05-07-1985 Regular MeetingREGULAR MEETING MIAMI SHORES VILLAGE COUNCIL May 7, 1985 The regular meeting of the Miami Shores Village Council was held on May 7, 1985, at the Village Hall, commencing at 7:30p.m., with the following members present: Mayor Karen Kirby Robert S. Butler, Jr. Kevin O'Connor Elspeth Jensen Marty Stofik Absent: None Also Present: L.R. Forney, Jr., Village Manager William F. Fann, Jr., Village Attorney The meeting was opened with an invocation given by Reverend Matthew Kerestes of the Advent Lutheran Church, followed by the Pledge of Allegiance. A Proclamation declaring May, 1985 as Mental Health Month in Miami Shores Village was presented by Mayor Kirby to Mr. Bob Ward, Executive Director of North Miami Mental Health Center. MINUTES. (a) Council Meeting of April 16, 1985 - approved as written by a motion made by Mr. O'Connor, seconded by Mrs. Stofik and passed unanimously. (b) Special Council Meeting of April 26, 1985 - approved as written by a motion made by Mrs. Stofik, seconded by Mr. O'Connor and passed unanimously. Receipt acknowledged: c Recreation Advisory Committee 4/8/85. (d Downtown Revitalization Board 4/11/85, 3/28/85, & 2/6/85. (e) Country Club Advisory Board 4/18/85. - Mr. O'Connor commented on the Board considering non -agenda items without giving prior notification to the general public. Mr. Fann recommended that the Board consider only items on the agenda. Mrs. Stofik requested that motions be cited in the minutes. (f) Planning & Zoning Board 4/25/85. (g) Historic Preservation 4/26/85. (h) Code Enforcement Board 5/2/85. Mr. O'Connor and Dr. Butler asked that the discussion of the workshop be recorded in writing. -2 - PLANNING BOARD APPROVALS/DENIALS, Greenberg Appeal, Item 5 of meeting held April 11,1985. This appeal was deferred to the Council meeting of May 21, 1985 because the Greenbergs were unable to attend. ORDINANCE AMENDING SUB -PARAGRAPH b) 2) OF SECTION 504 OF ARTICLE V OF ORDINANCE 270 REGARDING SIGNS. First Reading. Mrs. Stofik moved to adopt the ordinance on first reading. The motion was seconded by Dr. Butler. In the discussion that followed, Dr. Butler questioned Mr. Stobs, Chairman of the Planning & Zoning Board, concerning the size and distance of the signs from the sidewalks and public access. Mr. Stobs stated the basic change in the Ordinance pertained to the place- ment of the signs. The amended Ordinance would require the signs be placed parallel rather than perpendicular to the street. Mrs. Jensen expressed concern over the size of the signs being too large. Mrs. Stofik asked if this Ordinance could be enforced. Mr. Forney responded that the Ordinance would be enforced. Mrs. Stofik moved to amend the Ordinance to become effective ninety (90) days from the date of adoption. Dr. Butler seconded the motion which passed unanimously. Dr. Butler moved to amend the Ordinance to alter the five (5) foot setback from the property line to be increased to ten (10) feet from the property line in both portions of Section 2 of the Ordinance. Mrs. Jensen seconded the motion. The amended Ordinance passed 4/1 on first reading with Mayor Kirby dissenting. Mayor Kirby objected to the Ordinance because it failed to place tighter restrictions on the size of the signs. ORDINANCE ON EMERGENCY WATER MANAGEMENT. Second and Final Reading. Mr. O'Connor moved to adopt the Ordinance as written, seconded by Mrs. Stofik. The motion passed unanimously, said Ordinance being: ORDINANCE NO. 479-85 AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA PROVIDING FOR LOCAL IMPLEMENTATION OF THE WATER SHORTAGE PLAN OF THE SOUTH FLORIDA WATER MANAGE- MENT DISTRICT; PROVIDING DEFINITIONS; PROVIDING FOR ENFORCEMENT AND PENALTIES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. -3 - REVISIONS TO RECREATION COMPREHENSIVE PLAN. In a report to Council, Mr. Forney requested that the following two revisions to the Comprehensive Plan be approved: 1. To allow for free play on the football field "by permit from the Recreation Director". (Page 11) 2. To close the Community Center throughout the year on Saturday mornings. The Center would remain open on Saturdays for the ceramic program, the gymnastics team and special events as needed. (Page 16) This measure which was endorsed by the Recreation Advisory Committee and would save $643.50 in staffing costs and an undetermined amount in elec- tricity. Dr. Butler moved to accept the changes to the Comprehensive Plan of the Recreation Department as outlined on pages 11 & 16 of the plan. Mrs. Stofik seconded the motion. The motion passed unanimously. VILLAGE MANAGER'S REPORT. (a) Mr. Forney announced that a Council Workshop on Commercial Filming would be held on Tuesday, May 14th at 7:30 p.m. at Village Hall. (b) The FY '86 budget calendar was explained by Mr. Forney. ANNOUNCEMENTS. (a) Mother's Day at the Country Club, 5/12/85. (b) Miami Shores Heritage Council, Community Center, 5/22/85. (c) Healthwise Day, Community Center, 5/23/85, 10a.m.-4p.m. (d) Memorial Day Observance, Memorial Park, 5/27/85 at 10a.m. COUNCIL COMMENTS. Mr. O'Connor discussed three bills now before the State Legislature regarding Binding Arbitration, State Mandated Zoning for Group Homes and Utility Taxes on Telephone Service. He urged citizens to contact their representatives about these issues. Mayor Kirby expanded upon the importance of the State Mandated Zoning for Group Homes bill, and reported she had attended meetings of the Dade League of Cities and Council of Mayors. Dr. Butler also commented on the bilis. Mrs. Jensen commented on the issue of a magnet school at Horace Mann. -4 - PUBLIC COMMENTS. Joe Dugoni, Business Manager of Miami Shores Presbyterian Church, inquired on the possibility of the Village sharing the cost of lighting the Church parking lot.
