05-20-1969 Regular Meeting REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL May 20, 1969 A regular meeting of the Miami Shores Village Council was held at 4:00 o'clock P. M. , May 20, 1969, at the Village Hall, with the following Councilmen present: Mayor Don G. Nicholson Raymond L. Clement Dean R. Claussen Edwin B. Cole Elwood Jones Absent: None Mr. Thomas H. Anderson, Village Attorney, and Mr. John W. McIntyre, Village Manager, were also present. The meeting was opened by Mayor Nicholson, with an invocation given by Rev. Ben Varner, of the Advent Lutheran Church. Minutes of the meeting of May 6, 1969, were approved as written on a motion made by Mr. Cole, seconded by Mr. Jones and carried. Letter from Library Board. A letter was read by the Village Manager stating that the Library Board is of the opinion that no change in the control or administration of the library should be undertaken without a vote of the citizens of the Village. The Board also stated that Brockway Memorial Library has neither the staff nor the facilities to serve a portion of the Dade County area. Motion was made by Mr. Clement, to accept the report with thanks, seconded by Mr. Jones and passed unanimously. The Village Manager read a letter written by Mrs. Donald 5/20/69 -2- McIntosh for the Library Board recommending the appointment of Mrs. A. Alston Fisher, Jr. to the Library Board of Trustees for the term 1969 - 1974. This appointment will be on the agenda of the next Council meeting. Proposed Ordinance Concerning Seizure and Sale of Confiscated or Abandoned Property. Upon motion made by Mr. Cole, seconded by Mr. Clement, ORDINANCE NO. 345 was unanimously approved. Annual Leave (Vacation) Report. The attached report, asked for by Mayor Nicholson, was made by the Village Manager. After some discussion the Manager was authorized by the Council to use the recommended annual leave schedule in the departments where it would not affect the current personal services budget. Permission to raise laborers' and drivers' salaries 51o. Mr. Jones made a motion that garbage, trash laborers and drivers get a 50/c increase to bring them more in line with salaries being paid by other municipalities. On a substitute motion by Mr. Claussen, accepted by Mr. Jones and seconded, the Village Manager was authorized to raise salaries of laborers and drivers 51c if necessary subject to the approval of the Mayor. Motion passed unanimously. Second and Final Payment of the Village Contribution to the 701 Planning Program. A letter from Mr. Reginald R. Walters, Planning Director of Dade County, was read asking for the final contribution to the 701 Planning Program in the amount of $3, 647. 00. Upon a motion by Mr. Claussen, seconded by Mr. Cole approval was given with the stipulation that this is in 5/20/69A 44 -3- compliance with the contract between Dade County and Miami Shores Village. The motion was passed unanimously. Unfinished Business: (a) Committee report on golf and swimming pool memberships. This report was given, as a committee of one, by Mayor Nicholson who stated that the pool is being poorly managed and that he is hopeful that a better program can be worked out by increasing the regular swimming hours and staff. Mr. Claussen made the motion that the Village Manager, Swimming Pool Manager, Swimming Pool Chairman and a group of citizens meet to work out a better pool program., seconded by Mr. Cole and passed unanimously. The Village Manager was also instructed to make a report on Country Club finances before next Council meeting. (b) Authorization for final plans on proposed new recreation center. Mayor Nicholson explained that this item was carried over from last Council meeting in order to get a firm commitment from the CY,_ M architect on the architectural fee in regard to the cost of plans .10 rh N and specifications if the project is put out for bids and also a fee commitment if the project had to be terminated. Mr. Claussen a� a� explained the architectural fee basis after which Mr. Wahl Snyder on a direct question quoted a maximum fee figure of $12, 000. 00. o U Mayor Nicholson made the motion that a maximum fee of $12, 000. 00 0 U 5/Zo/69 45 be approved for the final plans and specifications on the proposed Recreation Center and that the building committee be authorized to proceed with the program and the letting of bids on the project. Motion seconded by Mr. Jones and passed with Mr. Clement dissenting because he feels that a referendum is in order. (c) Petition to close a portion of N. E. 91st Street. The Village Manager had been instructed to obtain information on the ownership of the 87th Miami Shores Corporation at the last Council meeting. A letter was read from the law offices of Sager, Silverman, Bodne & Burns, signed by Michael D. Bodney stating that the officers of the 87th Miami Shores Corp. are as follows: Ruth Winston - President E. B. Kline - Secretary/Treasurer Mr. Claussen made the motion, seconded by Mr. Jones, that an appropriate resolution be prepared to close N. E. 91st Street from Park Drive to the Railroad and to remove it from the plat, upon the condition that the property owners provide drainage of the area to the satisfaction of the Building Department. The motion was passed unanimously. (d) Tropical Chevrolet addition. - The architect reports that the plans are not completed at this time. (e) Parking survey N. E. 2nd Ave. The Council asked that this item be removed from the agenda but that committee meetings be carried on. 5/20/69 -5- Mayor Nicholson opened discussion from the floor. Mrs. K. Hagearty requested that something be done about the facilities of the Police Dept. and stated that in her opinion a holding cell was needed as a security measure. After a discussion of police training programs and Chief Fowler's report on current educational programs it was agreed by the Council that any college credits that have to do with police work taken by members of the department could be properly charged to Police Department expense. McIntyre Village Manager APPROVED: Mayor ,01-iami Jhores9lIIage F L O R 1 D A May 16, 1969 ANNUAL LEAVE ( VACATION) REPORT The recent Florida City Managers' conference at Daytona Beach, the more recent Florida Association of Civil Service and Personnel Agencies' publication "Salary Survey 196911, and House Bill 117, "Collective Bar- gaining for Public Employees", all point up to the fact that unionism in Florida cities is now in fact a reality. Many City Managers went on record at the conference as being in favor of House Bill 117. It was not because they approved in principle but simply because the unions have such a strong hold that sooner bargaining can begin the sooner service will be resumed. Mr. Lynn Andrews from St. Petersburg, who has already broken one strike, said that this would not now be possible to do again because the climate has changed and the people no longer support him. It is a well-known fact that the first attack by unions on a city is usually in the fringe benefit area because they have more to talk about and more to accomplish. They use this as a wedge to get checkoff, which means payroll deduction of dues. The best way to insure against this is to keep fringe benefits up to those of other cities we must compete against for personnel. Miami Shores Village has no personnel ordinance, in fact, it has no written ordinance or resolution on annual leave or sick leave. The estab- lished practice on vacations has been two weeks for employees having one year or more service and as to sick leave, one day per month is allowed for a verified sickness up to a maximum accumulation of 90 days. The following report is a short study of what other cities are doing and a program recommended by your Village Manager. CITY OF MIAMI gives 10 working days for the first 9 years' service, 15 working days for 10-19 years, 20 working days for 20 thru 30 years and 30 work- ing days for over 30 years. DADE COUNTY gives 10 working days for the first 5 years and then gives one additional day for each year up to 10 years with a top at 15 days. ANNUAL LEAVE (VACATION) REPORT Page 2. CORAL GABLES has a schedule going from 10 days the first year to 22-1 /2 days after 25 years. NORTH MIAMI's schedule goes from 10 days the first year to 20 days after 15 years. Keeping in mind that it is to our advantage to keep employees happy in between their 4th and 20th years of service more than in the over 20 years of service category I would like to suggest the following annual leave schedule: After 1 year - 2 weeks' vacation (we use weeks instead of working days because many Club employees work a 6-day week) After 4 years' service - add one day After 8 years' service - add an additional day After 12 years' service - add an additional day After 16 years' service - add an additional day After 20 years' service - add an additional day (This then would give a 5-day week employee 3 weeks' vacation after 20 years. ) If this meets with Council approval a resolution or ordinance can be pre- pared to accomplish this purpose.
