03-05-1974 Regular Meeting REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL March 5, 1974 The regular meeting of the Miami Shores Village Council was held at 4;00 o'clock p. m. , March 5., 1974, at the Village Hall, with the follow- ing Councilmen present; Mayor James W. Condit Elwood Jones Harry F. Smenner, Jr. Absent; Dean R. Claussen Raymond L. Clement Mr. John W. McIntyre, Village Manager, and Mr. Thomas H. Anderson, Village Attorney, were also present. The meeting was opened with an invocation given by Rev. Richard Sparks of the Miami Shores Baptist Church. Minutes of the meeting of February 12, 1974 were approved as written by motion made by Mr. Jones, seconded by Mr. Condit and passed. Con- cerning the minutes of the meeting of February 19, 1974, Mr. Smenner moved that they be approved with the stipulation that it was not the intention of the Council to instruct the Chief of Police not to enforce an ordinance that is on the books (in regard to trailers) but to research the ordinance further for discussion at the next meeting. Mr. Jones seconded the motion and it was carried. Minutes of the meeting of February 26, 1974 were approved by motion made by Mr. Jones, seconded by Mayor Condit and carried. Planning Board minutes. A recommendation was made by the Board that the Zoning Ordinance be amended to abolish the renting of rooms and limiting the number of 3/5/74 2Z -2- non-related persons living as a family in a single family zone as follows: That Section 216 of the Zoning Ordinance be amended to read: Family One or more persons living as a single housekeeping unit and consisting of either: (a) any number of persons related by blood or marriage; or (b) not more than two persons not related by blood or marriage. Mr. Jones moved that the Council request that the Village Attorney write an amendment to the Zoning Ordinance in regard to the definition of "Family", as recommended by the Planning Board. The motion was seconded by Mr. Smenner and carried. Recommendation by the Chief of Police that the Council adopt a standard fine of $20. 00 for non-court appearances. Lt. Gwynn, in the absence of Chief Fletcher, stated that in conjunction with our use of Metro Court for municipal offenses it was requested that a $20. 00 fine be established for non-court appearances, to be divided as follows: $5. 00 for administrative costs to Metro, 10. 00 to the Village and $5. 00 to Dade County. He added that these fines could be payable by mail. Mr. Anderson stated that this would have to be established by ordinance and the subject was referred to the Village Attorney, Village Manager, and Chief of Police to review the Village laws and list offenses that can be put in this category. Authority to beautify the center park on 109th Street between N. Miami Avenue and N. W. 2nd Avenue. The Village Manager reported that this would include installation of a 1-1/2" water meter, a sprinkler system and additional plantings at a total cost of up to $2800. 00, which has been budgeted. Mr. Jones moved that the Council authorize an expenditure of up to $2800. 00 to beautify the center 3/5/74 -3- parkway of 109th Street from Miami Ave. to N. W. 2nd Ave. The motion was seconded by Mr. Smenner and passed. Agreement between Miami-Dade Water & Sewer Authority and Miami Shores Village on the installation of fire hydrants. Mr. Jones moved that the Council authorize the expenditure of an estimated $22, 000. 00 and enter into an agreement with the Miami-Dade Water & Sewer Authority, the money to be paid from Revenue Sharing over a period of three years. The motion was seconded by Mr. Smenner and carried. Report by the Village Manager on article "Experiment in Trash Bags" to be printed in the Village Hall News. The Village Manager reported that he was proposing an experiment in the use of trash bags to be picked up with the garbage and planned to print an article in the Village Hall News asking people to cooperate. The Council was in favor of allowing the Village Manager to try this. Report by the Police Dept. on the necessity for revision of the home and business security alarm system. Lt. Gwynn reported that there are 65 alarms in the Police Dept. that are connected to residences and businesses and that these alarms are installed and serviced by five different companies, which results in too many people tampering with the equipment causing breakdowns. He stated that the system is out of date and that they would like to allow one central company to provide the system and let the customers contract with that company for the use of the service. Different alarm companies could still be used through the master system and serviced by that one company. Lt. Gwynn stated that A. D. T. and Reliable had submitted estimates on cost of connecting to the system and monthly fee. Mr. Smenner asked for specific information on 3/5/74 2v -4- prices for consideration at a later meeting. The Village Manager reported that there will be a meeting on March 21st for all subscribers who will have the proposals explained to them. Former Chief Senneff pointed out that the Country Club has no alarm system at present. Mr. Jones moved that the Village Manager be authorized to take bids on an alarm system at the Country Club and also bids on a floor safe in the bar area. The motion was seconded by Mr. Smenner and carried. Bills. Upon motion made by Mr. Jones, seconded by Mr. Condit and passed, the bills for the month of February were approved. Unfinished business: (a) Consideration of changes to Ordinance No. 367 on campers and trailers. (Mr. Clement asked postponement until he can be present. ) (b) Amendment to Personnel Appeals Board Ordinance No. 372.
