REGULAR MEETING
MIAMb SHORES VILLAGE COUNCIL
May 15, 1956
A regular meeting of the Miami Shores Village Council was. held
at 4x00 o'clock P. M. , May 15, 1956, at the Village Hall, with the following
Councilmen present:
Mayor Dean R. Claussen
Michael J. Franco
M. E. Reynolds
William E. ' Carpenter
S. D. Phillips, Jr.
Mr. Thomas H. Anderson, Village Attorney, was also present.
Minutes of the last regular meeting were adopted as written by
motion made by Mr. Franco, seconded by Mr. Phillips and passed unanimously.
A petition was received by residents requesting removal of the
rubber trees along N. E. 10th Avenue south of 95th Street because of the
constant nuisance they cause by shedding leaves. The Village Manager
recommended removal if the residents will replace them or beautify the park-
way. He reported that it would cost about $20 per tree and that there are
approximately 20 trees involved. Mr. Phillips moved that we remove the
trees and let the Village Manager work out the replacement with the residents.
The motion was seconded by Mr. Franco and passed unanimously.
Mr. Sol Silberman was present to appeal the Planning Board's
decision denying him a permit to split 125 ft. into two building sites of 62.1/2 ft.
each, Lots 8, 9, and E 1/2 of 10, Block 47. After some discussion Mr. Phillips
moved that his request be denied. The motion was seconded by Mr. Franco
and passed unanimously. The Council further stated that Mr. Silberman could

get -a permit on 75 ft. at any time, provided he built on Lot 9 and the E 1/2
of 10, leaving an undivided 50 ft.
A proposal was made by the Village Manager to pave sidewalks on
both sides of the railroad crossing at 96th St. to permit safe passage of
pedestrians and children on bicycles. Permission was secured from the
Railroad and an estimated cost to the Village of $45-0. 00. Mr. Carpenter
moved that the sum of $450. 00 be approved for widening the railroad crossing.
at 96th St. on the north and south side, for the purpose of pedestrian and
bicycle traffic. The motion was seconded by Mr. Franco and passed unanimously.
Mr. James K. Lewy of 1236 N. E. 92nd,St. , appeared before the
Council with petitions signed by the residents of 92nd,St. east of 10th Ave. ,
requesting that the Council provide some measures of safety to children and
residents against speeding cars and reckless drivers on 92nd St. They pro-
posed signs in the middle of the street and obstructions on.the pavement. The
Council turned this over to the Police Department to handle.
A letter was received from Mr. Sidney Weise concerning the
Council's motion that the fire works for the 4th of July program,- not be stored
in the Village. Mr. Weise stated that he could not build the sets under these
conditions. Mr. Reynolds then amended the motion to the effect that the-fire
works may be stored in a safe place on the golf course. Mr. Franco seconded
this motion and it was passed unanimously.
A proposed ordinance concerning truck traffic was read by the
Village Manager. This ordinance prohibits trucks having a gross weight rating
exceeding 20, 000 lbs. on any street within Miami Shores Village except

N. E. 2nd Ave. and Biscayne Blvdo or when delivering or receiving goods,
at a specific place. Upon motion made by Mr. Phillips and seconded by Mr,
Carpenter, ORDINANCE NO. 269 was unanimously passed and adopted, same
being entitled:
AN ORDINANCE REGULATING TRUCK TRAFFIC
ON STREETS IN MIAMI SHORES VILLAGE
Mr. Reynolds suggested that between now and preparation of our
next budget, the Village Manager get a breakdown of costs on repaving and
widening 103rd St. from the Golf Course to N. W. 2nd Ave.
The next item of unfinished business was the adoption. of the new
Zoning Ordinance. After some discussion concerning Section 404 which pro-
hibits the splitting of plots under one ownership at the time of the adoption of
the ordinance, into building sites of less than the minimum required width,
the Council agreed to maintain this restriction as written by Mr. Pomeroy.
Mr. Franco then moved that this ordinance be adopted. The motion was
seconded by Mr. Carpenter and thereupon ORDINANCE NO. 270 was unanimously
passed and adopted, same being entitled:
AN ORDINANCE ADOPTING.A COMPREHENSIVE ZONING
PLAN FOR MIAMI SHORES VILLAGE. AND PROVIDING
PENALTIES FOR VIOLATIONS THEREOF.
Concerning the insurance survey, - copies of the recently made
survey will be sent to the Council.
The Council requested that the item of additional parking meters
be removed from the agenda.
An opinion from Mr. Anderson was read concerning the legality

of the Flood Control DistricVs request for a 25 ft. set back on the north side
of Biscayne Canal, and the Council agreed that the Building Department should
be instructed to notify any prospective builder what is going to occur in the
° future.
The problem of concrete lawn markers was again brought up for
discussion. Because of the parking problem involved and the traffic hazard
they cause,. Mr. Reynolds moved that the Village Manager be instructed to
prepare an ordinance requiring,a six foot setback for all concrete markers
e from the paved portion of the street. The motion was seconded by Mr. Phillips
and passed unanimously.
After a brief report from the Village Manager on the .Managers.'
Short Course, Mr. Franco moved it be accepted. Motion was seconded by
Mr., Carpenter and passed unanimously.
A request was made by Mr. Roland Tompkins to have the Council
authorize the Railroad to stop the blowing of train whistles at the crossings
in. Miami Shores which was turned over to the-Village Manager to look into.
The meeting was adjourned at 6:10 P. M.
