04-02-1974 Regular Meeting M OA REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL April 2, 1974 The regular meeting of the Miami Shores Village Council was held at 4:00 o'clock p, m. , April 2, 1974, at the Village Hall, with the following Councilmen present; Mayor James W. Condit Raymond L. Clement Elwood Jones Harry F. Smenner, Jr. Absent: Dean R. Claussen Mr. John W. McIntyre, Village Manager, and Mr. Thomas H. Anderson, Village Attorney, were also present. The meeting was opened with an invocation given by Elder John S. Mikell of the Miami Primitive Baptist Church. Mr. Jones moved that the minutes of March 19, 1974, be accepted. Mr. Clement seconded the motion providing the following amendment is made to the minutes: that Mr. Clement moved that the Village Manager and Police Department be instructed to enforce all ordinances of the Village, which motion died for lack of a second. The motion to approve the minutes as amended was then carried. Minutes of the meeting of March 26, 1974 were approved as written by motion made by Mr. Jones, seconded by Mr. Clement and passed. Service awards. Municipal Judges William F. Fann, Jr. , Albert E. Quinton, Jr. and William H. Pierce, were presented by the Mayor with a plaque in appreciation of their service to the Village prior to the abolishment of the Municipal Court. 4/2/74 -2- Mayor Condit also presented Harry Brown, an employee of the Parks Department, with a gift of a radio in recognition of his 25 years with the Village. First reading of amendment to Pension Ordinance raising the entrance age from 45 to 51. This was passed on first reading by motion made by Mr. Jones, seconded by Mr. Smenner and carried. Second reading of amendment to Zoning Ordinance on the definition of "family". Upon motion made by Mr. Clement and seconded by Mr. Smenner ORDINANCE NO. 377 was passed and adopted on final reading, same being entitled AN ORDINANCE AMENDING SECTION 216 OF ORDINANCE NO. 270, BEING THE ZONING ORDINANCE OF MIAMI SHORES VILLAGE, AND THEREBY DEFINING WHAT CON- STITUTES A FAMILY. Report on seawall by the Village Manager. Mr. McIntyre stated that they propose to dig up the old tie backs with the help of Formost Construction Co. and install 20 new tie backs, so that with the concrete bags, new tie rods and poured concrete behind the slabs, the wall can be repaired for the present at a cost of under the Council's $1, 000 appropriation. Mr. Clement asked the Village Manager to check with the committee appointed to study this problem before going on with the work. Mr. Dave Buxbaum, Golf Course Superintendent, and Mr. Cecil Cloud of Formost Construction Co. , were present to report on the completion of the installation of the automatic irrigation system on the golf course. The Mayor and the Village Manager thanked Mr. Cloud for his cooperation and services over and above the contract. 4/204 -3- First reading of Resolution approving replat of Block A, Miami Shores, Section 1. , to be known as "Dora Heights" subdivision. Upon motion made by Mr. Jones and seconded by Mr. Smenner this resolution was passed on first reading. Mr. Clement brought up the condition of the railroad equipment crossing for which we paid $800. 00 and it was reported that the work is not complete. Unfinished Business: (a) Consideration of changes to Ordinance No. 367 on campers and trailers. The Village Manager read the recommendation of the Planning Board to increase the permitted length to 30 feet with restrictions on parking in the rear yard with adequate screening. Mr. Smenner moved that the Council sustain the recommendation of the Planning Board with regard to the change in length of trailers. The motion was seconded by Mayor Condit to get it on the floor. Both Councilmen Jones and Clement spoke against extending the permitted length of trailers. The following citizens were heard on this subject: Dr.Genxge Williams, 54 N. E.100th St. , wanted the Council to give consideration to those who have recreational vehicles; he hoped that they would not rule them out, and that with proper screening they can be permitted. / Mrs. Joan Frechette, 300 N. E. 103rd St. , did not want the permitted size increased and thought the aesthetics of the Village will be \ destroyed by trailers. \ Mrs. E. Jensen, 2 N. W. 111th St. , cited the Village Hall News which stated that: "this ordinance was passed to protect your welfare and maintain the proper aesthetics of a residential community", and she felt this ordinance should be maintained and enforced for these reasons . She concluded by mentioning several violations that now exist. Mr. George Vernier, 29 N. W. 105th St. , stated that he is against dogs and campers. Mr. R. E. Holmstrom, 118 N. W. 94th St. , stated that he has had a trai ler for 8 years in the rear yard and there have never been any complaints. 4/2/74 e� -4- Mr. M. E. Hall, 882 N. E. 97th St. , stated that he has had a trailer in the rear yard since 1964 and the neighbors do not have any objection. Mr. Lyle Benson, 9490 N. W. 1 st Ave. , stated that they have had a trailer in the back yard for 15 years which can't be seen from the front of the house. He further read an article on the doubtful legality of policing aethetic values. Mrs. Lois Smith, 672 N. E. 98th St. , thought that many people were abiding by the ordinance. Mr. Jack Fitzgerald, 79 N. W. 97th St. , thought the Council should make a survey of violations. Mr. Howard Cawein, 700 N. E. 93rd St. , past president of the Miami Shores Chamber of Commerce, stated that their Board of Directors, wished to go on record as objecting to any change in the travel trailer ordinance and presented a statement to this effect which is made a part of these minutes. Mrs. Georgeen Spragg, 73 N. E. 108th St. , thought that before we go changing any ordinance we should enforce the ones we have. Mr. Ken Greenblatt, 9357 N. E. 9th Pl. , pointed out that it would be difficult to regulate parking of trailers at condominiums. Upon vote the motion failed with Mr. Smenner voting for it and Messrs. Condit, Jones and Clement against it. Mr. Jones then moved that the Council not accept the recommendation of the Planning Board to extend the length of travel trailers and keep the existing ordinance as is. Mayor Condit seconded the motion but it failed to carry on a tie vote. However, the present ordinance will still be in effect. Mr. Clement moved that we disallow all trailers and bows in Miami Shores. This motion died for lack of a second. Mr. Jones stated that the Village Manager should work out permission for people to load and unload their trailers. (b) Amendment to Ordinance No. 372 on Personnel Appeals Board. Mr. Anderson stated that this will be ready for the next meeting. '4/2/740€ -5- (c) Purchase of a safe for the Country Club. The Village Manager stated that in talking with the bartenders he learned that they are against having the safe anywhere near the bar. Upon motion made by Mr. Clement, seconded by Mr. Jones and carried, approval was given for the purchase of a safe to be located in an acceptable place. (d) Presentation of new type security alarm system - to be made following the meeting. Mr. Smenner moved that the meetings of the Council be recorded with the installation of a tape recording setup. This motion was seconded by Mr. Clement. It was then changed as follows: that the Village Manager present the Council with a cost estimate on installing a tape recording system. This motion was seconded by Mr. Clement and passed. Mr. Clement proposed that the Council meeting minutes be published in the Village Hall News. It was agreed that the agenda would be published in the North Dade Journal prior to Council meetings.
