, and if they are not corrected by the
September meeting of the Board, a fine of $10.00 per day be levied at that
point. The amended motion was seconded by Mr. Davis and carried with the
following vote:

4) AFFIDAVIT OF VIOLATION - CASE NO. 82-742-031
OREN & JERRY MORTON, 189 N.W. 92 STREET
UNSIGHTLY YARD OVERSIZE HEDGE
Upon complaints received, this property was inspected on March 7, 1980.
At that time the property was in a state of extreme neglect, with minor
dilapidation of the house. Subsequently some work was done on the yard but
since that time no effort has been made to maintain the property unless a

violation notice is issued. Violator refuses to accept notices and
has been uncooperative toward the inspector. This is a continuing.
violation.
Mr. Grau made a motion that we proceed with the next step,
seconded by Mrs. Fox and passed unanimously.
5) AFFIDAVIT OF VIOLATION =- CASE NO. 82-895-032
MOIZANIEL DA FONSECA - 282 N.W. 111 TERRACE
DISPLAYING CAR FOR SALE
On May 26, 1982 a car was observed with "for sale" sign displayed
in window. Notices were sent and inspection made on June 21 revealed
the car with sign still being displayed, On July 1, 1982 the same car
and sign were observed, This is a continuing violation,
Mr. Fabian moved that the Board proceed with the next step, The
motion was seconded by Mr. Grau and carried unanimously,
The meeting adjourned at 8:45 P.M.
