09-16-1986 Regular MeetingREGULAR MEETING MIAMI SHORES VILLAGE COUNCIL September 16, 1986 The regular meeting of the Miami Shores Village Council was held on September 16, 1986 at the Village Hall commencing at 7:30 p.m. with the following members present: Mayor Karen Kirby Robert S. Butler, Jr. Kevin P. O'Connor Elspeth Jensen Marty Stofik Also present L.R. Forney, Jr., Village Manager William F. Fann, Jr., Village Attorney The meeting began with Reverend John McLaughlin, St. Martha's Catholic Church, giving the invocation and followed by the Pledge of Allegiance. MINUTES. (a) The Regular Council Meeting of September 2, 1986 - Mrs. Stofik made a motion to approve the minutes as written. Dr. Butler seconded. Mayor Kirby requested that her comments regarding the unsatisfactory quality of the lunches prepared by the Country Club for community meetings be included in the minutes. Approval of minutes passed unanimously to include the Mayor's comments. (b) First Public Hearing on Village and Country Club Tentative Budget of September 4, 1986 - Mrs. Stofik made a motion to approve the minutes as written. Dr. Butler seconded and it was passed unanimously. (c) Second Public Hearing to Amend Tentative tiudget; Adopt Final Budget and Adopt Millage Rate of September 10, 1986 - Mrs. Stofik made a motion to approve the minutes as written. Dr. Butler seconded and it was passed unanimously. Receipt Acknowledged: (d) Fine Arts Commission 8/9/86. Mrs. Jensen stated that since a quorum was not present for the meeting, the "minutes" were actually a report of discussion rather than minutes. (e) Code Enforcement Board 9/3/86. (f) Planning and Zoning Board 9/11/86. (g) Downtown Revitalization Board 9/3/86. Mrs. Stofik congratulated the Downtown Revitalization Board on its positive actions. Mayor Kirby asked for the annual updated report to be presented to the Council. PENSION BOARD ORDINANCE. Second and Final Reading The Deputy Village Clerk read the Ordinance entitled: ORDINANCE NO. 496-86 AN ORDINANCE AMENDING THE PROVISIONS OF CHAPTER 18, ARTICLE III, OF THE PENSION PLAN OF THE MIAMI SHORES VILLAGE CODE OF ORDINANCES TO PROVIDE FOR THE ELECTION OF A POLICE REPRESENTATIVE TO THE PENSION BOARD, TO PROVIDE FOR THE ELECTION OF THE SECRETARY OF THE PENSION BOARD, TO PRESCRIBE A SYSTEM FOR FILLING APPOINTED AND ELECTIVE VACANCIES ON THE BOARD AND TO AUTHORIZE THE BOARD TO DETERMINE THE ASSET ALLOCATION MIX. 2 Dr. Butler made a motion to adopt the Ordinance on second reading. Mr. O'Connor seconded and it was passed unanimously. BOARD ATTENDANCE POLICY DISCUSSION. Mrs. Stofik suggested that the Chairman of each committee convey the information that the Council does expect participation of its committee members. She felt that 50% attendance was reasonable and asked Mr. Forney to review the committee minutes and report back to the Council at the next meeting on attendance for the last year. Mrs. Jensen felt that committee meetings should not take place during the summer. Dr. Butler explained that this was necessary for committees to plan functions during the summer for the fall season. Mr. O'Connor commented that it was necessary for the Code Enforcement and Planning and Zoning Boards to meet during the summer in order to serve the needs of the residents. Mayor Kirby asked for a consensus of the Council that 50% attendance be established as a policy not an ordinance. She would support this only if it were not retroactive. Mrs. Jensen suggested that boards having poor attendance be dissolved. Mr. Forney will review the minutes and report back to the Council. *Mrs. Jensen was opposed. APPOINTMENTS TO BOARDS AND COMMISSIONS. Planning and Zoning Board - 2 vacancies - Applicants: Robert J. Rossi, Thomas J. Laubenthal, J. Leslie Wiesen, and Michael P. Cudlipp. As a result of a vote by ballot the following applicants were unanimously reappointed to a 2 year term expiring in September 1988: Robert J. Rossi Thomas J. Laubenthal Code Enforcement Board - 3 vacancies - Applicants: David B. Daley, Arthur H. Taylor, J. Leslie Wiesen, Dr. Tom James and Sandy Sottilare. As a result of a vote by ballot the following applicants were appointed to a 3 year term expiring in September 1989: Arthur H. Taylor Dr. Tom James As a result of a vote by ballot the following applicant was appointed to a 1 year term due to a resignation of an unexpired term to expire in September 1987: Sandy Sottilare Historic Preservation Board - 2 vacancies - Applicants: Margo Newton and Henry D. Gaggstatter. Upon a motion made by Mrs. Stofik, seconded by Dr. Butler and passed unanimously, the following were reappointed to a 2 year term expiring in September 1988: Margo Newton Henry D. Gaggstatter Recreation Advisory Board - 4 vacancies - Applicants: Joe Dugoni, Candy Rengstl, Bernadette Bosstick and Spero C. Canton: *Amended October 7,1986 Upon a motion made by Mr. O'Connor, seconded by Dr. Butler and passed unanimously, the following were appointed to a 2 year term expiring in September 1988: Joe Dugoni Candy Rengstl Bernadette Bosstick Spero C. Canton Country Club Advisory Board - 4 vacancies - Applicants: Bobbi Scott, William G. Mercer, Johnathan W. Rose, Walter Stevens, John Kirby, Lee Howard, Michael P. Cudlipp and Angela Daley Upon a vote by ballot the following applicants were appointed to a 2 year term expiring in September 1988: William G. Mercer Walter Stevens Lee Howard Angela Daley Beautification Advisory Board - 2 vacancies - Applicants: Peggy Hayward, Mildren Dean, M. Antoinette Vigneron and Maaike Visser. Upon a vote by ballot the following applicants were appointed to a 2 year term expiring in September 1988: Peggy Hayward M. Antoinette Vigneron Advisory Board on Handicapped Services - 3 vacancies - Applicants: Gordon B. Scott, Jr. and Reno Cocchi. Upon a motion made by Mrs. Jensen, seconded by Mrs. Stofik and passed unanimously the following were appointed unanimously for a 2 year term expiring in September 1988: Gordon B. Scott, Jr. Reno Cocchi NOTE: One vacancy still exists on this board. Fine Arts Commission - 4 vacancies - Applicants: Jean Cuson, Ron Marrocco, Mary S. Judernatz, Edward Abdella, Teresa Simas, Rosemarie Chiarlone Wolfson and Sister Myra Marck. Upon a vote by ballot the following applicants were appointed to a 3 year term expiring in September 1989: Jean Cuson Rosemarie Chiarlone Wolfson Sister Myra Marck And to a 1 year term expiring in September 1987: Ron Marrocco Downtown Revitalization Board - 1 vacancy - Applicants: Patricia E. Dahne, Marie Hoey and Steve B. Forbes. Mayor Kirby asked Mr. Fann if she was required to vote because she was not satisfied with the candidates. Mr. Fann responded that she should vote and disclose her conflict or nominate someone else. Mayor Kirby then nominated Mr. Sandy Sottilare. 4 By a vote by ballot the following applicant was appointed to a 1 year term expiring in September 1987: Sandy Sottilare CANCER CARD PARTICIPATION. Mr. Forney recommended that we participate again next year in this program. Mrs. Stofik made a motion to approve the recommendation. Mrs. Jensen seconded and it passed unanimously. Dr. Butler requested that again next year we ensure the cards are punched when used. VILLAGE MANAGER'S REPORT. (a) Country Club Financial Report. (b) Country Club Membership Report (c) Investment Report. (d) Film Variance Report. A variance was granted for filming on Saturday at the Pink House because rain had prevented a previously permitted shoot. The Public Hearings for the change in B-1, B-2 and X Zones will take place November 18 and December 2. ANNOUNCEMENTS. As noted on the agenda. COUNCIL COMMENTS. Mayor Kirby thanked all committee and board applicants. Dr. Butler commended Mr. Oxford's efforts to increase Country Club membership. Mrs. Jensen also supported Mr. Oxford's efforts and brought the front page of a Baton Rouge newspaper to show a contest for the biggest cockroach. PUBLIC COMMENTS. Mrs. Candy Rengstl requested a Proclamation for St. Rose of Lima Day when Mr. William Bennet, U.S. Secretary of Education, would visit. The meeting adjourned at 8:25 p.m. ATTEST: L.R.
