09-06-1983 Regular MeetingREGULAR MEETING MIAMI SHORES VILLAGE COUNCIL September 6, 1983 The regular meeting of the Miami Shores Village Council was held on September 6, 1983, at the Village Hall, commencing at 7:30 p.m., with the following Council members present: Mayor Kevin O'Connor Elspeth Jensen Robert J. Lodge Herbert Spahn, Jr. Terry Cuson Absent: None Also present: L. R. Forney, Jr., Village Manager William F. Fann, Jr. The meeting was opened with an invocation given by Rev. Elwood Lodge of the Miami Shores Baptist Church, followed by the Pledge of Allegiance. MINUTES: (a) Council meeting 8/16/83 - approved by motion made by Mr. Lodge, seconded by Mr. Cuson and passed unanimously. (b) Budget workshop 8/8/83 - receipt acknowledged. (c) Recreation Advisory Board 8/15/83 - " Mrs. Jensen asked that names of absent members be listed. (d) Planning & Zoning Board 8/25/83 - receipt acknowledged. (e) Code Enforcement Board 9/1/83 - " PLANNING BOARD APPROVALS/DENIALS: Meeting of 8/25/83, Item 3. Plans for an addition and alterations to John Militana's building at 8900 Biscayne Blvd., were approved by the Board with a variance to recognize an existing encroachment of the southeast corner of the building into the required DOT 25 ft. setback. Mr. Robert Stobs, Chairman of the Board, reported that the variance was approved on the peculiar and unusual position of the lot. Mr. Lodge moved that the action of the Board be upheld. The motion was seconded by Mrs. Jensen and passed unanimously. APPROVAL OF NEW PAY AND CLASSIFICATION PLAN. With a report to Council Mr. Forney attached a Pay and Classification study prepared by Long Associates, in which they recommend elimination of the current "step" system, replacing it with pay "ranges", as well as 9/6/83 -2- certain changes in entry level and top -out pay. Mr. Forney asked for Council approval of plan details on Pages 10 through 12 and Tables II and III. Mrs. Carolyn Long of Long Associates, was present to explain how the survey was made and answer any questions. Mr. Forney added that the FPE had settled at 3% plus the new pay plan. Mr. Spahn felt this should be reviewed at a workshop and moved to table action on the plan pending the scheduling of a workshop. The motion was seconded by Mr. Cuson and passed 4/1 with the Mr. Lodge dissenting. Mr. Forney asked if he could go ahead with the 3% as of October 1 and the Council agreed that it had been approved. The WORKSHOP was scheduled for Tuesday, September 27, 1983, at 7:30 p.m. APPROVAL OF LAND SURVEY ON 5.42 ACRES. Pursuant to recent Council action Mr. Forney had secured an estimate from the firm of Donald W. McIntosh & Associates for a survey of the 5.42 acres as itemized in the proposal letter of August 23, 1983, for a sum of $1250.00. Mr. Cuson argued that following a change in the Comprehensive Plan this was the direct succession toward the sale of the property. Mr. Spahn was of the opinion that this would answer a lot of questions as to the optimum use of the land. A motion was made by Mr. Lodge for approval of $1250.00 to be taken from the contingency fund for the McIntosh survey on the 5.42 acres. The motion was seconded by Mr. Spahn and passed 3/2 with Mr. Cuson and Mrs. Jensen dissenting. BID RECOMMENDATION - FUEL CONTROL SYSTEM FOR PUBLIC WORKS. In a report to Council Mr. Forney recommended acceptance of the low bid of Cherokee Equipment Sales & Service Company in the amount of $26,827.28. Mr. Lodge moved that the bid be awarded to the Cherokee company in the amount of $26,827.28. The motion was seconded by Mr. Cuson and passed unanimously. PROPOSED AMENDMENT TO SECTION 2-22, VILLAGE CODE. In a report to Council Mr. Forney recommended amending the Village Code, Section 2-22, concerning Code Enforcement Board members, to pro'vfde for removal of a Board member and that this provision be incorporated for all Boards. An ordinance was presented for first reading that amends Section 2-22, as proposed by the Village Manager. Mr. Lodge moved approval plus similiar action for all other 9/6/83 -3- Boards. Mayor O'Connor turned the gavel over to Mrs. Jensen and seconded the motion. After discussion by Council members and Mr. Ken Cutchens, CEB member, who questioned the legality of the action, the vote was called with the following results: Mr. Spahn Yes Mr. Lodge Yes Mayor O'Connor Yes Mr. Cuson Yes Mrs. Jensen No The motion to approve the ordinance on first reading was passed 4/1. POLL COUNCIL ON ATTENDANCE AT METRO RAIL DEMONSTRATION A letter was received from Mr. John Greene of the County Manager's office, inviting the Council to enjoy a demonstra- tion ride on METRORAIL on September 17, 1983. No Council members were free to make the trip. VILLAGE MANAGER'S REPORT. (a) Mr. Forney reported that the tree planting on N. E. 6th Avenue was completed. ANNOUNCEMENTS: (a) 9/8/83, Thurs., first public hearing on FY 84 budget, Community Center, 7:30 p.m. (b) 9/14/83, Wed., final hearing on FY 84 budget, Village Hall, 7:30 p.m. (c) 9/24/83, UNITY DAY, beginning at 10:00 a.m. (d) 9/24/83, OPEN HOUSE, Police Station 12-3 p.m. (e) 9/30/83, Dues party, C.C., free buffet & drinks for paid-up members. COUNCIL COMMENTS: Mrs. Jensen thanked everyone who had inquired about her husband, and reported that he is now recuperating at home. Mr. Cuson asked everyone to rethink about statements made against the Property Owners Association in that it was composed of many good hardworking citizens and the association should not be chastised for the actions of a few members. Mr. Cuson added that it appears that the Council is working on a property sale (of the 5.42 acres). Mayor O'Connor stated in regard to a former question on rebuttal that we conduct our debates so that there will be Council comment, public comment, Council response and a -4 - vote and he wanted to say publicly that that has historically been the position of this Council and will remain so as long as he has the chair. PUBLIC COMMENTS: Mr. Ed Abdella, 9304 N. E. 9th P1., complained about the number of dogs running loose in the Village. Mr. Spahn suggested that the Animal Control Office be informed of this problem.
