REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
April 7, 1959
A regular meeting of the Miami Shores Village Council was held
at 4:00 o'clock P.M. , April 7, 1959, at the Village Hall, with the follow-
ing Councilmen present:
Michael J. Franco, Mayor
John F. Saxon
M. E. Reynolds
Spencer W. Rudnick
Absent: Dean R. Claussen
Minutes of the last regular meeting were approved by motion made
by Mr. Rudnick, seconded by Mr. Reynolds and passed unanimously.
A petition was received from certain residents on N. E. 91st
Terrace protesting the special assessment for drainage. Several of these
citizens were present and stated that they felt this assessment should be
paid for by the people who had benefited by it. Mayor Franco requested that
the signatures be checked on the petition asking for this drainage and then
ask Mr. Anderson if the entire cost can be borne by those who have benefited
by the drainage.
Mr. Crusty Drybread, representing Dade Council of Civic Organ-
izations and Biscayne Gardens Civic Assoc. , was present to request that
the Council pass a resolution urging the County Commission to do something
to better the County-wide transportation. Mr. Saxon moved that the Village
Manager and Village Attorney be instructed to prepare a resolution urging
the County Commission to provide an adequate system of public transportation
for all of Dade County. Motion was seconded by Mr. Reynolds and passed

unanimously.
The following bids were opened for the construction of a vehicle
inspection station at the Village nursery:

Mr. Saxon moved that the Village Manager be instructed to study
the bids and award the contract to the lowest bidder and provide adequate
bond. Motion was seconded by Mr. Rudnick and passed unanimously.
The following bids were opened for installation of drainage
facilities at N. E. 5th Court in the vicinity of Tropical Chevrolet and Mickey's
Drive-in:

Mr. Reynolds moved that the Village Manager compute the bids,
check the low bid with the bidder and if he can do the job for that figure, to
award the contract providing it is checked by Rader Engineering Company at
the usual fee, otherwise that the bid be thrown out, but provide engineering
supervision regardless of who gets the bid. Motion was seconded by Mr. Saxon
and passed unanimously.

A letter was received from Mr. James Elder in which he makes
a gift to the Village of five flood lamps. Mr. Rudnick moved that we accept
the gift and notify Mr. Elder of our thanks and appreciation. Motion was
seconded by Mr. Saxon and passed unanimously.
Discussion of the By-Laws of the Tri-County Governmental League
was postponed until Mr. Claussen returns.
Concerning the Planning Board minutes, Mr. Reynolds moved the
action of the Planning Board in regard to Mr. Doyle's request to build on
Lot 3 and the north 1/2 of 2, Block 13, M.S. Sub. (72 ft. I be approved.
Motion was seconded by Mr. Rudnick and passed unanimously.
After a review of the current bills, Mr. Reynolds moved that they
be approved. Motion was seconded by Mr. Rudnick and passed unanimously.
Mr. Harry Swan of 600 Grand Concourse, appeared before the
Council with pictures of a garage built behind his property which, because of
its height, Mr. Swan considers an eyesore. Mr. Swan contended that the
Village should never allowed this to be built and demanded that steps be taken
to help hide it by the erection of a higher fence between the two properties.
The Building Inspector was instructed to get estimates on a picket fence to
be installed on the existing rear wall.
Mr. Harry MacDonald, owner of property at 89th St. and 6th Ave. ,
was present in regard to the unfinished business of Tropical Chevrolet's
request for use of land on 6th Ave. for display of cars. Mr. MacDonald
contended that the use at that location would ruin the entrance to the Village
by the appearance of a new or used car lot.

After a discussion of the amendments being proposed to the Pension
Plan, Mr. Saxon moved that ORDINANCE NO. 291 be adopted. Motion was
seconded by Mr. Rudnick and passed unanimously with four affirmative votes.
Ordinance No. 291 is entitled: AN ORDINANCE AMENDING ORDINANCE
NO. 273 BEING THE MIAMI SHORES PENSION PLAN ORDINANCE.
Mr. A. M. Schlechte of 1345 N. E. 105th St., appealed to the
Council for some relief from the nuisance caused by the hauling of fill from
the Bay at the end of his street. After some discussion concerning the con-
tractor's (Mr. Chastain) permit to do this work for the Flood Control District,
and that the permit does not expire until 1961, Mr. Anderson stated that the
Village could regulate this work if it is causing a public nuisance. It was
his suggestion that the Village Manager discuss the problem with Mr. Chastain
and get some agreement for regulation of speed, times of operation, spraying
the street to keep down dust, etc.
The meeting adjourned at 5:55 P.M'.
