08-05-1986 Regular MeetingREGULAR MEETING MIAMI SHORES VILLAGE COUNCIL August 5, 1986 The regular meeting of the Miami Shores Village Council was held on August 5, 1986 at the Village Hall, commencing at 7:35 p.m. with the following members present: Mayor Karen Kirby Robert S. Butler, Jr. Kevin P. O'Connor Elspeth Jensen Marty Stofik Also present: L.R. Forney, Jr., Village Manager William F. Fann, Jr., Village Attorney The meeting began with Reverend Harold A. Davenport, Miami Shores Community Church, giving the invocation, followed by the Pledge of Allegiance. PRESENTATION. Mayor Kirby presented a Proclamation establishing August 12 as National Night Out in Miami Shores to Mr. and Mrs. Eddie Swan, Coordinators of the year's event. MINUTES. (a) The Regular Council Meeting of July 15, 1986 - A motion was made by Mrs. Stofik to approve the minutes as written, seconded by Mrs. Jensen and it was passed unanimously. (b) Dr. Butler asked the the Budget Workshop Minutes be amended to include his name as giving the second to the motion approving the Public Works Administration budget on July 23. Mrs. Jensen stated that she was opposed to the Downtown Revitalization budget but her vote was not counted as she had to leave the meeting. Mrs. Stofik made a motion to approve the Budget Workshop Minutes of July 21, 22, 23, and 24 as amended. Dr. Butler seconded and it was passed unanimously. Receipt Acknowledged: (c) Recreation Advisory Committee 7/14/86. (d) Downtown Revitalization Board 7/16/86. (e) Fine Arts Commission 7/7/86. (f) Planning and Zoning Board 7/24/86. STORAGE OF JUNK AND TRASH ORDINANCE. First Reading AN ORDINANCE AMENDING SECTION 501 (k) OF ORDINANCE NO. 270, OF MIAMI SHORES VILLAGE, FLORIDA; EXPANDING PROHIBITION AGAINST STORAGE OF JUNK, TRASH, AND DERELICT PERSONAL PROPERTY WITHIN THE LIMITS OF MIAMI SHORES VILLAGE, FLORIDA; PROVIDING EFFECTIVE DATE. - 2 Mrs. Jensen made a motion to adopt on the first reading, Mrs. Stofik seconded and it passed unanimously. RESOLUTION FOR SPECIAL ELECTION TO ESTABLISH THE NUMBER OF SIGNATURES FOR INITIATIVE AND REFERENDUM. RESOLUTION NO. 805-86 RESOLUTION CALLING FOR SPECIAL ELECTION IN MIAMI SHIRES VILLAGE, FLORIDA, ON TUESDAY, NOVEMBER 4, 1986, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF MIAMI SHORES VILLAGE A PROPOSED AMENDMENT TO ARTICLE III, SECTION 28, PARAGRAPH (A) (2) OF THE MIAMI SHORES VILLAGE CHARTER TO ESTABLISH THE NUMBER OF 500 AS THE MINIMUM NUMBER OF REQUIRED SIGNATURES FOR INITIATIVE AND REFERENDUM. Mrs. Jensen made a motion to approve the Resolution. Dr. Butler seconded and it passed unanimously. COUNTRY CLUB DUES RESOLUTION. RESOLUTION NO. 804-86 A RESOLUTION REPEALING RESOLUTION NO. 792-85 and 799-86 REGARDING COUNTRY CLUB FEES AND USE REGULATIONS; RE-ESTABLISHING MIAMI SHORES COUNTRY CLUB ANNUAL MEMBERSHIP FEES; DAILY GOLF AND TENNIS FEE. DEFINING MEMBERSHIPS AND REGULATING PLAN. Mr. Forney asked to eliminate paragraph 3 (f) which would require guests to take golf carts. Mrs. Stofik made a motion to approve with the elimination of paragraph 3 (f) and Dr. Butler seconded. The floor was opened to public discussion. Mr. Jack Rengstl suggested that the age be increased from 36 to 45 for intermediates and that the non-resident dues be lowered by $100 for family and single memberships. Mayor Kirby asked the Clerk for a roll call vote on the motion: Marty Stofik . . . . yes Kevin P. O'Connor . .yes Robert S. Butler . . yes Elspeth Jensen . . . yes Mayor Karen Kirby . yes The vote was unanimous to approve the Resolution. REQUEST FROM HISTORIC PRESERVATION BOARD FOR AUTHORITY TO APPLY FOR A STATE GRANT. Margo Newton, Chairman, Historic Preservation Board, explained that the Board was asking for $2,500 for a state grant which would require matching funds by the Village either in cash or in-kind services such as volunteer fime. The grant application would be in the category of survey and planning activities for the 3 preparation of data for listing of historic sites on the National Register of Historic Places. Mrs. Stofik made a motion to approve. Dr. Butler seconded and it passed unanimously. COUNTRY CLUB MEMBERSHIP PROMOTION CAMPAIGN. Mr. Forney recommended accepting Robert M. Levy & Associates Inc.,at $500 per month, hiring a temporary Membership Director for $300 a week and 5% commission and using the remaining $17,000 for promotional materials. Dr. Butler made a motion to approve. Mrs. Stofik seconded and it passed unanimously. PBA ACTUARIAL STUDY. Mr. Forney asked that the Village be willing to contribute $2,100 rather than the original $1,200 for the actuarial study required to evaluate the PBA pension demands. Mr. O'Connor made a motion to approve the Manager's request. Dr. Butler seconded and it passed unanimously. JULY BUDGET EXECUTION REVIEW. Mr. Forney read the four changes he was asking: An additional $300 for Mayor and Council, $6,000 for Legal Counsel, $750 for Village Manager, and $77,200 for Public Works. Mrs. Jensen made a motion to approve. Mr. O'Connor seconded. Dr. Butler asked that the motion be amended to include adding the hiring of two new police officers right away. Mrs. Jensen seconded. The amendment was unanimously passed. The July budget execution review recommendations were unanimously approved. VILLAGE MANAGER'S REPORT. (a) Optimist Christmas Tree Sales The Optimist Club will donate an 18 ft. tree for the tree lighting ceremony to take place in front of Village Hall. (b) Soccer Sanctions The U.S. Youth Soccer Association has remitted all sanctions except for the $300 fine and one on individuals. ANNOUNCEMENTS. As noted on the agenda. COUNCIL COMMENTS. -4 - Mayor Kirby thanked Rod Bryson who worked on the soccer sanctions. Mr. O'Connor also expressed his gratification to Mr. Bryson and to the other parents who volunteered their time. Mayor Kirby announced that Agnes Conlon, a former teacher at Edison Senior High School and long time resident, had passed away. Dr. Butler asked all residents to look at their own alleys for cleaning. PUBLIC COMMENTS. None. The meeting was adjourned at 8:40 p.m. ATTEST: L.R.
