10-05-1971 Regular Meeting REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL October 5, 1971 The regular meeting of the Miami Shores Village Council was held at 4:00 o'clock p.m. , October 5, 1971, at the Village Hall, with the following Council members present: Raymond L. Clement Dean R. Claussen Mrs. Marjorie A. Dunn Howard J. McLaughlin, Council appointee Absent: Mayor Elwood Jones Mr. John W. McIntyre, Village Manager, and Mr. Thomas H. Anderson, Village Attorney, were also present. In the absence of Mayor Jones, Councilman Clement was asked to take the chair and the invocation was given by Mr. Claussen. Metro Court Judge Thomas E. Lee was called upon to officially administer the oath of office to the newly appointed Councilman, Howard J. McLaughlin. Minutes of the budget hearing, the meeting of September 21, 1971 and a special meeting of September 28, 1971, were approved as written by motion made by Mr. Claussen, seconded by Mr. McLaughlin and carried. Recommendation to increase hospital daily rate under group hospitalization coverage. The Village Manager reported an amount of $10, 357. 37 being held in a contingency reserve account by our insurance company, Continental Assurance, which he recommended be used to increase the daily hospital rate from $30. 00 to $40. 00 at a cost of about $4500. 00 and that the balance be held in the contingency reserve if it will accrue interest. Mr. Claussen moved 10/5/71 that the Council accept the Manager's recommendation and increase the benefits to $40. 00 per day and apply the difference to the reserve account to draw interest. The motion was seconded by Mr. McLaughlin and carried. Memo from Planning Board regarding Pellegrino residence at 144 N. E. 91st Street Mr. Robert Lewin, 136 N. E. 91st Street, together with his neighbors, was present to petition the Council to stop Miss Pellegrino of 144 N. E. 91st Street, from using her property for multiple family dwelling purposes, based on the fact that the extent of the non-conforming property was changed when 50 ft. of the land was sold off, on which Mr. Lewin's home was later built. It was also reported that the lower floor of the garage was closed in by a former owner without permit, that the building is sub-standard and constitutes a definite fire hazard to second floor tenants. Mr. Claussen moved that the Council refer this to our Village Attorney to contact Miss Pellegrino's attorney to see if they can work out a solution to the problem. The motion was seconded by Mrs. Dunn and passed unanimously. New contract for John Cusano, Golf Pro. The Village Manager pointed out the changes made in the agreement with the golf pro as to salary and omission of a stipulated agreement concerning report of pro shop sales. Copies of the new contract had been sent the Council. Mr. Claussen moved that the Council approve the agreement as presented. The motion was seconded by Mr. McLaughlin and carried. Florida League of Cities annual dues. Authority was requested to pay the Florida League of Cities dues in 10/5/71 �� -3- the amount of $750, 00 which is $250. 00 more than budgeted. Mr. Claussen moved approval of the $750. 00 dues with an accompanying letter expressing concern over the fact that they did not advise us of the increase prior to our budget adoption. The motion was seconded by Mr. McLaughlin and passed unanimously. The newly appointed Councilman Howard McLaughlin was invited to attend the Florida League of Cities meeting in St. Petersburg, October 23-26. Unfinished Business: (a) Clubhouse painting bids - The Village Manager reported that the low bidder, Mr. Albert Warner, did not have a painting contractor's license and he therefore recommended that the bid go to the next low bidder, Mr. Lloyd S. King, with a bid of $2980. 00. Upon motion made by Mr. Claussen, seconded by Mrs. Dunn and passed the bid of Mr. King was accepted. (b) N. E. 2nd Ave. park - no report. (c) Condemnation suit - Lot 23, Block 15, Miami Shores Sub. Because of the approaching court date on this suit and the estimated cost of acquiring the property, the Council was asked if they wished to reconsider their position. After some discussion Mr. Claussen moved that we instruct our attorney to withdraw from the condemnation suit and negotiate a reasonable fee for the opposing counsel. The motion was seconded by Mr. McLaughlin and carried. 10/5/71 -4- Chief Fowler announced the plans being made for Fire Prevention Week, October 4 through October 10th, with a display of fire fighting equipment at the Biscayne Kennel Club parking lot on October 10th from 1 to 5:00 p.m. The meeting adjourned at 4:45 p.m. Village Clerk APPROVED: 9 Mayor
