REGULAR COUNCIL MEETING
MAY 1 , 1990
The regular meeting of the Miami Shores Village Council
was held on Tuesday, May 1 , 1990 at Village Hall commencing
at 7:35 p.m. with the following members present :
Mayor Courtney
Herb Spahn
Spero Canton
Stephen Loffredo
Marty Stofik
Also present : Gait Macdonald
William F. Fann . .
Mayor Courtney presented a proclamation to Ms. O'nell for
National Music Week and received a flag that flew over the
Capitol in Washington, from Mr . Art Taylor of the Village Lodge.
ITEM *1 MINUTES
Ms. Stofik moved approval of the minutes from the Regular
Council Meeting of 4/17/90. Mr . Spahn seconded the motion and
the vote was unanimous in favor . Mayor Courtney acknowledged
receipt of the minutes from the following meetings:
Historic Preservation Board 4/16/90
Planning and Zoning Board 4/12/90
ITEM *2 REQUEST FOR APPROVAL OF HOUSE COLORS.
Mr . Lubien explained the background . Mr . Fann stated that the
Item is not a request for a variance rather a determination from
Council if the P&Z Board properly Interpreted the Code of
Ordinances. Mr . Spahn spoke about the color of houses and his
past request for a color chart of permissible colors. He said
that this case is a Judgement call . Ms. Stofik stated that a
color chart is very hard to create. Mr . Loffredo arrived at
this point in the meeting. Mayor Courtney stated that the P&Z
minutes reflect that examples of the colors were provided. Mr .
Spahn moved to overturn the decision of the P&Z Board . Mayor
Courtney passed the gavel over to Ms. Stoflk and seconded the
motion . He said that this is a very subjective Item. Ms.
Stofik stated that there is nothing unique In this case that
would allow overturning P&Z 's decision . The vote was as
follows: Spahn, Courtney - Yes, Loffredo, Stofik - No. Mayor
Courtney explained that a 4/5 vote is necessary to overturn the
Board 's decision and the motion falls.
ITEM #3 STAFF 'S RECOMMENDATION ABOUT PLACING A SCHOOL CROSSING
GUARD AT THE INTERSECTION OF 96TH AND 4TH. Ms. Macdonald
explained that a pedestrian count was taken and the highest
count was 13. She read a letter from Dade County Public Works
Department and recommended not placing a school crossing guard
at the Intersection.
ITEM *4 DISCUSSION AND POSSIBLE ACTION REGARDING CONSTRUCTION
OF BARRICADE AT NZ 91ST AND 4TH. Ms. Macdonald explained the
background . M;, . Canton arrived at the meeting at this time.
Mr . Frank Amar Damon stated that he was In favor of placing a
barricade at 91st and 4th . Ms. Debbie Brown, Mr . Lou Imburgla,
Ms. Linnett Davis, Mr . Blake Davis, Ms. Castell Bryant, Mr .
Keith Videcki , Ms. Vanessa Johnson, Ms. Maria Leonard, and Mr .
Joe lorio all spoke in favor of placing a barricade at that
location. Most spoke about the speed rather than the volume of
the traffic. Mr . Louie Lezama and Ms. Sandy Lezama were opposed
to placing a barricade in the proposed location although they
said they were generally in favor of barricades. Ms. Stofik
stated that the barricade originally was not placed as a
courtesy to EI Portal and that it will be an inconvenience if
the barricade is placed . She said the Idea of temporary
barricades is to see how they work in each location. Ms. Stofik
moved to place a temporary barricade at NE 91st Street and 4th
Avenue. Mr . Canton seconded the motion . He spoke about the
evaluation of the barricade program, the quality of life and the
perception of crime. Mr . Loffredo spoke about the speed of the
traffic on 4th Avenue. Mayor Courtney stated that he was
opposed to the Installation of the barricade because it would
cause more traffic on 96th Street . Mr . Spahn spoke about the
grid system layout of Miami Shores. The vote was as follows:
Spahn, Canton, Stofik - Yes, Loffredo, Courtney - No. The
motion passed . Ms. Stofik asked when the barricade will be
Installed . Mr . Benton replied tomorrow. Mr . Loffredo explained
the bid process for the permanent barricades. Mr . Stokesberry
spoke about barricades at 91st Terrace and 10th Avenue. Mr .
Canton asked for an estimate to complete the temporary barricade
program. Mayor Courtney asked how much each barrel costs. Mr .
Benton replied approximately $11 for everything and takes 3 to 4
weeks for delivery. Mr . Canton moved to give the Village
Manager up to $2,000 to complete road closures on the area East
of Biscayne Boulevard and North of 91st within the Miami Shores
Village limits. Ms. Stofik seconded the motion . Mr . Spahn
asked for a special Council meeting next week to decide the
Issue. He said the Council needs the facts before a decision Is
made. The vote was as follows: Canton, Loffredo, Stofik - Yes,
Spahn, Courtney - No. The motion passed .
ITEM *5 ANNOUNCEMENTS
Mayor Courtney read the announcements.
ITEM *6 COUNCIL COMMENTS
Mr . Canton spoke about Mr . Fernandez 's letter to the P&Z Board
and the workshop meeting on May 8th .
Mr . Spahn spoke about barricades and dealing with the County.
Mr . Loffredo spoke about the barricade process and little
league.
Mayor Courtney spoke about National Book Week and the program at
the Library.
ITEM *6 PUBLIC COMMENTS
Mr . Owen Henderson, Ms. Kathy Hull , Mr . Larry Hull , Mr . Wally
Moneyhun all spoke about the schedule at the pool and the swim
team's request for a change in the schedule. Mr . Loffredo
stated that the staff is not at fault in this situation. Mr .
Canton stated that the actions of the staff were outrageous.
Ms. Stofik spoke about the Red Cross coming to evaluate the
safety at the pool . She said she was unhappy with the pool
staff 's actions. Mr . Spahn suggested directing the staff to get
an Independent person to check the safety situation . Ms. Jackie
Walker and Mr . Kim Walker spoke about the swim team and the
pool schedule. Mayor Courtney stated that the situation should
be handled administratively.
