MIAMI SHORES VILLAGE COUNCIL
December 10, 1982
A special meeting of the Miami Shores Village Council was
held on December 10, 1982, 5:00 p.m., at the Village Hall, with the
following Council members present:
Mayor Robert J. Lodge
Herbert Spahn, Jr.
Donald W. McIntosh
Henry A. Everett (arrived late)
Absent: Mrs. Elspeth Jensen
Also present: L. R. Forney, Village Manager
William F. Fann, Jr., Village Attorney
This meeting was called for the purpose of reconsidering the
contract on the men's lockerroom at the Country Club. Representa-
tives of the C.N.H. Construction Company and the J. L. Deveras
Company were present, having received notification that the award
was to be reconsidered.
The discussion concerned the C.N.H. bid which was accepted and/or
negotiated as low bid, although it did not meet specifications.
Mr. Forney asked the Council to consider his original
recommendation and award the bid to J. L. Deveras, with a performance
bond, as the other bid had not included paving and painting of all
lockers. Mr. Fann, Village Attorney, advised that this was essentially
correct as the C.N.H. bid should not have been considered.
Mr. Spahn moved to rescind the action taken Tuesday night
awarding the bid to the C.N.H. Construction Company. The motion was
seconded by Mr. McIntosh.
Mr. Robert Hubbard of C.N.H., argued that there was no bid bond
required, no form of contract, no time of completion, no allowances
established and that AIA contract procedures were not followed.
The motion to rescind the previous action was passed unanimously.
Mr. McIntosh agreed that a performance bond should be considered.
Mr. Robert Klein of J. L. Deveras, stated that his company
was in fact, low bidder with the items they had included.
Mr. Spahn thought this should be declared as an emergency
situation and that the Council authorize the Village Manager to review

the bids and award the contract to the low bidder, which he so moved.
The motion was seconded by Mr. McIntosh and passed unanimously.
The meeting adjourned at 5:40 p.m.
