The meeting was called to order immediately following the conclusion of the first of two Public Budget Hearings. The following individuals were present for the meeting: PRESENT: ALSO PRESENT: CONSIDERATIONS Herta Holly Steve Loffredo Hunt Davis Prospero Herrera JC Rodriguez Tom Benton, Village Manager Barbara Estep, Village Clerk Richard Sarafan, Village Attorney 1) VILLAGE CLERK Barbara A. Estep A) APPROVAL OF THE JULY 15, 2008 COUNCIL MEETING MINUTES. Mr. Herrera moved to approve the July 15, 2008 Council Meeting Minutes. Mr. Davis seconded the motion and the vote was unanimous in favor of the motion. B) REQUEST FROM TROPICAL CHEVROLET TO EXTEND, FOR ONE ADDITIONAL YEAR, PROVISIONS OF VILLAGE COUNCIL RESOLUTION NO. 1125-07, AUTHORIZING VACATION OF CERTAIN PORTIONS OF N.E. 5TH COURT AND PORTIONS OF N.E. 89TH STREET. Attorney David Sachs, representing Tropical Chevrolet, spoke to the Council and requested a time extension in order to complete the conditions outlined in the Resolution. Mr. Loffredo asked about the appraisal on the roadway and whether or not a price had been negotiated between Tropical and the Village. Mr. Sachs • indicated that although an appraisal had been completed, no negotiations or discussions between the Village and the dealership had taken place. Mr. Rodriguez moved to extend the terms outlined in Resolution No. 1125-07 until April, 2009 as requested. Mr. Loffredo seconded the motion and the vote was unanimous in favor of the motion. 2) VILLAGE COUNCIL A) A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL SUPPORTING CONSTITUTIONAL AMENDMENT 8: LOCAL OPTION COMMUNITY COLLEGE FUNDING, AN INITIATIVE CONTAINED ON THE NOVEMBER 4, 2008 ELECTION BALLOT, AND URGING ALL ELECTORS TO SUPPORT EDUCATIONAL FUNDING FOR THEIR COMMUNITY COLLEGES. Councilman Herrera Ms. Estep read the caption of the Resolution into the record. Mr. Herrera provided background information to the Council and explained the purpose of the Constitutional Amendment. Mr. Loffredo moved to adopt the proposed Resolution. Mr. Rodriguez seconded the motion and the vote was unanimous in favor of the motion. B) A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL PROPOSING TO AMEND A PORTION OF SECTION 523.1 OF THE ZONING APPENDIX A, CONTAINED IN THE CODE OF ORDINANCES OF MIAMI SHORES VILLAGE, FLORIDA, SO AS TO AUTHORIZE, SUBJECT TO CERTAIN CONDmONS, CERTAIN STRUCTURES KNOWN AS "CHICKEES" AS DEFINED IN FLORIDA STATUTES § 553.71 (9)(i), AND REFERENCING CONSIDERATION THEREOF TO THE VILLAGE PLANNING BOARD IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 10 OF THE ZONING APPENDIX A, CONTAINED IN THE CODE OF ORDINANCES OF MIAMI SHORES VILLAGE, FLORIDA. Vice Mayor Loffredo Ms. Estep read the caption of the Resolution into the record. Mr. Loffredo offered information relating to chickee huts, indicating that he checked with neighboring communities and subject to some very strict guidelines, other municipalities do allow them. Following clarification of the language contained in the Resolution and what the Council would be voting on, Mr. Rodriguez moved to adopt the proposed Resolution. Mr. Herrera seconded the motion and the vote was unanimous in favor of the motion. 3) ANNOUNCEMENTS Ms. Estep read the announcements. 4) PUBLIC COMMENTS Kathleen Canary Ms. Canary spoke about the Village Board vacancies and the appointment process. 5) COUNCIL COMMENTS Hunt Davis Mr. Davis spoke about the P & Z Board member attendance. Steve Loffredo Mr. Loffredo spoke of his disappointment with the N.E. 2nd Avenue contractor. Prospero Herrera Mr. Herrera indicated that it was great to be back after the summer recess. JC Rodriguez Mr. Rodriguez spoke of the N.E. 2nd Avenue project. Herta Holly • Mayor Holly offered congratulations to the Miami Shores Community Church on their 75th anniversary. She indicated that they would be having a celebration service and luncheon on Sunday, September 14th.
