MIAMI SHORES VILLAGE COUNCIL
November 19, 1985
The regular meeting of the Miami Shores Village Council
was held on November 19, 1985 at Village Hall, commencing at 7:40p.m.,
with the following members present:
Mayor Karen Kirby
Robert '.S. Butler, Jr.
Kevin P. O'Connor
Elspeth Jensen
Marty Stofik
Also Present: L.R. Forney, Jr., Village Manager
William F. Fann, Jr., Village Attorney
The meeting was opened with an invocation given by
Reverend John Stroman of Rader Memorial Methodist Church, followed by
the Pledge of Allegiance.
MINUTES.
(a) Council meeting of November 5, 1985 -Mrs. Stofik moved to approve the
minutes as written, seconded by Mr. O'Connor and passed unanimously.

PLANNING & ZONING BOARD APPROVALS/DENIALS.
(a) Gordon request for approval of plans for new building,
Item 4, 11/14/85.
Mr. Frank LuBien, Director of Building & Zoning, explained
that the Planning & Zoning Board had approved Mr. Gordon's site plans to
construct a new building, subject to compliance with Section 225 of Miami
Shores Village Code of Ordinance, which stipulates that all exterior
walls shall be masonry. In this particular case the walls were masonry
but covered with wood.
After considerable discussion between Council, Mr. Carlson
of Carlson Construction Company and Mr. Gordon the owner of the building,
Council referred this request to the Planning & Zoning Board to determine
if a variance was required to apply wood trim on the building.

APPROVAL OF TOP DRESSING MACHINE FOR THE GOLF COURSE.
Mr. Forney reported that three vendors had been contacted
to submit bids on a top dressing machine. DeBra Turf & Industrial
Equipment Company was the only bidder.
Mr. Lee Fullmer, Golf Course Superintendent, explained
DeBra was the only company that handled this machine.
Mr. O'Connor moved to approve the purchase of the top
dressing machine from DeBra Turf & Equipment Company at a cost of
$5,595.00, seconded by Dr. Butler and passed unanimously.
APPROVAL OF APPLICATION FOR GRANT-IN-AID ASSISTANCE
FOR HISTORIC PRESERVATION BOARD.
Ms. Margo Newton, Chairwoman of the Historic Preservation
Board, outlined a request for Council approval to apply for a Federal
Grant -In -Aid in order to prepare the nomination of Miami Shores to be
listed on the National Register of Historic Places as a thematic resource
district. She explained the group theme was "The Miami Shores Development
As Developed by the Shoreland Company During the Years of 1924-26".
Mayor Kirby questioned Ms. Newton concerning owner consent.
It was explained that no property could be designated without owner consent.
The grant would amount to approximately $1,500.00 and
require a match of the same amount by the Village. However, the match
would be for in-kind services and no projected out-of-pocket costs would
be incurred by the Village. The grant would be used to hire a consultant
to prepare the application.
Mrs. Stofik moved to approve the Historic Preservation
Board's request to apply for a Federal Grant -In -Aid through the Bureau of
Historic Preservation for $1,500 grant to prepare a thematic resource
nomination for the National Register. Dr. Butler seconded the motion
and passed unanimously.
APPOINTMENT TO THE FINE ARTS COMMISSION.
Mr. Richard Osburn, Jr., and Mr.. Edgar Bundy applied for
the position previously held by Mr. Don Ink on the Fine Arts Commission.
On a vote by ballot of 3/2, Mr. Bundy was appointed to a term expiring
in March, 1988.
VILLAGE MANAGER'S REPORT.
(a) Financial Report -Mr. Forney elaborated on dining room sales,
promotional activities and net operating income at the Country Club.
(b) Membership Report -Mr. Forney reported that all persons who had not
renewed their memberships would be contacted.
(d) Investment Report.

Mayor Kirby expressed her appreciation to Mr. Jack Rengstl,
Chairman of the Mayor's Task Force and Ms. Lee Demerjian, Chairperson for
the Mayor's Ball for the outstanding job they performed with the Mayor's
Ball activities. She also thanked Dr. Butler and the Kiwanis Club for
cleaning the sidewalks. Mayor Kirby commended Jean Cuson, members of the
Fine Arts Commission and artists who participated in the Fine Arts Festival.
ANNOUNCEMENTS.
(a) "Wolfman Jack Night" at the Country Club, Friday,
November 22nd, 8:00 - Midnight.
(b) Special Council Workshop at the Community Center,
Monday, November 25th, 7:OOp.m.
(c) Thanksgiving Day Dinner at the Country Club,
Thursday, November 28th, 3:00 - 8:OOp.m.
COUNCIL COMMENTS.
Mrs. Stofik commented on the Third Annual Book Fair
sponsored by the Friends of the Library on November 9th and the Fine
Arts Festival.
Mayor Kirby requested that a resolution opposing legislation
to authorize Group Homes in municipalities without:complying with local
zoning ordinances be placed on the Agenda.
Mr. O'Connor moved to place the resolution on the agenda,
seconded by Mrs. Stofik and passed unanimously.
The Mayor commented on the Mobile Crime Watch Covered Dish
Dinner.
Mrs. Jensen commended a Miami Shores resident for being
awarded "Best Show" for a painting displayed at the Art Festival.
PUBLIC COMMENTS.
Mr. J.C. Brown, a member of Mobile Crime Watch Patrol,
requested a notice be put in the Village Hall news to caution people who
drive in Miami Shores Village alleys.
Mr. Robert Bell stated his concern over the condition of
the property located at 61 N.E. 96th Street.
Mr. Dick Bezdek, a member of Mobile Crime Patrol, commented
on houses not having numbers to identify their location.
Mr. Frank Wolland, an attorney representing Mr. Thomas Porter,
requested that Council hear an appeal from Mr. Porter to stay a fine levied
against him by the Code Enforcement Board.
After discussion, the Porter appeal failed to be placed on
the agenda for lack of a motion by Council.

Mr. Edgar Bundy commented on the designation criteria.

Mayor Kirby welcomed Mr. Steve Smith the new reporter
for the Miami Herald.
Clerk's Note: The Council adjourned without taking any action on
the Resolution concerning Group Homes.
