The Meeting was held at the Village Hall and was called to order at 7:20 PM with the following individuals present: PRESENT: ALSO PRESENT: CONSIDERATIONS Al Davis J.C. Rodriguez Herta Holly Steve Loffredo Jim McCoy Tom Benton, Village Manager Barbara Estep, Village Clerk Richard Sarafan, Village Attorney 1) VILLAGE CLERK Barbara A. Estep A) APPROVAL OF THE SEPTEMBER 6, 2005 COUNCIL MEETING MINUTES AND THE SEPTEMBER 8, 2005 BUDGET HEARING MEETING MINUTES. Mr. McCoy moved approval of the two sets of Minutes as presented. Mrs. Holly seconded the motion and the vote was unanimous in favor of the motion. B) AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING CHAPTER 8 "EMERGENCY MANAGEMENT" TO ADD ARTICLE III - "HURRICANE PROTECTION MEASURES", PROVIDING FOR REGULATIONS CONCERNING LANDSCAPING AND THE MAINTENANCE AND DISPOSAL OF LANDSCAPING DEBRIS, TREES, YARD WASTE AND VEGETATION, SO AS TO MITIGATE POTENTIAL STORM IMPACTS AND DAMAGES; PROVIDING RESTRICTIONS ON PLACEMENT OF LANDSCAPING DEBRIS; REQUIRING REMOVAL OF CERTAIN EXOTIC PLANTS AND TREES FOR NEW CONSTRUCTION; PROVIDING FOR PROTECTION OF ELECTRIC POWER LINES FROM VEGETATIVE GROWTH; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS, PROVIDING FOR PENALTY; AND PROVIDING FOR AN EFFECTIVE DATE. First Reading Mr. Benton offered background information regarding the purpose and intent of the proposed ordinance, which is to work towards minimizing power outages during storm events due to untrimmed trees too close to the power lines. Mr. Benton indicated that the Village had used a newly adopted Key Biscayne ordinance as a model and stated that it was the Administration's intent to remove a sentence from the text of the ordinance which related to possible imprisonment for violations. Individual Council members expressed their opinions on the ordinance, agreeing with Mr. Benton's suggestion of deleting certain language. The discussion centered around enforcement of the ordinance and notifying the residents of their responsibilities, i.e. cutting and trimming trees, etc., which are outlined in the ordinance. Following these discussions, Mr. McCoy moved to adopt the ordinance, as amended, on first reading. Mr. Loffredo seconded the motion and the vote was unanimous in favor of the motion. 2) VILLAGE MANAGER Tom Benton A) DISCUSSION AND POSSIBLE ACTION REGARDING USE OF PEOPLE'S TRANSPORTATION PLAN TAX DOLLARS FOR A VILLAGE BUS SERVICE. Mr. Benton provided information regarding the People's Transportation Plan (PTP) requirement to expend 20% of the available funds on actual transportation of people. Mr. Benton indicated that prior to moving forward with the development of bid specifications and any additional planning for providing a bus service within the Village, he was looking for input from the Council on whether or not they wanted to see such a service in the Village. Council Members voiced their thoughts and concerns regarding beginning a bus route within the Village but following their discussion reached a consensus to have Mr. Benton proceed with developing a program and obtaining bids for the service. 3) ANNOUNCEMENTS Mrs. Estep read the announcements. 4) PUBLIC COMMENTS No one present wished to make any public comment. 5) COUNCIL COMMENTS Herta Holly Jim McCoy Steve Loffredo JC Rodriguez Al Davis Mrs. Holly spoke of Hurricane Rita and asked everyone to keep the effected residents in their thoughts and prayers. Mr. McCoy recognized the police officers in the audience and referenced a resident's letter thanking the Police Department for their service. Mr. Loffredo wished to echo the remarks of his colleagues. No Comment offered.
