MIAMI SHORES VILLAGE
REGULAR COUNCIL MEETING
The regularly scheduled meeting of the Miami Shores Village Council was held on Tuesday,
March 20, 2001 at the Village Hall and commending at 7:30 PM with the following members
present:

CONSIDERATIONS
• 1) VILLAGE CLERK Barbara A. Fugazzi
A) APPROVAL OF THE MARCH 6, 2001 REGULAR COUNCIL MEETING
MINUTES.
Ms. Agosta moved approval of the March 6, 2001 Council Meeting Minutes. Mr. Blum
seconded the motion and the vote was unanimous in favor.

B) AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING
SECTION 11-4 (f) OF THE VILLAGE CODE OF ORDINANCES, RELATING
TO THE NUMBER OF MEMBERS OF THE HISTORIC PRESERVATION
BOARD WHOM MUST BE PRESENT TO CONSTITUTE A QUORUM,
PROVIDING FOR AN EFFECTIVE DATE.
The Clerk read the caption of the ordinance and indicated that it was requested that the ordinance
be considered for adoption on an emergency basis. Ms. Fugazzi outlined the intent of the
amending language and the reason for the request to adopt on an emergency basis (current
recodification/reformatting of the code of ordinances). Mr. Benton elaborated on Ms. Fugazzi's
comments. Mr. Loffredo moved to adopt the ordinance as presented on an emergency basis. Ms.
Agosta seconded the motion. Mayor Ulmer opened the floor for public comment and hearing
none, closed public comment and called for the vote which was unanimous in favor of the
motion.

2) FINANCE DEPARTMENT Mark A. Malatak
A) PRESENTATION OF THE COMPREHENSIVE ANNUAL FINANCIAL
REPORT FOR FISCAL YEAR ENDING SEPTEMBER 30, 2000.
Mr. Malatak introduced Mr. Jerry Chiocca from the auditing firm of Rachlin, Cohen & Holtz.
Mr. Chiocca reviewed some of the numbers/dollar values contained in the Comprehensive
Annual Financial Report (CAFRA). The impact of the recent decline in the stock market on the
Village's pension plans were discussed. Mr. Chiocca indicated that the Village's computer
accounting program is a major problem, one that must be addressed in the very near future. He
indicated that a number of issues arose from the difficulties with the computer software, causing
a delay in the completion of the audit and wasted hours tracing incomplete and erroneous
printouts. Mr. Loffredo moved to accept the CAFRA for the fiscal year ending September 30,
2000. Mr. Blum seconded the motion and the vote was unanimous in favor.
3) POLICE DEPARTMENT
A) REQUEST FOR APPROPRIATION AND EXPENDITURE OF FORFEITURE
FUNDS IN THE AMOUNT OF $4,000 TO THE INFORMED FAMILIES OF
MIAMI-DADE COUNTY ORGANIZATION.
Chief Masten outlined the request for forfeiture funds, indicating that the expenditure would
satisfy a portion of the State mandated donations to charitable organizations. Mr. Davis moved
to appropriate and expend $4,000 of forfeiture funds with Informed Families. Ms. Agosta
seconded the motion and the vote was unanimous in favor.
4) VILLAGE COUNCIL Mayor Ulmer
A) MOTION TO APPROVE AND APPROPRIATE FUNDING FOR THE
CONSTRUCTION OF A VILLAGE MARQUEE ON THE VILLAGE HALL
LAWN.
Mayor Ulmer indicated his intention to withdraw the item as he did not have enough information
to make a motion to move forward.
B) MOTION TO DIRECT THE VILLAGE MANAGER TO SUBMIT TO THE
PLANNING BOARD AN APPLICATION FOR MODIFICATION OF THE SITE
PLAN AND FOR A VARIANCE TO PERMIT THE CONSTRUCTION OF AN
EIGHT FOOT HIGH WALL ALONG THE PERIMETER OF THE MIAMI
SHORES AQUATIC CENTER AND POOL.
Mayor Ulmer stated that subsequent to a meeting with the effected property owners of N.E. 104th
Street, he was withdrawing the item from the agenda. He indicated that the residents of N.E.
104th Street have requested that a sound study be conducted during the summer months and that
the Village delay taking any further action until an additional study can be completed.

6) PUBLIC COMMENTS
No one from the audience wished to speak.
7) COUNCIL COMMENTS
Steve Loffredo Mr. Loffredo spoke about wooden fences and the O'Dell wall.
Mayor Ulmer Mayor Ulmer advised everyone that he would not be present for the April
3, 2001 Council Meeting.
8) ADJOURNMENT
The March 20, 2001 Council Meeting was adjourned at 8:05 PM.
