SPECIAL COUNCIL MEETING
A Special Meeting of the Miami Shores Village Council was held on Monday, July 23, 2001 at the Village
Hall commencing at 7:30 PM with the following members present:

ALSO PRESENT: Tom Benton, Village Manager
Barbara Fugazzi, Village Clerk
ABSENT: Richard Sarafan, Village Attorney
CONSIDERATIONS
1) MINUTES Barbara Fugazzi
• A) APPROVAL OF THE JULY 11, 2001 BUDGET WORKSHOP MINUTES AND THE
JULY 17, 2001 REGULAR COUNCIL MEETING MINUTES.

Mr. Blum moved approval of the Minutes as submitted. Mr. Herrera seconded the motion and the vote was
unanimous in favor.
2) VILLAGE COUNCIL Mark Ulmer
A) MOTION TO AUTHORIZE THE VILLAGE MANAGER TO RETAIN A CONSULTANT
TO ANALYZE THE AQUATIC CENTER.
Mr. Ulmer provided background information regarding the issue. Mr. Ulmer then moved to authorize the
Village Manager to retain a consultant to consider and report on: a) the perceived negative impacts of the
Aquatic Center on adjacent property owners, if any; and, b) options that the Village might consider, if any, to
lessen any such impacts, to the extent they actually exist, without negatively impacting the Village's
operation of the Aquatic Center. Mr. Herrera seconded the motion. Mr. Ulmer summarized his intent in
making the motion. Council discussion centered around clarification on the consultant services and including
a dollar amount within the motion. A consensus was reached to amend the motion to include language
indicating "at a cost not to exceed $20,000." Council members expressed their belief that the study should
include the following elements: 1) Identify the problem; 2) Offer possible solutions; and 3) Provide
approximate costs to solve. Mr. Ullman stated, for the record, that although he owns property on N.E. 104th
Street, he does not have a conflict on the issue, and he requested that Mayor Davis open the floor for public
comment on the issue. Mayor Davis opened the floor for public comment.

Tim Mr. Niezabitowski spoke about the noise ordinance and indicated that the Village
Niezabitowski should get rid of any noise problems
Kitra O'Connor Ms. O'Connor stated that the Village should spend money on fixing the problem
rather than on a consultant to study the noise problem.
Michael Cudlipp Mr. Cudlipp thanked the Council for their attention to the issue.
Mayor Davis called for a vote on the amended motion. The vote was unanimous in favor.
3) VILLAGE MANAGER Tom Benton
A) REQUEST AWARD OF BID FOR THE BROCKWAY MEMORIAL LIBRARY
EXPANSION PROJECT AND AUTHORIZATION TO ENTER INTO AN AGREEMENT
WITH THE TOP RANKED FIRM OF BROWN & BROWN ARCHITECTS.
Mr. Benton provided information regarding the architectural/construction firm selection process for the
Library expansion project. Mr. Benton advised the Council of the specific language which should be
included as part of the motion. Mr. Benton read into the record the following motion: Council moves to
authorize awarding the contract for the Library addition construction in the amount of $341,000 to Brown &
Brown Architects/Construction, after all of the requirements of the Public Library Construction Grant
Program, administered by the Division of Library and Information Services, have been met and approved by
our Village Attorney. Subsequent to this, Mr. Ulmer moved the item. Mr. Herrera seconded the motion.
Ms. Burch, Chair of the Library Board of Trustees, advised the Council on the status of the State grant
funding. Mr. Bill Brown, President of Brown & Brown, introduced himself and spoke briefly about his firm.
Mayor Davis called for a vote on the motion. The vote was unanimous in favor.
4) ANNOUNCEMENTS
The Clerk read the announcements.
5) PUBLIC COMMENTS
Leon Newman Mr. Newman spoke about marketing for the pool.
6) COUNCIL COMMENTS
Greg Ulhnan Mr. Ullman thanked the residents of N.E. 104th Street for their attendance.
7) ADJOURNMENT
The July 23, 2001 Special Council Meeting was adjourned at 8:03 PM.
