MIAMI SHORES VILLAGE -COUNCIL
August 20, 1985
The regular meeting of the Miami Shores Village Council was held on
August 20, 1985 at Village Hall, convening at 7:30p.m., with the following
members present:
Mayor Karen Kirby
Robert S. Butler, Jr.
Kevin P. O'Connor
Elspeth Jensen
Marty Stofik
Also Present: L.R. Forney, Jr., Village Manager
William F. Fann, Jr., Village Attorney
The meeting was opened with an invocation given by Dr. Harold Davenport
of the Miami Shores Community Church.
MINUTES.
(a) Council meeting of August 6, 1985 -Mrs. Stofik moved to approve the
minutes, seconded by Mr. O'Connor. Mrs. Jensen Asked that the minutes be
amended to reflect that she left the meeting at approximately 10:50p.m.
The motion passed unanimously.

ORDINANCE ON COMMERCIAL PICTURE REGULATION. Second and Final Reading.
Following a reading by title, Mrs. Stofik moved to adopt this ordinance
on second reading, seconded by Dr. Butler.
Mr. Forney recommended that the ordinance be amended to include specific
language which would require a license to be issued to the homeowner or resident,
not to the film company. Section 2, Paragraph G, of the ordinance would be
amended to add a new (1) and renumber the present (1-6) as 2-7. The new (1)
would read as follows:
(1) Licenses shall be issued to the property owner
or resident of the property where the film
activity is to take place.
Mr. O'Connor moved that the amendment as set forth be adopted, seconded
by Dr. Butler. The amendment passed 4/1 with Mrs. Jensen dissenting.

Following public and council comments concerning the starting time
of filming activities, the ordinance passed on second reading by a 3/2 vote
with Mayor Kirby and Mrs. Jensen dissenting. The ordinance being entitled:
ORDINANCE NO. 481-85
AN ORDINANCE AMENDING SECTION 19, OF CHAPTER 13,
OF THE MIAMI SHORES VILLAGE CODE OF ORDINANCES,
AND THE SCHEDULE OF REGULATIONS, BEING A PART OF
ARTICLE IV OF THE MIAMI SHORES VILLAGE ORDINANCE
NO. 270; ENLARGING PERMITTED USES IN B-1, B-2, C
AND 0 DISTRICTS, TO INCLUDE LIMITED COMMERCIAL
PICTURE ORIGINATION OF TELEVISION OR FILM, INCLUD-
ING BOTH MOTION AND STILL PICTURES; PROVIDING TIME
RESTRICTIONS FOR AUTHORIZED ACTIVITY; PROVIDING FOR
REQUIREMENT OF LICENSES AND REQUIRED CONTENTS OF
APPLICATIONS THEREFOR; PROVIDING EFFECTIVE DATE.
ORDINANCE ON UTILITY TAX INCREASE. Second and Final Reading.
Mr. O'Connor moved to adopt this ordinance on second reading, seconded
by Dr. Butler. The ordinance was read by title and passed unanimously, said
being:
ORDINANCE NO. 482-85
AN ORDINANCE AMENDING SCHEDULE A, SECTION 20-20,
ARTICLE II, CODE OF ORDINANCES, MIAMI SHORES
VILLAGE, FLORIDA; INCREASING EXCISE TAXES DUE ON
PURCHASES.
ORDINANCE INCREASING WASTE FEES. Second and Final Reading.
Mrs. Stofik made a motion to adopt this ordinance on second reading,
seconded by Dr. Butler. Following a reading by title, the ordinance passed
unanimously, said being entitled:

AN ORDINANCE AMENDING SECTION 10-16, 10-17, AND
10-18 (A) OF THE MIAMI SHORES VILLAGE CODE OF
ORDINANCES, MIAMI SHORES VILLAGE, FLORIDA; IN-
CREASING WASTE FEES, PROVIDING FOR SEMI-ANNUAL
PAYMENTS; PROVIDING EFFECTIVE DATE.
ORDINANCE ON OCCUPATIONAL LICENSE TAX. Second and Final Reading.
The ordinance was read by title. Mrs. Jensen moved to adopt the
ordinance on second reading, seconded by Mr. O'Connor and passed unanimously.
The ordinance being entitled:

ORDINANCE NO. 484-85
AN ORDINANCE AMENDING PARAGRAPH (F), SECTION
13-19, CODE OF ORDINANCES, MIAMI SHORES VILLAGE,
FLORIDA; EXPANDING THE NUMBER OF INSURANCE COM-
PANIES THAT OBTAIN OCCUPATIONAL LICENSES.
ORDINANCE AUTHORIZING MULTIPLE TRUSTEES AND TRUST
AGREEMENTS FOR PENSION BOARDS. Second and Final Reading.
Following a reading by title, Mr. O'Connor moved to adopt the ordinance
on second reading, seconded by Mrs. Stofik and passed unanimously. The en-
titlement of the ordinance reads as follows:
ORDINANCE NO. 485-85
AN ORDINANCE AMENDING PARAGRAPH (2) OF SECTION
17-21, AND SECTION 17-23 OF THE CODE OF ORDI-
NANCES OF MIAMI SHORES VILLAGE, FLORIDA; AUTHOR-
IZING MULTIPLE TRUSTEES AND TRUST AGREEMENTS;
PROVIDING EFFECTIVE DATE.
ORDINANCE ON BUILDING & ZONING DEPARTMENT FEES. First Reading.
The ordinance was read by title. Mrs. Jensen moved to adopt the
ordinance on first reading, seconded by Dr. Butler.
Mr. Forney explained that this ordinance increased Building & Zoning
Department fees which the Council had approved at the budget workshop. The
ordinance passed unanimously.
AWARD OF BID FOR PURCHASE OF PORTABLE GENERATOR.
In a report to Council, Mr. Forney recommended purchasing a 35 KW
Portable Standby Electric Power Generator from Casper. Engineering Corporation
for $7,830, the low bid. This generator would replace an existing older gen-
erator and be primarily used to provide power during and following a hurricane.
Mr. O'Connor moved to purchase the 35 KW Portable Standby Electric Power
Generator for $7,830, seconded by Dr. Butler and passed unanimously.
AWARD OF BID FOR CONSTRUCTION OF STEEL BUILDING FOR PUBLIC WORKS COMPOUND.
Mr. Forney recommended that Council accept the low bid of $48,950
from Andy Construction Manufacturing Corporation to construct a new steel
building in the Public Works yard. The building would replace an old wooden
structure which is unsafe. It would be utilized by the Public Works Depart-
ment and the Pblibe Department to support their range activities.
Mr. O'Connor moved to authorize the construction of a new steel building
for $48,950 by Andy Construction Manufacturing Corporation, seconded by
Dr. Butler and passed unanimously.

VILLAGE MANAGER'S REPORT.
(a) Vacancies on various boards.
Mr. Forney presented Council with a list of 23 vacancies on the
various Village boards. The vacancies will be advertised in the
Village Hall News with appointments being made at the Council
meeting of September 17, 1985.
(b) Country Club Financial Report.
(c) Country Club Membership Report.
(d) Investment Report.
Mr. Forney explained that the Neighbors section of the Miami Herald
had begun a weekly report on the schedule of meetings in the Village.
The Village Manager reported that a tentative agreement had been reached
with the Federation of Public Employees for next year's contract and will be
voted on for ratification by the membership on August 22, 1985.
ANNOUNCEMENTS.
(a) Public hearing on tentative budget and proposed millage
at the Community Center, ;9617 Park Drive, September 5th
at 7:30p.m.
(b) Adoption of final budget and setting of final millage,
September 11th, 7:30p.m. at the Community Center.
PUBLIC COMMENTS.
Mr. Frank LuBien announced that the races sponsored by the Pelican
Harbor Yacht Club to benefit Muscular Dystrophy were a success and commended
Mayor Kirby for attending and supporting the event.
Mr. Dennis O'Kain commented on Crime Prevention through education.
COUNCIL COMMENTS. -
Mrs. Stofik announced that the Miami Shores Theatre had been featured
in a recent article in Rolling Stone magazine.
Mr. O'Connor commented on the positive impact the new Parking Meter/
Monitor was having on the downtown area.
Mrs. Jensen commented on flyers being distributed in the area soliciting
residents to sell their homes.
