06-05-1984 Regular MeetingREGULAR MEETING MIAMI SHORES VILLAGE COUNCIL June 5, 1984 The regular meeting of the Miami Shores Village Council was held on June 5, 1984, at the Village Hall, commencing at 7:30 p.m., with the following Council members present: Mayor Kevin O'Connor Elspeth Jensen Robert J. Lodge Terry Cuson Herbert Spahn, Jr. Also present: Chief John Fletcher, acting Village Manager William F. Fann, Jr., Village Attorney The meeting was opened with an invocation given by Father Clifford R. Horvath, of the Episcopal Church of the Resurrection, followed by the Pledge of Allegiance. Mayor O'Connor praised the coordination of effort of the Miami Shores Baseball team sponsors for the success of the Recreation Department baseball program. In recognition of their contributions and efforts, Mayor O'Connor presented a baseball uniform T shirt and hat to Bob Orlando, Vice President of Chase Federal. Dr. Gil White and OK Doyle, representing the Miami Shores Optimist, and Brian O'Connor , a baseball team member, received the T shirt and hat for the Optimist Club. Dr. Gil White presented Mayor O'Connor a check in the amount of $2,000.00 for the purchase of baseball uniforms, for the Miami Shores Village Recreation Department. The success of the Miami Shores 10K Heritage Run was announced by Mayor O'Connor. Father Horvath noted the youngest finisher was 8 yrs. old, the eldest finisher 82 nears .young. Father Horvath presented T shirts commemo- rating the event, to the Council. MINUTES: (a) Mr. Cuson made a request for a copy of the State Of The Village address by Mayor O'Connor. Chief Fletcher was requested to make these copies available. Mr. Cuson then moved to approve, as written, the minutes of the May 15, 1984 meeting, seconded by Mrs. Jensen, and carried unanimously. Receipt was acknowledged of the following: (b) Fine Arts Commission, 5/7/84 (c) Fine Arts Commission, 5/14/84 (d) Recreation Advisory Committee, 5/14/84 (e) Code Enforcement Board, 5/16/84 (f) Planning and Zoning Board, 5/24/84 Mr. Cuson asked for clarification of Item #2, Request for Approval of Plans for Mooring Pilings. Mr. Robert Stobs, II, Chairman of the Planning & Zoning Board explained that this request was referred to the Corp of Engineers and DERM, for them to address the issue, they in turn referred it back to Planning & Zoning. Mr. Stobs stated that he had visited the neighborhood and encountered no objection and that the Planning & Zoning Board granted COUNCIL -2- June 5, 1984 approval, strickly on the basis of harmony. He further noted that any limitations or restrictions the Board might impose would be arbitrary. PLANNING BOARD APPROVALS/DENIALS (a) Meeting of 5/24/84, Item #4, variance requested for the extensive use of wood trim on the house of Mr. Crumpton. Mr. LuBien, Director of Building & Zoning reported that Mr. Crumpton was advised that his presence is necessary for his request to be discussed. However, in his absence Mr. LuBien recommended the request be deferred to the next meeting to give Mr. Crumpton the opportunity to by heard. Mr. Cuson moved to table the issue until Mr. Crumpton can be present, seconded by Mrs. Jensen, and passed unanimously. RECOMMENDATION BY RECREATION ADVISORY COMMITTEE CONCERNING GUEST USE OF TENNIS CENTER Mr. Varney, Recreation Department Director, presented a memorandum outlining the issue. Mr. Cuson made a motion to accept the Committee's recommendation to permit guests of residents to utilize the Tennis Center. The motion was seconded by Mr. Spahn. Mrs. Jensen was opposed to non residents using the courts, and being on Miami Shores Tennis Team. Mr. Varney countered,non residents on the teams are in the minority and further the Miami Shores Village does not financially support the Tennis Team. Mr. Dugoni stated that this issue has been debated extensively, and it has been decided that Miami Shores residents must remain with their guests. Mr. Theobold, Tennis Center. Pro, assured Council that he feels he can adequately control the situation, also that he recommends the change. The motion passed by a 4/1 vote, with Mrs. Jensen dissenting. HURRICANE SHUTTERS FOR POLICE DEPARTMENT Director of Public Works, Tom Benton presented a memorandum requesting hurricane shutters for the Police Department. In response to Mr. Cuson's query regarding funding, Mr. Benton stated the funds will be expended from the Public Works Budget, and the Finance Director approves this allocation. Mr. Cuson moved to accept the low bid by SeaView Industries, Inc, at a cost of $4,064.00, seconded by Mr. Lodge, and carried unanimously. VILLAGE MANAGER'S REPORT Chief John Fletcher, acting inthe absence of Mr. Forney reported on a Public Hearing to be held by the Board of County Commissioners, in it's meeting room on the second floor of the Dade County Court- house in Miami, June 19, 1984 at 9:00 a.m.. Re: ORDINANCE REGULATING USE OF ALCOHOLIC BEVERAGES AND DRUGS AT "OPEN HOUSE PARTIES": PROVIDING DEFINITIONS: PROVIDING PENALTIES: PROVIDING SEVERABILITY, INCLUSION IN CODE AND EFFECTIVE DATE. All members were urged to attend, discuss any questions on the issue with Mr. Ginsburg, County Attorney. COUNCI L -3- June 5, 1984 ANNOUNCEMENTS (a) Country Club -Early Bird Specials, 5-7p.m. during the month of June. If successful the program may be considered for future use. In response to requests, Mayor O'Connor requested Chief Fletcher speak to Mr. Herron, concerning the matter of advertising this program, and perhaps undertake a mailing, providing funds are available. (b) Country Club -4th of July Buffet, 5:30-8:00 p.m., $6.95 per person, children under 12 half price. Fireworks display will be at dusk. It was especially noted that this event is open to all residents of Miami Shores, and not for Club Members only. COUNCIL COMMENTS Mr. Spahn called attention to a flood problem in the mens locker room at the Country Club. Mayor O'Connor advised Chief Fletcher to make notes on this problem. Mr. Cuson announced that the Intramural Baseball play-off at the Recreation Center is in progress. He wished the Miami Shores Soccer Team well on their trip to Germany. The Lowe Gallery Tour, sponsored by the Fine Arts Commission, was a tremendous success. Congraulations to all school graduates. Mr. Cuson also expressed opposition to a cat ordinance, fearing that ridding the Village of cats would then create a rodent problem. Mayor O'Connor read a letter from the Miami Shores Chamber of Commerce directed to members of Council The Chamber requests Council to take action, as soon as possible on (a) rigid enforcement of 35 MPH speed limit and (b) take whatever steps necessary to reduce speed limit to 30 MPH in residential neighborhoods. The letter was turned over to Chief Fletcher for review. Mr. Lodge suggested the letter be discussed at the next meeting along with the question of reducing the 30 MPH speed zone on residential streets. PUBLIC COMMENTS Mr. Fabian, Marco Galleries, outlined a problem he is having with the Obenour Roofing Co., who re -roofed his home. He hoped Council would provide direction for recourse. Mayor O'Connor advised Mr. Fabian that this is not a Council issue, and he would advise Civil Action, and the services of an attorney. Mr. Cuson suggested that he perhaps might file a complaint with the Better Business Bureau for mediation.
