06-03-1982 Regular Meeting• • • Miami cJhores9illage F L OR ID q CODE ENFORCEMENT BOARD MEETING June 3, 1982 A meeting of the Miami Shores Village Code Enforcement Board was held on June 3, 1982, at 7:30 P.M. at the Village Hall, with the following members present: Donald L. Bednar, Chairman Julie S, Williamson Eugene F, Fabian Franklin E. Grau Martha Sue Fox Absent: W. Al Davis Also in attendance: Frank LuBien, Code Enforcement Director Wilbur W. Willaford, Code Enforcement Officer 1) MINUTES: Mr. Grau moved for approval of the minutes of May 6, 1982, seconded by Mr. Fabian. An addition was made by Mrs. Williamson to page 4, second paragraph, line 2, to include the words "per day" following $25.00, seconded by Mrs, Fox. The minutes as amended were then passed unanimously. 2) REPORTS FROM MAY MEETING: A - CASE NO. 81-183-003 ROBERT J. IOZIA, 440 N,E, 91 STREET (ATTILA & NANCY BESE - PRESENT OWNERS) Mr. LuBien advised the Board that Mr, Bese telephone him following the meeting and informed him that he talked to roofers and is obtaining prices to replace the tile roof that is in violation as to construction. Mr. Bese requested that the Code Enforcement Director place him on the agenda for the Planning & Zoning Board to petition for a variance. The Board indicated that Mr, Bese was informed that Mr. Iozia previously requested a variance for roof at 440 N.E. 91st St, and the Planning & Zoning Board denied same. (10 liami cJhores911.1age F L OR i D A June 3, 1982 B - HEARING CASE NO. 82-645-023 ARTHUR D. SOARES, 8841 BISCAYNE BLVD. DISPLAYING MERCHANDISE & SIGN OUTSIDE OF BLDG. The Code Enforcement Director advised the Board that Mr. Soares complied with our Order. C - HEARING CASE NO. 82-662-024 H.M. & H. ASSOCIATES INC.,'8909 BISCAYNE BLVD. DISPLAYING UNLAWFUL SIGN (PRICES'SIGN AT EDGE OF PROPERTY) .Mr. LuBien noted that Mr. Hazen removed the free standing sign and had been complying until the Memorial Day weekend. When Biscayne Exxon displayed their sign, Mr. Hazen replaced his sign. He is still in violation. After discussion, Mr. Grau moved that we proceed to the next step and in the process, we have Mr. Fann review that step in determining when the starting date of the fine should commence. The motion was seconded by Mrs. Williamson, and carried unanimously. D - HEARING CASE NO. 82-695-025 BISCAYNE EXXON 9020 BISCAYNE BLVD, DISPLAYING UNLAWFUL SIGN (PRICES SIGN AT EDGE OF PROPERTY) This violation which has been on record since January 28, 1982 continues. Over the Memorial Day weekend, Mr. LuBien noted, the sign was placed on the back of a truck. Following discussion by the Board, Mr. Grau moved that we proceed to the next step and in the process, we have Mr. Fann review that step in determining when the starting date of the fine should commence. The motion was seconded by Mrs. Williamson, and carried unanimously. E) HEARING CASE NO. 82-665-026 SIKANDAR KARIM - PIZZA KING (BROADWAY RESTAURANT) 9099 BISCAYNE BLVD. - DISPLAYING UNLAWFUL HANGING CLOTH SIGN) Mr. LuBien presented photographs to the Board showing cloth sign continues to be displayed by Mr. Karim. Originally, the signs in question were removed, and later replaced by similar cloth signs. Mr. Karim is still in violation. • • 1iami Jhores` 1llage F L OR ID A - 3 - June 3, 1982 Further, Mr. LuBien reported, the facia which read "Ice Cream Shop" now has four additional signs, painted without permits. Photographs were submitted by the Code Enforcement Director supporting his statements. A motion was made by Mrs. Fox to proceed with the next step and file an Affidavit of Non -Compliance, seconded by Mr. Fabian and carried unanimously. 3) HEARING CASE NO. 82-731-028 H. CLEMENT ALLEN, 1365 N.E. 105 STREET, APT.3 STORING EXCESSIVE NUMBER OF BOATS (3). Mr. LuBien advised the Board that final notice was sent to Mr. Allen on March 23, 1982. Photographs taken on June 3rd showed two boats on the property. Mr. Allen advised the Board that the 24' boat has been put in storage; the sailboat has been parked on another property - not on the condominium grounds; the zodiac raft is parked at 1365 N.E. 105 St. Following discussion, Mr. Fabian made a motion that the Code Enforcement Officer investigate and determine exactly on which property these boats are located; are not in excess of 20', and Mr. LuBien report back to the Board exactly where the boats in question sit, i.e. three separate lots or two separate lots. Mrs. Williamson seconded the motion which passed 4/1, with Mr. Bednar dissenting. Mrs. Williamson recommended we address the Village Attorney with reference to the question of several boats on one property, for reference in future cases, and noted this does not apply in this case as Mr. Allen advised oneboatis on the Condominium grounds, one boat is on adjacent property and one is in storage. Mr. Allen was informed the Building and Zoning Department will contact him if he is found in compliance. Mr. Allen presented to the Board a copy of letter addressed to Mr. Stobs, c/o Ann Vigneron, City Clerk. He stated he received no response to this communication. He wishes to apply for a variance for the 24' boat now in storage. Mr. Bednar assured Mr. Allen this would be processed. • • aiami Jhores9illage F L OR ID q - 4 June 3, 1982 4) AFFIDAVIT OF VIOLATION - CASE NO. 82-409-030 SAMUEL J. RABIN, 9900-10-20 N.E. 2ND AVENUE UNSIGHTLY PARKING LOT & FAILURE TO INSTALL REQUIRED PARKING LOT IMPROVEMENTS Inspections of alteration work on the buildings in late 1980 and early 1981, revealed that the parking area and premises were allowed to deteriorateeexcessively and the required parking lot improve- ments were not taken care of. Notice was sent on June 30, 1981 and Mr. Rabin advised he would comply but required more time. Inspection on May 12, 1982 revealed that the area was unsightly with accumulation of trash, weeds and wild growth, existing hazardous concrete louver fence still remains and the required improvements have not been made. Mr. LuBien presented to the Board a copy of plans submitted by Mr. Rabin to the Planning & Zoning Board on January 22, 1981 for approval. Plans showed there was supposed to be a sprinkling system, new hedge, new landscaping, new wall, existing louvered fence was to be removed and a flower -bin section was supposed to be along -side the sidewalk against the building. Photographs were viewed by the Board showing non-compliance to plans as submitted and approved on January 22, 1981, by the Planning and Zoning Board, providing a masonry wall, as per Ordinance 285, be installed around the west side of the parking lot; perimeter strip be landscaped and provided with necessary irrigation; removal of existing concrete wall and replace with landscaping. The Code Enforcement Director reported the only actual work he observed completed was that some trees were planted. After receipt of final notice, Mr. Rabin contacted Mr. LuBien and assured him the work would be done. Mr. Jeff Newman spoke to the Board for Mr. Rabin. He said they attempted to comply but due to unforeseen circumstances they could not financially complete the improvements. A gardener was hired on a monthly basis. Mr. Newman noted that neither Mr. Rabin nor himself could visit the property regularly as they travel out of town. A permit was recently obtained to put in the sprinkler system, and they have arranged to have the fence on the south side of the property removed and the site cleaned up. Miami Aores9Illage F L OR ID A - 5 - June 3, 1982 Following discussion, Mrs. Williamson made a motion that we proceed with the next step, a Notice of Hearing, seconded by Mr. Fabian, and passed with the following vote: Mr. Bednar Yes Mrs. Williamson Yes Mr. Fabian Yes Mrs. Fox Yes Mr. Grau Abstained Mr. Newman discussed the question of retaining the fence on the west side of the property, Following discussion, the Code Enforcement Officer advised Mr. Newman that the louvered fence is to be replaced with a CBS Wall in accordance to the plans submitted to the Planning & Zoning on January 22, 1981, and approved by this Board.
