MIAMI SHORES VILLAGE
REGULAR COUNCIL MEETING
The Miami Shores Village Council held their regularly scheduled meeting on Tuesday, July 2,
2002 in the Village Hall. The meeting was called to order at 7:30 PM with the following
members present:

Al Berg, Planning & Zoning/Code Enforcement Director presented John & Beverly Petersen with
a certificate in honor of their home being named "House of the Month" for the month of July,
2002.

CONSIDERATIONS

A) APPROVAL OF THE JUNE 18, 2002 REGULAR COUNCIL MEETING
MINUTES.
Mr. Ullman moved approval of the June 18, 2002 regular Council Meeting Minutes. Mr. Herrera
seconded the motion and the vote was unanimous in favor.
B) APPOINTMENTS TO THE LIBRARY BOARD OF TRUSTEES
1 APPOINTMENT FOR A FIVE (5) YEAR TERM
1 APPOINTMENT FOR A THREE (3) YEAR TERM (UNEXPIRED TERM OF
PAULA XANTHOPOULOU)
The Village Clerk reviewed the procedure for the appointments, indicating that as only three
Council Members were present, they would all need to agree for any of the appointments to be
made. It was decided that if the Council Members could not agree on the appointments after
three ballots, the item would be deferred until the next meeting where a full Council was present.
Applicants Dan Dower, Cheryl Gowing, Susan Maguire, Fredrick Miller, Frank Muscarella and
Carl Paulsen were present and spoke on their own behalf. The results of the first vote were as
follows:

As there was not a unanimous selection, a second vote was taken with the following results:

Once again, there was not a unanimous selection and a third vote was taken, the results of which
were as follows:

Per the decision of the present Council Members, this item was deferred until a full Council was
present to vote. It was agreed that all residents who had applied for the appointments would be
eligible for the appointment and all were invited back to the next meeting.
At this point in time, Ms. Alice Burch, Chair of the Brockway Memorial Library Board of
Trustees, provided the Council with a report on the operations of the Library over the past year.
C) AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING
CHAPTER 18, ARTICLE III, SECTION 49, SERVICE RETIREMENT
ALLOWANCE, PROVIDING FOR A THIRTY YEAR AND OUT CLAUSE TO
THE GENERAL EMPLOYEE PENSION PLAN, PROVIDING FOR CONFLICTS,
PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE
DATE. (Second & Final Reading — Public Hearing Required)
The Clerk read the caption of the Ordinance and indicated that the required advertising criteria
had been met. Mr. Ullman moved to adopt the Ordinance on second reading. Mr. Herrera
seconded the motion. Mayor Davis opened the Public Hearing for the Ordinance adoption.
There was no one present who wished to speak on the issue and therefore, Mayor Davis closed
the Public Hearing and called for the vote. The vote was unanimous in favor of the motion.
2) ANNOUCEMENTS
The Clerk read the announcements.
3) PUBLIC COMMENTS
Martin Drummond Pastor Drummond remarked about the quality of applicants for the
Library Board and spoke about available overflow parking for the
Library at the Church facilities.

Kathy Moore Ms. Moore spoke about the proposed Marbella Apartment project just
south of Miami Shores, expressing her opposition.
Francis Hill Mr. Hill spoke of his concerns with the Marbella project.
Richard Bartolli Mr. Bartolli also spoke of the Marbella project and expressed his
opposition.
4) COUNCIL COMMENTS
Greg Ullman
Mr. Ullman addressed the residents who spoke about the Marbella
project and advised them that it is the Council's intention to have a
presentation from the developer.
Prospero Herrera Mr. Herrera congratulated the Petersen's on their House of the Month
award and wished everyone a happy holiday.
Mayor Davis
Mayor Davis wished everyone a safe and happy 4th of July.
5) ADJOURNMENT
The July 2, 2002 Council Meeting was adjourned at 8:04 PM.
