REGULAR COUNCIL MEETING
The Miami Shores Village Council held their regularly scheduled meeting on Tuesday, October 5, 2004 at the
Village Hall. The meeting was called to order at 7:38 PM with the following members in attendance:

ABSENT: Ed Quinton
PRESENTATIONS
Miami -Dade County Commissioner, Sally Heyman, made a short presentation to the Council regarding the
upcoming elections.
The House of the Month award for October, 2004, was presented to Barry and Rachel Kraemer.
CONSIDERATIONS
1) VILLAGE CLERK Barbara A. Estep
A) APPROVAL OF THE SEPTEMBER 21, 2004 BUDGET HEARING AND COUNCIL MEETING
MINUTES.
Mr. Davis moved approval of the September 21, 2004 Budget Hearing and Council Meeting Minutes. Mrs. Holly
seconded the motion and the vote was unanimous in favor of the motion.
B) AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING THE VILLAGE
CODE OF ORDINANCES, CHAPTER 14, ARTICLE IV. COMMERICAL PHOTOGRAPHY AND
FILMING, SECTIONS 14-71, 14-72 AND 14-73, RELATING TO FILM LICENSING, PROVIDING
FOR CONFLICTS, AND PROVIDING FOR AN EFFECTIVE DATE.

Mrs. Estep read the caption of the ordinance. Mr. Benton indicated that the staff would like to conduct further
research on the proposed fee schedule. Mrs. Holly moved to table the item. Mr. Davis seconded the motion and
the vote was unanimous in favor of the motion.
C) AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL AMENDING SECTION 6.7
OF THE MIAMI SHORES VILLAGE CODE OF ORDINANCES RELATING TO BUILDING
PERMIT FEES; PROVIDING FOR FEES FOR RIGHT-OF-WAY CONSTRUCTION, PROVIDING
FOR CONFLICTS, PROVIDING FOR SEVERABILITY, PROVIDING FOR AN EFFECTIVE
DATE.
Mrs. Estep read the title of the proposed ordinance. Mr. Benton confirmed that the issue had previously been
discussed during the budget workshop process and represents a minor increase in a specific fee category. Mayor
McCoy opened the floor for the Public Hearing but as no one present wished to speak on the issue, closed the
Public Hearing and asked for a motion from his colleagues. Mr. Davis moved to adopt the ordinance on second
and final reading. Mr. Ullman seconded the motion and the vote was unanimous in favor of the motion.
D) AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING SECTIONS 18-38,
18-39, 18-48, 18-49, 18-53, 18-58 AND 18-65 OF THE CODE OF ORDINANCES OF MIAMI
SHORES VILLAGE, FLORIDA, RELATING TO THE DEFINITION OF AVERAGE FINAL
COMPENSATION, CONTRIBUTIONS BY MEMBERS, CREDITABLE SERVICE, THE
COMPOSITION OF THE GENERAL EMPLOYEES PENSION BOARD AND THE POLICE
OFFICER'S RETIREMENT SYSTEM PENSION BOARD, PROVIDING FOR CONFLICTS,
PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE.
Mrs. Estep read the caption of the ordinance. Mr. Davis moved to adopt the ordinance as presented. Mr. Ullman
seconded the motion. Mayor McCoy opened the floor for the public hearing. As no one present wished to speak
on the ordinance, Mayor McCoy closed the public hearing and called for the vote which was unanimous in favor
of the motion.
2) VILLAGE MANAGER Tom Benton
A) DISCUSSION AND POSSIBLE ACTION REGARDING ERECTING A FENCE WITHIN THE
EXISTING BARRICADE LOCATED AT N. BAYSHORE DRIVE AND 91ST TERRACE.
Mr. Benton provided background information on the issue, recapping the previous discussion and request for
further input from the residents in the neighborhood. Individual Council Members voiced their opinions on the
idea of a gated fence within the existing barricade. Mayor McCoy opened the floor for public comment. Resident
Alice Burch, indicated that she is in favor of the gated fence and commended Dr. Chaille for his initiative in
bringing the issue to the Village's attention. Resident Dr. Chaille, the individual who requested the fence within
the barricade, spoke of his experience in gathering petition signatures.
Council Members reiterated their views on the issue. Mr. Ullman asked that an item be placed on the next
Council Agenda so that a discussion regarding the possibility of installing sidewalks along 10th Avenue could take
place. Mrs. Estep indicated that she would agenda the item as requested.
Mr. Davis moved to approve the gated fence at N.E. 91st Terrace and North Bayshore Drive. Mrs. Holly seconded
the motion and the vote was unanimous in favor.
3) ANNOUNCEMENTS
The Village Clerk read the announcements.
4) PUBLIC COMMENTS
• No one in the audience wished to make any comments.
5) COUNCIL COMMENTS
Greg Ullman Mr. Ullman spoke about early voting for the upcoming election, urging people to take advantage
of the opportunity to vote beginning October 18th at the North Miami Library.

Mrs. Holly also spoke about early voting and talked about absentee ballots being available after
Jim McCoy Mayor McCoy thanked Commissioner Sally Heyman for her presentation and spoke about the
County's General Obligation Bond issue which will be on the November ballot.
6) ADJOURNMENT
The October 5, 2004 Council Meeting was adjourned at 8:23 PM.
