The Meeting was called to order at 7:30 PM with the following individuals in attendance: PRESENT: Herta Holly Jesse Walters Hunt Davis Ivonne Ledesma Jim McCoy ALSO PRESENT: Tom Benton, Village Manager Barbara Estep, Village Clerk Jesus Suarez, Acting Village Attorney CONSIDERATIONS 1) VILLAGE CLERK Barbara A. Estep, MMC A) APPROVAL OF THE JUNE 17, 2014 COUNCIL MEETING MINUTES. Vice Mayor Walters moved approval of the June 17, 2014 Council Meeting Minutes as presented. Councilwoman Ledesma seconded the motion and the vote was unanimous in favor of the motion. B) APPOINTMENT TO CHARTER SCHOOL BOARD OF DIRECTORS (One vacancy) Applicants: Connie Benson Anna Blackman Sean Brady Gregory Haile Alison Harke Ms. Benson was present and spoke on her own behalf. Council Members voted paper ballots with the following results: Ivonne Ledesma Jesse Walters Herta Holly Jim McCoy Hunt Davis Gregory Haile Connie Benson Connie Benson Connie Benson Connie Benson Based on the voting results, Ms. Benson was appointed to the Charter School Board of Directors. r • C) A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL SUPPORTING ADOPTION OF A COUNTY -WIDE ORDINANCE TO PROHIBIT THE SALE AND DISTRIBUTION OF CANDY FLAVORED TOBACCO PRODUCTS WHICH ARE COMMONLY MARKETED TO YOUNG ADULTS; PROVIDING FOR DISTRIBUTION OF RESOLUTION AND PROVIDING FOR AN EFFECTIVE DATE. Ms. Estep read the caption of the Resolution into the record and provided information relating to the presentation heard during the previous Council Meeting. Councilman McCoy moved to adopt the Resolution as submitted. Councilwoman Ledesma seconded the motion and the vote was unanimous in favor of the motion. 2) VILLAGE MANAGER Tom Benton A) REQUEST APPROVAL TO EXECUTE TURF AND LANDSCAPE MAINTENANCE JOINT PARTICIPATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR CONTINUATION OF RIGHT-OF-WAY/MEDIAN MAINTENANCE OF STATE ROADWAYS. Mr. Benton offered background information regarding the on-going maintenance of the State roadway right-of-ways and recommended approval of the agreement. Councilwoman Ledesma asked about the percentage of "Florida Friendly" materials used in the medians and the right-of-ways. Mr. Benton provided details of the planted materials. Following the discussion, Councilman Davis moved to approve execution of the Turf and Landscape Maintenance Agreement. Councilman McCoy seconded the motion and the vote was unanimous in favor of the motion. 3) VILLAGE COUNCIL Ivonne Ledesma • A) A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL SUPPORTING MARRIAGE EQUALITY, URGING ENACTMENT OF A LAW THAT WOULD PROVIDE FOR MARRIAGE EQUALITY IN THE STATE OF FLORIDA, AND PROVIDING FOR AN EFFECTIVE DATE. Ms. Estep read the caption of the Resolution into the record. Councilwoman Ledesma indicated that she was withdrawing the item from the agenda to be considered at a later date. B) A REQUEST TO WAIVE THE MUNICIPAL FEES ASSOCIATED WITH THE GREEN DAY EVENT. Mayor Holly voiced her understanding that either she or Councilman Davis would need to move to reconsider the item in order to have the Council once again discuss the matter. Neither Councilman Davis nor Mayor Holly made such a motion and therefore the item was not heard. 4) ANNOUNCEMENTS Ms. Estep read the announcements. 5) PUBLIC COMMENTS Hortensia Hunter Ms. Hunter spoke in support of the marriage equality resolution. David Traupman Mr. Traupman expressed his concern regarding the postponement of the marriage equality resolution which he favors. Jim Harper Mr. Harper voiced his support for the marriage equality resolution and distributed copies of an article he wrote for the Biscayne Times on the issue. • Patrick Sullivan Mr. Sullivan spoke of the resident survey that was tabled and the police department patrols. • • Kim Krause Ms. Krause spoke in favor of the marriage equality resolution. Lance Harke Mr. Harke talked of his support of the marriage equality resolution. Leslie Del Monte Ms. Del Monte spoke of her support of the marriage equality resolution and hearing public comment. Gabriella Locatelli Dr. Locatelli expressed her support of the marriage equality resolution. 6) COUNCIL COMMENTS Ivonne Ledesma Councilwoman Ledesma thanked those in attendance for their participation. In addition, she thanked Bob Bourne, Chip Shepard and John Challenor of the PhoneDoctor.com for their generosity and support of the Village by sponsoring the July 4th fireworks. Councilwoman Ledesma also thanked Vice Mayor Jesse Walters for his representation of the Village residents. Hunt Davis Councilman Davis also expressed his thanks to Chip Shepard, Bob Bourne and John Challenor. He congratulated his alma mater, Vanderbilt University on their winning the College World Series and commented on the World Cup soccer games. Jim McCoy Councilman McCoy thanked John Challenor, Chip Shepard and Bob Bourne for all they do and for giving back to the community. Jesse Walters Vice Mayor Walters recognized El Portal Councilman, Omar Nickerson and thanked those in attendance for their support of the marriage equality resolution. He indicated that he would reintroduce the marriage equality resolution at the next council meeting. Herta Holly Mayor Holly thanked Chip Shepard, Bob Bourne and John Challenor for sponsoring the fireworks. She indicated that she was sorry the marriage equality resolution did not go forward during the meeting as she was prepared to vote on the issue. She additionally spoke of the courage to bring items to the table and that the Council is available to speak to the residents regarding their view points. 7) ADJOURNMENT The Tuesday, July 1, 2014 Council Meeting was adjourned at 8:05 PM.
