09-01-1953 Regular Meeting 139 REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL September 1, 1953 A regular meeting of the Village Council of Miami Shores Village, Florida, was held at 4:00 o'clock P. M. , September 1, 1953, at the Village Hall, with the following Councilmen present: Mayor S. D. Phillips, Jr. M. E. Reynolds William E. Carpenter Michael J. Franco Dean R. Claussen Absent: None Mr. Herbert Nadeau attended in the absence of Mr. Anderson, Village Attorney. Minutes of the last regular meeting were approved by motion made by Mr. Franco, seconded by Mr. Reynolds and passed unanimously. Dr. E. C. Kelly Geiger of 112 N. E. 93rd Street, appeared before the Council in regard to a long standing complaint by one of the neighbors concerning the operation of two air conditioning units in his home. Dr. Geiger submitted a statement and report substantiating his efforts to lessen the noise through engineering assistance and new equipment. He pointed out that nothing he had done appeased his neighbor and that he was continually being harassed over the operation of these air conditioners. The Council assured him that it had never taken any part in this quarrel and that the Police Dept. would be instructed to refrain from bothering Dr. Geiger when called in regard to this noise complaint. 140 141 -2- 9/1/53 The next item was in regard to police protection at street inter- sections where school children cross. The Village Manager reported that numerous demands are being made for Policemen at many more inter-sections than it is possible to cover. It was also suggested by one of the Villagers present that the mothers be .called upon to help in this policing. Concern- ing the need for an officer at 96th St. and the Boulevard, the Chief said he would make a count before deciding whether or not this spot should be covered. It was also suggested that the man at 91st St. and Miami Ave. be used at some other spot where the younger children must cross alone. An ordinance was read authorizing the adoption of the State pension plan for Police officers through the assessing of a 116 tax on all premiums on casualty insurance written in the Village. Upon motion made by Mr. Reynolds, seconded by Mr. Claussen, ORDINANCE NO. 248 was unanimously passed and adopted, same being entitled: AN ORDINANCE ASSESSING AND IMPOSING ON EVERY INSURANCE COMPANY, CORPORATION OR OTHER INSURER NOW ENGAGED IN OR CARRYING ON, OR WHO SHALL HEREAFTER ENGAGE IN OR CARRY ON THE BUSINESS OF CASUALTY INSURANCE AS SHOWN BY THE RECORD OF THE STATE TREASURER IN HIS CAPACITY AS STATE INSURANCE COMMISSIONER, AN EXCISE OR LICENSE TAX IN ADDITION TO ANY LAWFUL LICENSE OR EXCISE TAX NOW LEVIED BY MIAMI SHORES VILLAGE, AMOUNTING TO ONE (116) PER CENT OF THE GROSS AMOUNT OF RECEIPT OF PREMIUMS FROM POLICYHOLDERS ON ALL PREM- IUMS COLLECTED ON CASUALTY INSURANCE POLICIES COVERING PROPERTY WITHIN THE COR- PORATE LIMITS OF MIAMI SHORES VILLAGE, FLORIDA. 142 -3- 9/l/53 An ordinance was read requiring fences around swimming pools, specifically calling for a minimum height of four feet with design to be approved by the Planning Board. Upon motion made by Mr. Franco, seconded by Mr. Reynolds, ORDINANCE NO. 249 was unanimously passed and adopted, same being entitled: AN ORDINANCE REQUIRING THAT THE OWNERS OF ANY PROPERTY SITUATED WITHIN THE LIMITS OF MIAMI SHORES VILLAGE AND UPON WHICH THERE IS CONSTRUCTED A SWIMMING POOL SHALL FENCE THE SAME, AND PROVIDING FOR A TIME WITHIN WHICH SUCH PERSONS ARE REQUIRED TO COMPLY WITH THIS ORDINANCE, AND FIXING A PENALTY FOR VIOLATION THEREOF. No action was taken on the subject of building sidewalks along Biscayne Blvd. in the business and apartment zones. A request was again made for tax exemption on the Presbyterian Church parking lot in view of the exemption by the County. The Village Manager was instructed to check into the reasons for this exemption and report back to the Council. The audit report for the year 1952-53 was received from Ring, Mahony and Arner. After a discussion of the expenses being incurred at the pistol range, the bills were approved by motion made by Mr. Reynolds, seconded by Mr. Franco and passed unanimously. Mr. Carpenter requested that he be in on all cost discussions on the improvements to the range so that if there is not sufficient money to complete it, he can attempt to supplement this money from other sources. 145 -4- 9/l/53 Mayor Phillips stated he would arrange a meeting with the P. T.A. of the Miami Shores School, Catholic school and Horace Mann School to see if they can work out a safety program for school crossings. The Mayor also mentioned the Parking Survey Committee named on July 21, 1953, with Mr. McElwain as chairman and asked that this be brought up again at the next Council meeting. In reviewing the Country Club financial statement for August, Mr. Carpenter suggested that now that school has started, why not open the pool to outsiders for additional revenue since there are not as many using it now. It was requested that the daily reports on last year's operation of the pool be reviewed for further discussion as to its operation for the fall and winter season. A request was made by one of the Villagers present for a street light at 101st Street and West Railroad Avenue. A report was requested on the advisability of furnishing free meals to certain Club employees. The meeting was adjourned at 5:55 P.M.
