PUBLIC HEARING &
SPECIAL COUNCIL MEETING
The Miami Shores Village Council held a Public Hearing and Special Meeting on Tuesday, January 27,
2015 in the Council Chambers of Village Hall. Mayor Holly called the meeting to order at 7:03 PM with
the following Council Members and Administrative Staff in attendance:

CONSIDERATIONS
1) VILLAGE CLERK Barbara A. Estep
A) PUBLIC HEARING ON THE PROPOSED ANNEXATION OF THE COMMERCIAL
AREA SITUATATED NORTH OF N.E. 105TH STREET, SOUTH OF N.E. 108TH STREET,
WEST OF BISCAYNE BOULEVARD AND EAST OF N.E. 12TH AVENUE.
B) A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL, APPROVING
THE INITIATION OF A PROPOSED MUNICIPAL BOUNDARY CHANGE PURSUANT
TO SECTION 20-3, MIAMI-DADE COUNTY CODE, FOR A COMMERCIAL AREA
LOCATED TO THE WEST OF BISCAYNE BOULEVARD, EAST OF N.E. 12TH
AVENUE, SOUTH OF N.E. 108TH STREET, AND NORTH OF N.E. 105TH STREET,
PROVIDING FOR AN EFFECTIVE DATE.
Mayor Holly introduced the item and outlined the protocol for the evening. Ms. Estep read the caption of
the Resolution into the record and Mayor Holly opened the Public Hearing. Attorney Jeffrey Bass was
•
present and spoke on behalf of K -Mart which represents 85% of the land area being proposed for
annexation into the Village. Mr. Bass summarized K -Mart Corporation's objections to becoming part of
the Village, specifically listing the higher millage rate and concerns about development rights and the level
of service provided to the parcel. Mr. Bass indicated that two representatives were in attendance directly
from Chicago further representing the interests of K-Mart/Sears Corporation.
Jim Mulholland, owner of the Busy Bee Car Wash spoke in opposition of the proposed annexation, citing
higher taxes and the fact that he is a long-time business owner in the same location and doesn't feel the
need to join the Village. He expressed complete satisfaction with the service level provided by the County.
Two Village property owners in the neighborhood of the proposed annexation location spoke of on-going
issues with K -Mart and spoke in favor of the annexation in order to increase the level of code enforcement
and to control future land use decisions.
No additional individuals came forward to speak and Mayor Holly subsequently closed the Public Hearing.
Mr. Benton advised the Council as to the next steps in the annexation process.
Councilman Davis thanked those in attendance and the business representatives for expressing their views.
He indicated that he would like the Village to have some say in the land use/development issues in the
future and following his comments, moved to approve the resolution to move forward with the annexation
application. Councilman McCoy seconded the motion. Councilman McCoy spoke of the Village's
standards versus the County and his belief that the annexation would help the community.
Mayor Holly, Councilman McCoy and Councilman Davis offered additional comments regarding their
views on the positive aspects of annexing the parcels and the fact that there will be a lengthy review
process with the County. Mr. Benton confirmed for Vice Mayor Walters that the grocery store under
construction is located on property owned by K -Mart.
Mayor Holly then called for a vote on the motion which passed unanimously.
2) ANNOUNCEMENTS
Ms. Estep read the announcements.
3) PUBLIC COMMENTS
Alice Burch Ms. Burch spoke of her interest and support of the annexation.
Jorge Mallo Mr. Mallo spoke of the positive effects annexation would have on the neighborhood
surrounding the commercial properties. He also spoke of the motel.
Jenna Rassif
K -Mart.
Ms. Rassif reiterated her support for the annexation and spoke of specific complaints with
Nina Birnbach Ms. Birnbach talked of issues surrounding the K -Mart store and the possibility of
annexation helping to alleviate some of the problems.
4) COUNCIL COMMENTS

Jim McCoy Councilman McCoy thanked the people for their attendance at the meeting.
Hunt Davis Councilman Davis spoke of the St. Rose Carnival just held, the upcoming Charter
School event, Evening in the Courtyard. He also reported that he had attended a Legislative Committee
Meeting in Tallahassee regarding the vacation rental issue.
Herta Holly Mayor Holly also spoke of the vacation rental issue and thanked everyone in
attendance for their participation.
5) ADJOURNMENT
The January 27, 2015 Special Meeting of the Village Council was adjourned at 7:50 PM.
