MIAMI SHORES VILLAGE COUNCIL
December 3, 1974
The regular meeting of the Miami Shores Village Council was held
at 4:00 o'clock p.m. , December 3, 1974, at the Village Hall, with the follow-
ing Councilmen present:
Mayor James W. Condit
Raymond L. Clement
Harry F. Smenner, Jr.
Absent: Dean R. Claussen
Elwood Jones
Mr. David Peace, Village Manager, and Mr. Richard M. Lund,
Village Attorney, were also present.
The meeting was opened with an invocation given by Rev. Marion
Prather, of the Miami Shores Christian Church.
In recognition of the retirement of Mr. Thomas H. Anderson as
Village Attorney on December 1, 1974, the Mayor on behalf of the Council,
presented Mr. Anderson with an expression of appreciation in the form of a
plaque commemorating his 29 years of service with Miami Shores Village, and
a lifetime membership to the Country Club.
Minutes of the regular meeting of November 19, 1974 were approved
as written by motion made by Mr. Clement, seconded by Mr. Smenner and
passed.
Minutes of the work session of November 18, 1974 were approved
by motion made by Mr. Smenner, seconded by Mr. Clement and passed.
Planning Board minutes.
Planning Board approval was given to a request for Waiver of Plat

on Lot 15 less the southwesterly 10 ft. and all of Lot 14, Block 76, Miami
Shores Section #3. This parcel of land is located on the east side of Biscayne
Boulevard between 95th and 96th Streets and has a 90 ft. frontage with 11, 700 sq. ft.
After a review of the plan Mr. Clement moved that the Council uphold the action
of the Planning Board. The motion was seconded by Mr. Smenner and carried.
Amendment to proposed agreement with Dade County on merger
of auto inspection station.
In a letter received from Mr. Greene of the County Manager's office,
it was requested that the insurance required by the agreement to cover use of
the Village inspection station be in accordance with Dade County insurance
placement policy and not subject to approval by the Village. This amendment
was accepted by motion made by Mr. Smenner, seconded by Mr. Clement and
passed.
Village Manager's reports;
(a) Conference on "Collective Bargaining in Law Enforcement
Administration", Dec. 13-14, Miami Beach.
The Council approved Mr. Peace's attendance at this conference
by motion made by Mr. Clement, seconded by Mr. Smenner and
passed.
(b) Status report on pool repairs. Mr. Peace reported that the
pool had been closed during the month of November for maintenance
and repairs and that the total cost for this work would be between
$4500 and $5000. Because of the worn out filtering system the
Village Manager suggested that a new system be budgeted in the
fiscal year 75-76.

Bids on tennis court maintenance.
Invitations to bid on the maintenance of the 6 clay courts .at the Country
Club were sent to five companies. Only one bid was received as follows:
Trevor Shuert, 15521 N. E. 15th Place, North Miami Beach
For the month of December . . . . . . $ 900. 00
For remaining 9 months . . . . . . . . 3060. 00
Mr. Peace stated that he would look into this bidding further and report
at the next Council meeting.
Unfinished Business:
(a) Alley abutting the Mandel property - Mayor Condit recommended
that this be tabled until the next meeting and in the meantime
have our new attorney look into it.
(b) Board of Governors for Country Club - for special meeting.
(c) Method of electing Mayor - for special meeting.
Mr. Clement commented on the letter received from Judge Pearson
in which he notified the Council that he had decided not to pursue a permit to
build on a 50 ft. lot thru legal action, and at the same time commended the
Council on its zoning policies. Mr. Clement wanted the new Village Attorney
to make sure we can maintain our position on 50 ft, lots.
Mr. Alfred Mikker, who had complained about the assesment on the
Dog Track, commented on the letter received from the County Tax Assessor as
being unsatisfactory, and wanted the Village to take some action on getting a
reassessment of the track. It was requested that a copy of the Tax Assessor's
letter be sent to the Village Attorney.
