REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
December 21, 1954
A regular meeting of the Miami. Shores Village Council was held
at 4:00 o'clock P.M. , ,December 21, 1954, at the Village Hall, with the
following Councilmen present:
Mayor S. D. Phillips,ips, Jr.
William E. Carpenter
Michael J. Franco
Dean R. Claussen
Absent: M. E. Reynolds
Mr. Thomas H. Anderson, Village Attorney, was also present.
Minutes of the last regular meeting were adopted as written by
motion made by Mr. Carpenter, seconded by Mr. Claussen and passed
unanimously.
A resolution was read by the Village Manager authorizing the
execution of a chattel mortgage or retain title contract with Peoples
National Bank to finance the purchase of a new fire truck. Upon motion
made by Mr. Carpenter, seconded by Mr. Claus sen, RESOLUTION NO.
343 was unanimously passed and adopted.
Mr. Corlett and Mr. J. Law Davis appeared to petition for a
filling station to be constructed on the southeast corner of 88th Street and
Biscayne Blvd. This was brought before the Council inasmuch as the
Planning Board was under the impression that it could not be approved with-
out an exception to the gasoline station spacing ordinance. . Mr. Claussen
stated this ordinance had been repealed at the time the last permit was

issued andthe minutes were checked to verify this. Afterfurther discussion
Mr. Carpenter moved that we take this petition under advisement and plan to
give the petitioners an answer at the first meeting in January. Motion was
seconded by Mr. Claussen and passed unanimously. Mr. W. Krames who owns
the Amoco Station on the northeast corner of Biscayne Blvd. and 88th Street,
'to substantiate this petition, stated that this is the only piece of vacant property
left along that stretch, that he doesn:t see any other use for the property but a
filling station; that he has no objection to another station in that area.
The request to pave part of the parkway on 95th Street in front of
Dr. Baxter's office was denied by the Planning Board. However, it was brought
before the Council for discussion because of the church parking in front of this
building which creates ruts and sand trouble in the parkway. After discussion
the Council agreed that a circular drive could be paved but not the entire area
and it was turned over to the Village Manager for handling.
The next business before the Council was a complaint registered
against Mr. Otho Rice's plan to construct another two car garage on the rear
of his premises at 230 N. E. 100th Street, approval for which was granted by
the Planning Board several months ago. The complaint written by Mr. Landis,
living immediately east of Mr. Rice, was based on the assumption:that Mr.
Rise would use this for business purposes, - storing,paint and operating a
carpentry shop. Mr. Rice's permit was then held up until the objection could
be investigated. Mr. Rice was present at this meeting and stated that he needed
this additional garage to house his truck, ladders and store paint, that his
present two car garage is too crowded for this purpose. In answer to the noise

complaint, Mr. Rice admitted that he has a band saw in his garage for
making cornices and shelves. Mr. Claussen suggested that we take this under
advisement and view the property and get opinions from other neighbors. This
will be taken up again at the first meeting in January after the Council has had
an opportunity to view the property and look into it further.
Mrs. Doyle E. Bush of 9126 N. E. 1st Avenue, Lots 1, 2, and 3.
Block 1, Miami Shores. Section, requested permission through the Planning
Board to divide her property to permit the construction of another residence.
The Planning Board recommended to the Council that Mrs. Bush be allowed to
divide her lots in such a way that all set backs will be maintained by the
present building which will leave another building site of 61 ft. After discussion
as to whether or not the Council can prohibit a property owner from dividing
his property into two building sites, the Mayor made the following statement:
that the Council has not turned down anyone on application for a residence on
a 50 ft. lot, where no additional land can be purchased.
Mr. John H. Lockhart of 87 N. E. 92nd Street appeared before the
Council in behalf of his claim for Homestead Exemption. He contended that
he had received it for many years, that he had filed this past year and had
made an additional trip to the Tax As s e s s or l s office at their request but had
no receipt to prove it. Mr. Claussen moved that we grant Mr. Lockhart the
benefits of Homestead Exemption for 1954 because of his statement that due
to an error in the County Assessor's office his receipt failed to reach us and
because of his long standing and good reputation in our Village we should grant
it. Motion was seconded by Mr. Carpenter and passed unanimously.

Concerning the purchase of Police cars, the Village Manager reported
that the low bid was made by All Miami Motors after disposing of the old cars
in a separate transaction. Mr. Franco moved that we approve the purchase of
three Police cars at $3108. 32 net from All Miami Motors. The Motion was
seconded by Mr. Carpenter and passed unanimously.
Mayor Phillips stated he had a complaint from Mr. Mic.es of 1182
N. E. 92nd St. against the fishing prohibition. No action was taken.
The Village Manager made a report on the Managers' meeting he
recently attended in which he stated that cities are coming to a 40-hour week
and that an established pay p1;.n and personnel plan is badly needed here.
Mr. Claussen brought up a discussion of a pension plan for all
employees, the cost of which will have to be approved by the freeholders
in April and plans for which should be started now.
The Council approved Mr. Ward's request that the Village split
the cost of the prize money in the home decoration contest with the Chamber
of Commerce, this year as in the past.
The meeting adjourned at 5:30 P.M.
