10-17-1972 Regular Meeting REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL October 17, 1972 The regular meeting of the Miami Shores Village Council was held at 4:00 o'clock p. m. , October 17, 1972, at the Village Hall, with the follow- ing Council members present: Raymond L. Clement Dean R. Claus s en Mrs. Marjorie A. Dunn Howard J. McLaughlin Absent: Mayor Elwood Jones Mr. John W. McIntyre, Village Manager, and Mr. Thomas H. Anderson, Village Attorney, were also present. The meeting was opened with an invocation given by Rev. Marion Prather of the Miami Shores Christian Church. In the absence of Mayor Jones, Council Clement was asked to take the chair. Minutes of the meeting of October 3, 1972, were approved by motion made by Mrs. Dunn, seconded by Mr. McLaughlin and carried. Planning Board minutes. - no action required. Mr. Bassett of Bassett School on termination of his license by Ordinance No. 346. Ordinance No. 346, passed on July 15, 1969, limits private schools using temporary facilities to a 5-year term of operation. The Village Attorney, in discussing this ordinance with Mr. Bassett's attorney, came to the con- clusion that the five-year period should begin on the date of the passage of the ordinance. Mr. Claussen moved that the Council grant the Bassett School 10/17/72 -2- another year to operate. The motion was seconded by Mr. McLaughlin and passed. Disability Insurance rider. The Village Manager reported that there would be a reduction in our disability insurance premium which our insurance carrier recommended be used for increased disability benefits with no additional cost to the Village. Mr. Claussen moved that the Council approve the rider on our disability insurance. The motion was seconded by Mr. McLaughlin and carried. Authority to ask for bids on the Country Club air conditioning. The Village Manager reported that Mr. Frese, the engineer hired to write air conditioning specifications for the Country Club had them ready for bidding. Mr. Claussen moved that the Village Manager be authorized to advertise for bids for the system as prescribed and that he will go over the structural plan before the spec's go out. The motion was seconded by Mr. McLaughlin and passed. The Village Manager discussed the County abandoned vehicle program recommended by Chief Thurman and stated that we will have to pass an ordinance in order to adopt the program. Mr. Claussen moved that the Council authorize the Village Manager to prepare an ordinance on car removal. The motion was seconded by Mr. McLaughlin and passed. Mr. Robert Koppen, attorney, and Mr. C. H. Missall, owner of Lots 1 and 2, Block 21, E1 Portal Sub. , appeared before the Council to request a Quit Claim deed to the east five feet of these lots which had at one time been deeded to the Village for street widening purposes. In searching the title for 10/17/72 -3- sale of the property this deed was discovered, as well as, a Quit Claim deed the Village had given to a previous owner to clear a cloud on the title. Since the deed to the five feet was dated prior to the deed for quit claim, question arose as to whether or not the Village still owned the five feet. Mr. Claussen moved that the Council table action on this problem and take it up again at the next Council meeting. The motion was seconded by Mrs. Dunn and carried. Mr. Clement discussed the problem of allowing items of business to be brought up from the floor without being on the agenda and moved that in the future,an item of business will not be taken up unless it is on the agenda, without a unanimous vote of the Council to hear the business, otherwise it will be postponed until it is put on the agenda of the next meeting. Mrs. Dunn seconded this motion and it was passed. Because of her concern for an employee Mrs. Dunn voiced her feelings about Frances Falconer, who had been the telephone operator at the Country Club for 15 years and was forced to quit because she couldn't get her Sundays off. Since this employee had already secured another position no action was required. The meeting adjourned at 4:50 p. m. '0 Village Clerk APPROVED: Mayor
