06-15-1954 Regular Meeting 95 REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL June 15, 1954 A regular meeting of the Miami Shores Village Council was held at 4:00 o'clock P.M. , June 15, 1954, at the Village Hall, with the following Councilmen present: Mayor S. D. Phillips, Jr. M. E. Reynolds William E. Carpenter Michael J. Franco Dean R. Claussen Absent: None Mr. Thomas H. Anderson, Village Attorney, was also present. Upon motion made by Mr. Franco, seconded by Mr. Carpenter, and passed unanimously, the minutes of the last regular meeting were approved as written. Mrs. William H. Walker, Jr. , Chairman of the Library Board, attended this meeting, together with Miss O'Connell, Librarian, to present to the Council the Sixth Annual Report of the Brockway Memorial Library. Mayor Phillips accepted the report and expressed thanks and appreciation to the Board for their services. A proposed ordinance was read prohibiting the issuance of building permits, for a period of sixty days, on the vacant lots in the "X" Zone along N. E. 2nd Avenue. Upon motion made by Mr. Reynolds, seconded by Mr. Carpenter, ORDINANCE NO. 253 was unanimously passed and adopted, same being entitled: AN ORDINANCE PROVIDING THAT NO BUILDING PERMITS SHALL BE ISSUED UPON CERTAIN HOTS IN MIAMI SHORES VILLAGE FOR A PERIOD OF 60 DAYS. 96 : 9.1'. 6/15/54 The next business was consideration of the Planning Board's recommended approval of Dr. R. E. Baxter's revised plans for a professional building to be constructed on Lots 1 and 2, Block 60, Miami Shores Sub- division. A letter was read from the Village Attorney in which he advised that Ordinance No. 212 did permit multiple professions in one building, either of the same or different professions. Also that, in his opinion, the prohibited clinical use meant, "the treatment of bed patients and the perform- ance of surgical operations on the subject property. " It was pointed out by Mr. Oren E. Morton, as well as Mr. Earle Dutton, that according to the minutes of the meeting at which Ordinance No. 212 was adopted, that there would be parking on Railroad Ave. only. Mr. George Mason of 9430 N. E. 6th Avenue, stated that he thought it should be a residential type building and not a commercial type building of such a large size. He further went into the possibility of a future use as a hospital with ambulances, etc. Mayor Phillips explained that the plans had to be considered insofar as they met present ordinances, not the size or projected future use. Mr. Carpenter added that minimum building requirements are set up but we can't regulatethe maximum size of a building as long as it meets the set backs. Because of the attitude of the Villagers :concerning all zoning dis_ cussions, Mr. Franco made the following statements: that the people lose sight of the fact that the Council must sit as judges on any petition for a change in zoning; that the Council gets criticized for zoning changes that have been forced on us by the Supreme Court, as in the case of the Wolfe property north 98 e . �V 6/15/54 -S- of the Canal and the business property on N. E. 2nd Avenue; that the Council hasn't made one zoning change that hasn't benefited the Village. To further explain his feelings, Mr. Franco went on to say: 1. That over 7576 of the total net worth of each Councilman is represented by the value of his home in the Village and none of the Councilmen are foolish or stupid enough to take any action that would affect the value of their homes. 2. That all the Councilmen have been residents of the Village for a long time and that they have had much to do with its present reputation of being the best residential area in the County, which was probably the reason that was responsible for most of the recent residents coming to the Village. 3. That the length of service of the Councilmen on this Village Council runs from 2 to 13 years, with a majority of them serving over 5 years. 4. That the Councilmen ran for the office because they were civic-minded and not because of self interest nor the salary involved, $1.00 per year. 5. That the only time many of the Villagers attend any Council meetings is when a zoning case comes up and not at any . other time, sa that many of the people present feel that zoning is the only business of the Council. There are other important questions such as budget and parking. 6. The Council spends many evenings in special meetings to set the policy for many of the operations of the Village. Discussion followed as to whether or not laboratory tests would constitute clinical work but the main contention seemed to be against the size of the building in comparison with the average residence. Mr. Carpenter then moved that we table this matter temporarily and take the suggestions under advisement. Motion was seconded by Mr. Claussen and passed unanimously. Mr. Victor Marquette, former owner of the Village Inn Restaurant, 4(100 101 - 6/15/54 asked the Council if he could get a beer and wine license for a small restaurant to be located across from Tropical Chevrolet. The Council unanimously turned down this request. The meeting adjourned at 6:00 P.M.
