SPECIAL MEETING
MIAMI SHORES VILLAGE COUNCIL
March 26, 1953
The Miami Shores Village Council held a special meeting on Thursday,
March 26, 1953, with all members present except Mr. Carpenter.
The matter of the Planning Board's approval of a filling station to be
located on the southeast corner of N. E. 2nd Avenue and 99th Street wherein
the Board had made such approval provided the filling station at N. E. 2nd
Avenue and 96th Street be demolished and confirmed at a previous meeting of
the Council, was re-considered. In view of the fact that the owner of the
property at the N. E. 99th Street and 2nd Avenue location, being Sinclair Refin-
ing Company, had no control over the demolishment of the old station at 96th
Street and 2nd Avenue and in view of the fact that the Council is considering
the enactment of an ordinance which regulates the spacing of service stations,
and inasmuch as there is a likelihood that the owners of the service station
at N. E. 2nd Avenue and 96th Street will demolish that station voluntarily,
and in view of the fact that the Council had been advised by the Village Attorney
that the action of the Planning Board and subsequent confirmation of the Council
was illegal, it was therefore moved by Mr. Phillips that the Council approve
the issuance of the permit for a filling station to be erected by Sinclair Refin-
ing Company at the southeast corner of N. E. 2nd Avenue and 99th Street without
the previous restriction imposed by the Planning Board as to the demolishment
of the old station at 96th Street and 2nd Avenue. The motion was seconded by
Mr. Franco and unanimously carried with Mr. Frix not voting.
The meeting was then adjourned.
