08-21-1979 Regular Meeting REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL August 21, 1979 , The regular meeting of the Miami Shores Village Council was held on August 21, 1979, 7:30 p.m. , at the Village Hall , with the following Councilmen present: Mayor Henry A. Everett Donald W. McIntosh Herbert Spahn, Jr. Absent: Ralph E. Bowen Mr. 0. Sam Ackley, Village Manager, and Mr. William F. Fann, Jr. , Village Attorney, were also present. The meeting was opened with an invocation given by Msgr. Fogarty of St. Rose of Lima Catholic Church, followed by the Pledge of Allegiance. Minutes of the meeting of August 7, 1979, were approved as written by motion made by Mr. McIntosh, seconded by Mr. Spahn and carried. Resignation of Councilman Joseph P. Farina. A letter of resignation had been received from Joseph P. Farina following his appointment to the Dade County Judiciary as a County Court Judge. Mr. McIntosh moved that the letter of resignation be accepted with regret as Mr. Farina will be missed by the Council and residents. The motion was seconded by Mr. Spahn and passed unanimously. Mayor Everett explained that the Council must appoint another Council member and asked any citizen who is interested in serving to submit a resume to the Village Clerk and it will be forwarded to Council . The Mayor also asked for a Council work shop to be held on September 11, 1979, to review these resumes and talk to the candidates. Mr. McIntosh moved approval of a work shop to be held on September 11th for the purpose of interviewing the interested aspirants for the position of Councilman or Councilwomen, and that the Council 8/21/79 -2- will take action subsequent to that time or later. The motion was seconded by Mr. Spahn and passed unanimously. Mr. Frank Miller, 890 N. E. 100th St. , - tennis courts. Mr. Miller claimed that the Village extended the Country Club tennis courts 11 ft. to the east, cutting off his view, and that he had not been notified that this construction was to take place. Mr. Miller asked the Council to direct the Attorney to draw up a resolution agreeing not to extend the courts any farther to the east, that there will never be night lighting and that when the Council does anything in the way of a public improvement, that the people within 500 ft. should be notified. He also added that there should be water on the outside of the wall to keep the plants alive. Mayor Everett stated that he felt this Council has no right to bind any future Council to these stipulations. Village Attorney Fann advised that it is a matter of policy but whatever is done it would have no effect on future Councils. He suggested that Council adopt a resolution requiri:ng written notification of public improvements or projects (other than maintenance) . Mr. McIntosh questioned the feasibility of any further expansion of the courts and added that there are no plans for lighting the courts. He stated that there have been many resolutions that have been amended or over-ruled and thAt he felt this Council could pass something to indicate its intention, along the lines requested. Mr. McIntosh then moved to table action on this request until we have a full 5 member Council , some time in the next month. The motion was seconded by Mr. Spahn and passed unanimously. Ordinance on new occupational licenses. Following first reading by title only and discussion of revised fees based on a 33% increase, Mr. McIntosh moved that it be passed on first reading. The motion was seconded by Mr. Spahn and passed unanimously. 8/21/79 -3- Complimentary memberships to Country Club. Mr. Ackley asked for approval of three memberships for the Presbyterian Church, membership for the wife of our former Village Attorney, and membership for our former tennis pro. Mr. McIntosh moved that action on these memberships be tabled at this time because of the ambiguities in the resolution. The motion was seconded by Mr. Spahn and passed unanimously. Summer program recreation fees for 1980. Mr. Ackley presented a list of new fees for organized sports, the summer program for 1980, as well as new fees for the swimming pool , which had been prepared by the Recreation Director. Mr. Ackley recommended that some action be taken on these fees effective October 1st. Mr. McIntosh asked if these fees were not tied in with the budget and since they are, it was suggested that these fees be read into the record of the public hearing and that action will be taken with approval of the budget. Village Manager's report. (a) Crime statistics - A Florida crime statistics report for the first six months of 1979 published by the State Department of Law Enforcement and a six months' report prepared by Chief Fletcher, were discussed. (b) Street lighting on State roadways - A letter was received from the State Department of Transportation concerning street light costs on N. E. 6th Ave. and N.E./N.W. 103rd St. , indicating that the State will assume these costs when the streets are officially transferred to the State, or if not because of priorities, the County will pay the lighting costs. (c) Country Club roof - Mr. Ackley reported on some of the structural problems uncovered by the mechanical engineer who has been coordinating the roof repair with air conditioning replacement. (d) Seawall - A report with specifications for repair of the seawall was submitted by Summit Engineering. Mr. Ackley stated that the next step would be to send out bids following Planning Board review. It was suggested that a courtesy notice be sent to residents in the area prior to construction. (e) Re-routing of garbage routes - Mr. Ackley reported that we 8/21/79 -fl- are now using 4 trucks instead of 5 with the new routing, which will be published in the Newsletter. Council . Mr. McIntosh reported that Mrs. Gosselin, 671 N. E. 105th St. , had asked him to reiterate her request for sidewalks or at least a bikepath along N. E. 6th Ave. for the school children attending Miami Day School and Miami Shores Elementary, and that the Council pursue this further. In the discussion that followed the Village Manager was requested to find out when the traffic light will be installed at 107th St. and 6th Ave. The Village Manager announced the Labor Day picnic to be held at the Country Club from 5 to 8:30 p.m. on September 3rd. Mr. Ackley also reported on the N. E. 2nd Ave. project, that his inspection had resulted in notifying the County that there were items to be corrected. The post office boxes are to be relocated, as well as the news- stands.
