12-18-1984 Regular Meeting12/18/85 REGULAR"MEETING MIAMI SHORES VILLAGE COUNCIL December 18, 1984 The regular meeting of the Miami Shores Village Council was held on December 18, 1984, at the Village Hall, commencing at 7:30 p.m., with the following Council members present: Mayor Kevin O'Connor Elspeth Jensen Robert J. Lodge Herbert Spahn, Jr. Terry Cuson Absent: None Also present: L. R. Forney, Jr., Village Manager William F. Fann, Jr., Village Attorney The meeting was opened with an invocation given by Mayor O'Connor, followed by the Pledge of Allegiance. PRESENTATION - Ms. Marty Stofik, Chairman of the Historic Preservation Board, presented Mayor O'Connor, on behalf of the Village, with a bronze plaque commemorating the site of the Miami Shores golf course. MINUTES. (a) Council meeting of 12/4/84 - approved as written by motion made by Mr. Cuson, seconded by Mr. Spahn and passed unanimously. Receipt acknowledged: (b) Code Enforcement Board 12/6/84. (c) Fine Arts Commission 11/5/84. (d) Beautification Committee 12/3/84. (e) Planning & Zoning Board 12/13/84. PLANNING BOARD APPROVALS/DENIALS - Meeting of 12/13/84, Item No. 2 Mr. Stan Taylor, 10611 N. E. 10th Place, was present to appeal the Planning Board's denial of a variance for a 6 ft. fence to enclose the Miami Shores Police dog which is in his care. Mr. Lodge moved that the Council overturn the decision of the Planning & Zoning Board and grant the variance based on the conditions of Section 702 of the Zoning Ordinance. Mr. Spahn asked that the variance be made conditionally as long as Officer Taylor lives there. Ms. Agnes Conlon, a dog lover, spoke on behalf of the dog and the Police Officer. After discussion the original motion passed unanimously. COMMUNITY CENTER ROOF. In a report to Council Mr. Forney explained the 12/18/84 -2- necessity for replacing the cedar shingle mansard roof on the Community Center. After bidding the job on two occasions his recommendation was to use tile as a replace- ment roof covering and accept the low bid of Carruth for replacement tile at a cost of $27,970.00. Mr. Forney further reported that the budget estimate for this job was $14,000, $6,300.00 could be taken from the girls restroom budget, deferring that project until another year, and the remainder - $7,670.00 could be taken from the Village contingency fund. Mr. Lodge moved to approve the Manager's recommendation to award the bid to Carruth in the amount of $27,970.00 for a tile roof with the funding as set forth. The motion was seconded by Mr. Spahn. Mr. Cuson wanted the girls' bathroom money to be left in the budget and suggested that extra money could be made available by deferring the hiring of another Athletic Director. After some discussion a substitute motion was made by Mr. Spahn to accept the bid as proposed but leave the $6300.00 in the budget for the girls restroom and take $13,700 from the contingency fund. This motion was seconded by Mr. Cuson and passed unanimously. RECOMMENDATION ON CITIZEN COMPLAINT. In regard to Mr. Ken Cutchens' complaint about Barry University running a public cafeteria Mr. Forney reported that the cafeteria is a permitted use in a college zone and that the University is providing a service to our senior citizens. He recommended that the Mayor send a letter of appreciation to Sister Jeanne for making this offer to her neighbors in the Shores. Mr. Cuson moved that a letter be sent to the President of Barry by the Mayor with a. copy to Mr. Cutchens. The motion was seconded by Mr. Spahn and passed unanimously. VILLAGE MANAGER'S REPORT. Mr. Forney reported that a letter had been received from Storer Cable notifying subscribers of a rate increase effective January 1, 1985, for use of more than one cable outlet, which is contrary to our ordinance requiring a 60 day notice. He stated also that Federal law has brought about new regulations and he will look into how our ordinance needs to be changed to comply. Mr. Forney also announced that there is a vacancy on the Country Club Advisory Board by the resignation of Stanley Palmer. We will advertise for a replacement. (a) Membership report - Country Club. (b) Financial reports - Country Club. (c) Investment report. 12/18/84 -3- ANNOUNCEMENTS. (a) Open House at the Library scheduled for Dec. 21, has been cancelled because of redecorating. The children's party for the same day is also cancelled. (b) New Year's Eve at the Club - reserve now. (c) The next Council meeting will be held on Tuesday, January 15th at the Community Center.
