MIAMI SHORES VILLAGE COUNCIL
September 29, 1981
A special meeting of the Miami Shores Village Council was held on
September 29, 1981, 7:30 p.m., at the Village Hall, with the following
Council members present:
Mayor Robert J. Lodge
Herbert Spahn, Jr.
Donald W. McIntosh
Henry A. Everett
Elspeth Jensen
Absent: None
Mr. 0. Sam Ackley, Village Manager, and Mr. William F. Fann, Jr.,
Village Attorney, were also present, as well as the following insurance
representatives: Jay Leigh and Robert J. Meyers with Risk Management
Services under the Florida League of Cities, and Steve Christie and Ted Brach
with Aetna.
This meeting was called for the purpose of final discussion and
placement of the Village liability insurance for the fiscal year 1981-82.
The agenda included:
1. Discussion of Motor Carrier Act of 1980. The Village Attorney
advised that this act did not pertain to Village vehicles.
2. Public Officials Liability insurance.
This coverage had been requested but was not part of the current
coverage. By a poll of Council members it was unanimously agreed
to take this policy if it could be bound by October 1, which
Mr. Christie stated, could be done. The League representative,
Jay Leigh, reported it was already part of their coverage and
would be bound at the same time (10/1/81), if approved.

3. Action placing liability insurance for 1981-82.
Mr. McIntosh stated that although a majority of Council agreed
to the 100/200,000 coverage, he has great concern with that
immunity level because of the Country Club and asked if this
coverage could be broken out. Mr. McIntosh stated he wanted
to go on record as being against the 100/200,000 level if it
pertains to the entire insurance package of the Country Club.
(The liability insurance is carried as a package on all facilities.)
Mr. Fann stated that the sovereign immunity law covers the
Country Club.
A revised bid proposal had been received at this meeting from
Steve Christie, Aetna, representative, with the total difference
in the two plans being narrowed down to $5,945.00.
Mr. Ackley summarized the two proposals, pointing out that the
principal weakness in the Fla. League coverage was the absence of riot insur-
ance and a specific contractual endorsement. However, it was noted that the
League's Public Officials Liability had a wider coverage than Aetna's. Aetna
provided riot coverage and a blanket contractual endorsement.
Mr. Spahn moved that the Village accept the Aetna proposal at the
100/200,000 immunity level, as they have served us for four years, the
difference between the policies is minimal, and the League has only three years'
experience. The motion was seconded by Mr. McIntosh and passed 4/1 with
Mrs. Jensen dissenting, stating that she is in favor of self-insurance.
The meeting adjourned at 8:40 p.m.
